HomeMy WebLinkAboutContracts & Agreements_165A-2020Rin Co ultonts First An end FY20-0013 FIRST AMENDMENT TO THE AGREEMENT FOR THE PROVISION OF PROFESSIONAL ENVIRONMENTAL CONSULTING SERVICES FOR A PRIVATE PROJECT This first amendment ("First Amendment") to the agreement dated the 3rd clay of June, 2020 ("the Agreement") by and between the City of Redlands, a municipal corporation ("City") and Rincon Consultants, Inc. ("Consultant"), is made and entered into this 22nd day of July, 2020. RECITALS WHEREAS, it is the desire of City and Consultant to amend Exhibit`A of the Agreement, titled `Scope of Services, to include the additional services described in Exhibit '1" which is attached hereto and incorporated herein by reference; and WHEREAS, it is the desire of City and Consultant to amend Article 5.1 of their existing Agreement to increase Consultant's present total compensation of seventy thousand ninety-six dollars ($70,096) to the amount of eighty thousand seven hundred and seventy-three dollars ($80,773); NOW THEREFORE, City and Consultant agree as follows: AGREEMENT Section 1. The scope of work performed by Consultant pursuant to Exhibit "A of the Agreement, titled `Scope of Services, is hereby amended to include the work that is identified in Exhibit '1. Section 2. Article 5 of the Agreement, entitled `Payments to Consultant' is hereby amended to read as follows: '5.1 The total compensation for Consultant's performance of the Services shall not exceed the amount of eighty thousand seven hundred and seventy-three dollars ($80,773). City shall pay Consultant on a time and materials basis up to the not to exceed amount, in accordance with Exhibit `E, titled Additional Compensation,' which is attached hereto and incorporated herein by this reference. Section 3. All other provisions of the Agreement shall remain unchanged by this First Amendment and in effect. 1 Llen \dlmNgr nts\Rin n Co ullants First An nd FY20-0013 do IN WITNESS WHEREOF the parties involved have executed this First Amendment to be effective on July 22 2020 CITY OF REDLANDS -4actt\6jtaavviaL A644" 614'- �` harles M Duggan Jr , City Manager f .+' en, Principal in Charge RINCON CONSULTANTS, INC Attest e Donaldson, City Clerk EXHIBIT "A" ADDITIONAL SCOPE OF SERVICES Work Program Subtask 2 7 Noise Report To address noise and vibration impacts associated with the proposed project, Rincon will conduct noise measurements, modeling, and prepare an analysis Rincon will review the project description, the anticipated construction activities, and project plans A field survey will be conducted to ascertam the existing noise levels at key locations within the project area. To characterize the existing noise environment, one 24-hour noise measurement will be taken at on the project site and up to four short-term (10 to 30 minute) ambient and traffic noise level measurements will be taken at locations representing off-site receivers Manual traffic counts will be conducted during each measurement as feasible No vibration measurements are proposed However due COVED 19 considerations, noise measurements may not be representative of normal baseline conditions, therefore Rincon will include an evaluation of other background noise sources for the project area Construction noise and vibration levels under unmitigated and mitigated scenarios will be evaluated based on Federal and State methodologies. The projected noise and vibration levels from project construction will be compared with the City of Redlands noise ordinances policies and standards Vibration levels will be calculated in terms of peak particle velocity for structural evaluations and vibration decibels for human annoyance evaluations. Specific construction equipment noise will be used to calculate resultant noise levels at those receptors The analysis of long-term operational noise impacts associated with the proposed project will include noise increases generated by vehicle traffic on area roadways and noise from on site equipment Rincon will calculate traffic noise levels for existing and future conditions, such as existing, existing plus project, and cumulative with and without project scenarios, based on forecasted traffic volumes as identified m the traffic report being prepared for this project Rincon will use this information to determine if increases to roadway noise levels would adversely affect noise sensitive land uses in the vicinity It is assumed that the traffic report prepared for the project will contain the necessary traffic information needed for the noise analysis On-site operation noise generated by the project will be based on anticipated mechanical ventilation equipment, loading docks, or other prepared equipment, using standard reference noise levels for similar construction industry equipment The SoundPLAN model will be used to calculate noise levels at specific receiver locations and develop noise level contour maps in 5 decibel increments The noise and vibration analysis will be summarized in a technical report that includes a description of the project, a discussion of the applicable federal, state, and local regulations and standards, an explanation of study methodology, a summary of air quality impacts and, an identification of mitigations measures, as necessary Task 4 Project Management This task is being expanded to include progress meetings (telephone conferences) with the City and Project Applicant every two weeks An hour for each meeting has been included in the budget with a half-hour for call preparation and a half-hour for telephone conferences Up to 18 meetings are assumed EXHIBIT 13 ADDITIONAL COMPENSATION The budget for the additional work described herein is $10,677.00, for a revised total budget of $80,773.00 for the project, and shall be paid in accordance with the Hourly Rates (per Exhibit 13) in the Agreement. 5
