A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS
DETERMINING THAT THE PROVISIONS OF GOVERNMENT CODE SECTION
65402 ARE INAPPLICABLE TO THE ACQUISITION OF CERTAIN EASEMENTS
ASSOCIATED WITH THE CITY'S REDLANDS BOULEVARD AND COLTON
STREET INTERSECTION IMPROVEMENTS PROJECT
WHEREAS, Government Code section 65402 generally provides that, when real
property is to be acquired or disposed of by the City, the City's Planning Commission
must render a report to the City Council as to the conformity of such acquisition or
disposition with the City's General Plan, and
WHEREAS, Government Code section 65402, also provides that, by resolution,
the City Council may deteinnne that the section's requirements shall not apply to (1) the
disposition of the remainder of a larger parcel which was acquired and used in part for
street purposes; (2) acquisitions, dispositions, or abandonments for street widening, or (3)
alignment projects, provided such dispositions for street purposes, acquisitions,
dispositions, or abandonments for street widening, or alignment projects are of a minor
nature, and
WHEREAS, the City Council has deemed the improvements to the intersections
of Redlands Boulevard and Alabama Street, and Redlands Boulevard and Colton Street,
are necessary and a priority, and
WHEREAS, the City desires to expeditiously complete the afore -mentioned
intersection improvements,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Redlands as follows.
Section 1 The City Council of the City of Redlands hereby determines that the
requirements of Government Code section 65402 shall not apply to the acquisitions of the
easements designated on Exhibit "A," attached hereto, which are proposed to be acquired
for street widening purposes, or for realignment purposes, in connection with the
construction of improvements to the intersections of Redlands Boulevard and Alabama
Street, and Redlands Boulevard and Colton Street, and that such easement acquisitions
are of a minor nature
