WALIK R, Director Mransporl~ationfFlood Control/Airports SUBJECT: ESTABLTS10= OF AN AD= SCHOOL CROSSING GUARD AT cRAFTCON AVaRJEE AND MW= BXIEVARD (SH38) , r WMM AREA RECOMMENDATION: Approve agreement with the City of Redlands to establish an adult school crossing guard at the intersection of Crafton Avenue and Mentone Boulevard, located near Mentone School, in the vicinity of Mentone. BACKGROtJND INFO TIC>N: The Transportation Department received a request from representatives of the Mentone School to study the passibility of establishing an adult crossing guard at Mentone Elementary School, in the Mentone area. A new housing development, which has expanded the number of elementary school students crossing Mentone Boulevard, as well as heavy growth in the area, prompted the Transportation Department to recommend a crossing guard at the October, 1986 Traffic Committee Ming. REASONS FOR RECOMMENDATION: The Traffic Committee, at its regular meeting on October 14, 1986, recomm�..nded the ;installation of an adult school crossing guard at the intersection of Crafton Avenue and Mentone Boulevard, based on the State Crossing Guard Warrants. The Board has approved this new crossing guard; however, contract negotiations have just been concluded with the City of Redlands. REVIEW BY OTHER DEFARTMETI'S: Deputy County Counsel Ed Robinson reviewed and approved the Contract on April 17, 1987. FTNANCIAL DATA: The annual cost to the Transportation Department to establish and maintain an adult crossing guard at this location is approximately $5,400.00. PRESENTER: Michael G. Set forth service to be rendered,amount to be paid,manner of payment, time for performance or completion, determination of satisfactory performance and cause for termination, other terms and conditions,and attach plans,specifications,and addenda,if any.) THIS AGREEMENT is entered into in the State of California by and between the COUNTY OF SAN BERNARDINO, hereafter called the "County", and the CITY OF REDLANDS, hereafter called "City" . It is hereby agreed as follows: 1. Recitals. (a) County is desirous of providing school crossing guards at various locations in the unincorporated portion of the County. (b) City presently operates a school crossing guard program within its incorporated area. (c) City is willing to provide school crossing guards for County at specified locations, provided City is fully reim- bursed by County for all wage, salary and benefit costs, and an agreed reimbursement for administrative costs, and provided that City is fully indemnified and held harmless by County for all risks attendant to the provision of this service in the unincorp- orated area. 2Provision of Guards. The City shall train and supervise and provide crossing guards at each of the locations shown on School Crossing Guard Location List, marked Exhibit "I", attached and incorporated in this agreement by this reference, during the hours prescribed by the school districts and agreed to by City and County as hours when pupils are walking to and from nearby schools on school days. Salaries and wages of crossing guards shall be at rates usual for such services , as the City may determine. The training and supervision of crossing guards shall be the same as provided the crossing guards working within the City. Relief guards for regular crossing guards shall have completed the same training as referred to above. 3. Reimbursement. As consideration for the satisfactory performance of the foregoing services, County agrees to reimburse City for salaries and wages and other such benefits as City normally provides to crossing guards, including but not limited to any workers' compensation benefits or payments which City may be required to make to or on behalf of any person employed by City in the performance of this agreement. Billing and Payment. Not later than thirty (30) days after the close of each month, City shall bill County for all sums due for that month and County shall pay the same within fifteen (15) days. 5. Change of Crossing Guard Locations. From time to time during the term hereof, County may, by order of its Board of Supervisors and delivery of certified copy thereof to City, delete from Exhibit "I" one or more of the crossing guard loca- tions, whereupon City shall within 10 days remove such guard and the obligation of County to pay therefore shall cease thereafter; and in the same manner, County may add one or more locations to Page _2 of 3 said list., whereupon the City shall within 10 days provide additional crossing guards under the terms of this agreement. City shall give County written notice thirty (30) days in advance of discontinuing any of the crossing guard services called for in this agreement. 6. Termination. This agreement may be terminated by either party upon thirty (30) days prior written notice. 7 . Hold Harmless. County agrees to, and shall, indemnify and hold City, its elective and appointive boards, commissions, officers, agents and employees harmless from any liability for damage or claims for damage for personal injury, including death, as well as from claims for property damage which may arise from City's operations under this agreement, whether such operations be by City or by any one or more persons directly or indirectly employed by or acting as agent for City. County agrees to and shall defend City and its elective and appointive boards, commis- sions, officers, agents and employees from any suits or actions at law or in equity for damages caused, or alleged to have been caused, by reason of any operations under this agreement. 8 . Attorney's Fees. In the event any legal action is commenced to enforce or interpret the terms or conditions of this Agreement, the prevailing party shall, in addition to any other costs and relief, be entitled to reasonable attorney's fees. 9.
