A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS
APPROVING SIGN CONDITIONAL USE PERMIT NO. 12 TO CONSTRUCT A
FREEWAY -ORIENTED SIGN (APPLICANT TOYOTA OF REDLANDS)
BE IT RESOLVED by the City Council of the City of Redlands as follows:
Section 1. The City Council of the City of Redlands hereby approves the Mitigated
Negative Declaration for Sign Conditional Use Permit No. 12 in the form attached hereto as
Exhibit A.
Section 2. The City Council of the City of Redlands hereby approves Sign
Conditional Use Permit No. 12, subject to the conditions of approval attached hereto as Exhibit
"B," and based upon the following findings:
(1) The size of the sign is compatible with the design, architecture, and scale of
the building(s) and/or project because the building for the Toyota of Redlands
dealership has a modern design with a white and gray exterior, and the sign
will also have a similar modem design with a white sign cabinet and gray top
and bottom cap. Also, the dealership building has an area of 70,000 square
feet and is located on approximately eight (8) acres with over 600 feet of
frontage along New York Street and over 1,000 feet of frontage along the
freeway the sign, at 578 square feet and 80 feet height, is large enough to be
proportional to the scale of development found at the project site.
(2) The size of the sign is aesthetically consistent with the project, adjacent areas,
and the City of Redlands; the building for the Toyota of Redlands dealership
has a modern design with a white and gray exterior, and the sign will also
have a modern design with a white sign cabinet and gray top and bottom cap.
In addition, the internally illuminated freeway oriented sign is aesthetically
consistent with the adjacent urban setting as there are several other internally
illuminated, freeway oriented signs in the area including two (2) 80 -foot high
freeway oriented signs for the Tri -City Center each with an area of
approximately 700 square feet, a 55 feet high 98 square foot Carl's Jr. sign, a
75 foot high 120 square foot II -IOP sign, and an 82 foot high 120 square foot
Old Spaghetti Factory Sign as well as numerous others along the I-10 in the
City of Redlands.

The size of the sign is needed to provide additional necessary project
identification for the benefit of the general public because the project is
located just north of the Caltrans right of way and is situated approximately 20
feet lower than freeway lanes. The site is visible from the westbound lanes;
however, it is very difficult for customers to identify the site from the
eastbound lanes. With the addition of the sign, customers will be able to
identify the site when traveling eastbound on the I-10 Freeway In addition,
the proposed sign will have four (4) separate panels that can accommodate

additional product lines m the future m a single easily recognizable sign,
minimizing visual clutter that would benefit the general public

SIGN CONDITIONAL USE PERMIT NO. 12
Applicant: Toyota of Redlands

1 The approval is for a Conditional Use Permit to permit a freeway -oriented
sign with an area of 578 square feet, with four (4) 120 square foot sign
panels, and a height of 80 feet for Toyota of Redlands located at 921 New
York Street in the EV/CG (General Commercial) District of the East Valley
Corridor Specific Plan.
2. This project shall comply with all permits requirements of the Redlands
Municipal Code.
3 The applicant shall obtain Building Permits from the Community
Development Department.
4 All plans submitted to the City shall reflect all City Council approvals and
any other changes required by the City Council and/or staff The time and
temperature display shall be removed from the freeway oriented sign.
This condition applies to site plans, elevations, and all other illustrations,
text, or plans submitted to the city in connection with the project.
As Amended by the City Council on April 20, 2010.
5 To• •mitigate the potential• impacts identified in Sections 1(c -d) of the
Environmental Checklist relative to aesthetic characteristics for the
property the applicant shall limit the sign to have a height of no more than
80 feet so as not to create an adverse impact to aesthetics in the general
area. (Mitigation Measure No. 1)
6. To mitigate the potential impacts identified in Sections 1(c -d) of the
Environmental Checklist relative to aesthetic characteristics for the site the
applicant shall use an opaque background for the sign so that only the
sign lettering and accent bands will be illuminated during the evening.
(Mitigation Measure No. 2)
7 The applicant for this permit, and its successors and assigns, shall defend,
indemnify and hold harmless the City of Redlands, and its elected officials,
officers, agents and employees, from and against any and all claims,
actions, and proceedings to attack, set aside, void or annul the approval of
this permit by the City or brought against the City due to acts or omissions
in any way connected to the applicant's project that is the subject of this
permit. This indemnification shall include, but not be limited to damages,
fees, costs, liabilities, and expenses incurred in such actions or
proceedings, including damages for the injury to property or persons,
including death of a person and any award of attorneys' fees. In the
event any such action is commenced to attack, set aside, void or annul all,
or any provisions of this permit, or is commenced for any other reason
against the City for acts or omissions relating to the applicant's project,
within fourteen (14) City business days of the same, the applicant shall file
with the City a performance bond or irrevocable letter of credit (together
the 'Security") in a form and in an amount satisfactory to the City to
ensure applicant's performance of its defense and indemnity obligations
under this condition. The failure of the applicant to provide the Security
shall be deemed an express acknowledgement and agreement by the
applicant that the City shall have the authority and right, without objection
by the applicant, to revoke all entitlements granted for the Sign Conditional
Use Permit pursuant to this permit. The City shall have no liability to the
applicant for the exercise of City's right to revoke this Sign Conditional
Use Permit

The project would develop a two sided freeway -oriented sign with an area of 1 116 square
feet and a height of 80 feet for Toyota of Redlands located at 921 New York Street in the
EV/CG (General Commercial) District of the East Valley Corridor Specific Plan. The sign
would be located along the project site's frontage along New York Street, and would be
placed approximately 100 feet from the 1-10 Transition lane to the 210 Freeway and
approximately 180 feet from the actual 1-10 Freeway travel lane. The sign will consist of a
single pedestal support with a height of 47'-8' Within the pedestal a time and temperature
display is proposed. This pedestal will support a four (4) paneled sign that will be internally
illuminated. Each of the panels will be 6'4' tall and 34'-6' wide.

EVALUATION OF ENVIRONMENTAL IMPACTS:
1) A brief explanation is required for all answers except 'No Impact' answers that are
adequately supported by the information sources a lead agency cites in the parentheses
following each question. A 'No Impact' answer is adequately supported if the referenced
information sources show that the impact simply does not apply to projects like the one
involved (e.g. the project falls outside a fault rupture zone). A "No Impact" answer should
be explained where it is based on project -specific factors as well as general standards (e.g.
the project will not expose sensitive receptors to pollutants, based on a project -specific
screening analysis).
2) All answers must take account of the whole action involved, including off-site as well as on-
site, cumulative as well as project -level, indirect as well as direct, and construction as well
as operational impacts.
3) Once the lead agency has determined that a particular physical impact may occur then the
checklist answers must indicate whether the impact is potentially significant, less than
significant with mitigation, or less than significant. 'Potentially Significant Impact' is
appropriate if there is substantial evidence that an effect is significant. If there are one or
more "Potentially Significant Impact" entries when the determination is made, an EIR is
required.
4) 'Negative Declaration: Less Than Significant With Mitigation Incorporated" applies where
the incorporation of mitigation measures has reduced an effect from "Potentially Significant
Impact" to a 'Less than Significant Impact" The lead agency must describe the mitigation

Section 15063(c)(3)(D). In this case, a brief discussion should identify the following:

b) Impacts Adequately Addressed. Identify which effects from the above checklist
were within the scope of and adequately analyzed in an earlier document pursuant
to applicable legal standards, and state whether such effects were addressed by

Measures Incorporated," describe the mitigation measures which were incorporated
or refined from the earlier document and the extent to which they address site-
specific conditions for the project.
6) Lead agencies are encouraged to incorporate into the checklist references to information
sources for potential impacts (e.g. general plans, zoning ordinances). Reference to a

La -c) The project is located north of the 1-10 Freeway in an urbanized area of the City and
involves the development of a 1 116 square foot freeway oriented sign with an overall
height of 80 feet. The actual face of the sign will have an area of approximately 976
square feet and will be 34'-6' wide and 28'-4' tall. Although the area is urbanized, the only
other freeway oriented signs in excess of 120 square feet are west of the project site, on
the south side of the 1-10 Freeway at the Tri -City Center The construction of a new
freeway oriented sign north of the freeway could potentially have an adverse effect on the
area by degrading the visual character of the surroundings.
Pursuant to the City's Sign Ordinance a flag test was conducted for the site to establish the
minimum height needed for visibility from east and west bound lanes of the 1-10 Freeway
The test determined that a sign with a height of 75 feet would be visible from the east
bound lanes of the 1-10 Freeway from a distance of 3/10 of a mile from off -ramps closest
to the site at Tennessee Street. Although the sign has a height of 80feet (to accommodate
a sign cap) the top of the sign will be at 75 feet, consistent with the flag test. Mitigation
Measure No. 1 shall require that the sign have a height of no more than 80 feet so as not
to create an adverse impact to aesthetics in the general area.
As mentioned above the project site is in an urbanized area near the City's Major
commercial corridors of Lugonia Avenue and Colton Avenue. Existing nearby businesses
include a Home Depot home improvement store, a Jack in the Box drive -though
restaurant and 7 -Eleven convenience store located to the north and the Empire Bowing
Alley Redlands Blueprint, Shakey's Restaurant to the east. In addition the project is

bounded on the south and west by the westbound 1-10 Freeway transition lane to the 210
Freeway and the 1-10 Freeway further south. Although the proposed sign is large it is in
keeping with signs found in heavily commercialized areas. As such development of the
sign will not generate a significant impact to aesthetics nor degrade the appearance of the
general area.
The sign will be illuminated during evening hours. Illumination of the entire sign cabinet
would create an adverse impact as It would introduce a significant amount of lighting to the
area affecting nighttime views and degrading night time aesthetics in the general area. In
order to reduce impacts to aesthetics from sign illumination Mitigation Measure No. 2
shall require the applicant to us an opaque background for the face of the sign so that only
sign lettering will be illuminated during the evening hours.
The project will develop a freeway oriented sign that will be internally illuminated. The
illumination of the sign would create an adverse impact as described above. Through the
implementation of Mitigation Measure No. 2 the applicant will insure that the project does
not create light or glare that would affect day or nighttime views in the area.
Issues:
ii. AGRICULTURE RESOURCES. In determining
whether impacts to agricultural resources are
significant environmental effects, lead agencies may
refer to the Califomia Agricultural Land Evaluation
and Site Assessment Model (1997) prepared by the
California Dept. of Conservation as an optional

Il.a-c) Adoption of the proposed project will not convert lands designated as either Prime
Farmland, Unique Farmland, or Farmland of Statewide Importance by the State Farmland
Mapping and Monitoring Program to non-agricultural use. According to Figure 5.2 of the
MENEIR the site has a designation of D Urban Lands. The property is developed with a
building and is located in an urbanized area. Additionally the property has a commercial
zoning of EV/CG (General Commercial) District of the East Valley Corridor Specific Plan
and a General Plan designation of Commercial/Industrial. It is not in an agricultural
preserve or subject to a Williamson Act contract and will not result in changes to the
environment. No mitigation is required.

native resident or migratory fish or wildlife species or with established native resident or
migratory wildlife corridors, or impede the use of native wildlife nursery sites. The project
site is not identified in the Biotic Resources Map, Figure 7 1 of the MEA/EIR, as being
within an area containing resident migratory wildlife or their habitat nor is it used by wildlife
as a migratory corridor No mitigation is required,
IV.e) Adoption of the proposed project will not cause a conflict with any local policies or
ordinances protecting biological resources. No biological resources are located in this
area thus the project will not cause a conflict with any local polices or ordinances
protecting these resources. No mitigation is required.
IV.f) Adoption of the proposed project will not cause a conflict with the provisions of an adopted
Habitat Conservation Plan, Natural Community Conservation Plan, or other approved
local, regional, or state habitat conservation plan. The project site located in an urbanized
area of the City and is not subject to any conservation plan. No mitigation is required.
