THIS AGREEMENT, made and entered into this 7th the day of April
19 92 by and between the City of Redlands, a municipal Corporation,
organized and existing under the laws of the State of California, hereinafter
referred to as the "City" and Petar Artukovich Construction Company Inc Cf ttn
FCity of Whittier
County of Los Angeles State of California, hereinafter referred
to as the "Contractor" .

WITNESSETH: That the City and the Contractor, for the consideration
hereinafter named, agree as follows:
1. SCOPE OF WORK: The Contractor will furnish all materials, labor,
equipment, tools and incidentals required to perform all of the work for the
following:
Center Trunk Sewer - Phase III, Project No. 14-7462-4610, in accordance
with the Contract Documents.
2 . THE CONTRACT SUM: Actual Payment shall be in accordance with the
Contract Documents. *$687,180.00*
3 . TIME FOR COMPLETION: The work to be completed within One hundred and
eighty, (180) calendar days from the date of issuance of the Notice to
Proceed.
4 . LIQUIDATED DAMAGES: Failure of the Contractor to complete the Work
within the time allowed will result in damages being sustained by the City .
L Such damages are, and will continue to be, impracticable and extremely
f difficult to determine. For each consecutive calendar day in excess of the
itime specified, as adjusted in accordance with the specifications, fbr
L completion of the Work the Contractor shall pay to the City, or have withheld
i from monies due it, the sum of one thousand dollars ($1,000. 00) .
Execution of the Agreement shall constitute agreement by the City and
Contractor that $1, 000. 00 per calendar day is a minimum value of the costs
and actual damage caused by failure of the Contractor to complete the Work
within the allotted time, that such sum is liquidated damages and shall not
be construed as a penalty, and that such sum may be deducted from payments
due the Contractor if such delay occurs.

5. CONTRACT DOCUMENTS: The complete contract includes all of the contract
documents set forth herein, to wit; Notice Inviting Bids, Proposal Documents,
General Specifications, Special Provisions, Agreement, Faithful Performance
Bond, Labor and Material Bond, Plans and Specifications and any addenda
thereto.
6. ATTORNEY'S FEES: In the event any action is commenced to enforce or
interpret the terms or conditions of this Agreement, the prevailing party
shall, in addition to any costs or other relief, be entitled to its
reasonable attorney's fees.
IN WITNESS WHEREOF, the parties hereto have executed this Agreement the day

said contract required to be performed on their part, at the times and in the
manner specified therein, then this obligation shall be null and void,
otherwise it shall remain in full force and in effect for a period of one
year from the date of completion specified in the Notice of Completion.
PROVIDED, that any alterations in the work to be done or the materials to be
furnished, which may be made pursuant to the terms of said contract, shall
not in any way release said Contractor or said Surety thereunder, nor shall
any extensions of time granted under the provisions of said contract release
either said Contractor or said Surety, and notice of such alteration or
extensions of the contract is hereby waived by said Surety.

to be fixed bythe court. This bond shall inure to the benefit of any
persons, companies, or corporations entitled to file claims under applicable
State law and will remain in force until 90 days after completion.

Labor code Section 3700 provides, in part:
"Every employer except the State and all political subdivisions or
institutions thereof, shall secure the payment of compensation in one or
more of the following ways:
(a) By being insured against liability to pay compensation in one or
more insurer duly authorized to write compensation insurance in
this State.
(b) By securing from the Director of Industrial Relations a certificate
of consent to self-insure, which may be given upon furnishing proof
fi satisfactory to the Director of Industrial Relations of ability to
self-insure and to pay any compensation that may become due to his
employees" .
I am aware of the provisions of Section 3700 of the Labor Code which require
every employer to be insured against liability for worker compensation or to
undertake self-insurance in accordance with the provisions of that code, and
I will comply with such provisions before commencing the performance of the
work on this contract.
