(Use of Residence at 11126 Iowa Street)
THIS AGREEMENT is made and entered into this 16th day of
October 1 1990 , by and between the CITY OF REDLANDS
a municipal corporation, hereinafter referred to as "City"
and Luisa Serrano an individual, hereinafter
referred to as "Tenant" .
W I T N E S S E T H:
1. RENTAL OF CITY PROPERTY. Tenant hereby rents the
premises located at 11126 Iowa Street, Redlands, California,
( "the City Property" ) with a rental payment of $ 820.00
per month, which shall be paid on the 1st day of each month until
termination as provided for hereunder.
2 . IMPROVEMENTS. Tenant shall obtain permission of the
Director of Community Services prior to making any improvements
or alterations to the City Property. Tenant shall not incur any
costs payable by City without prior written consent of the
Community Services Director. Tenant shall reimburse City for
any willful damage to the City Property and for any costs incurred
due to unapproved improvements or alterations. City shall handle
all major construction and refurbishing projects .
3 . ASSIGNMENT. The rights of Tenant may not be assigned or
sublet to any other person without the prior written consent of
City.
4 . INDEMNITY. Tenant hereby agrees to, and shall hold
City, its elected officials, officers, agents and employees
harmless from any liability for damage or claims for damage for
personal injury, including death, as well as from claims for
property damage which may arise from Tenant' s occupation of the
City Property under this Agreement, whether by Tenant or by any
one or more persons directly or indirectly employed by or acting
as agent for Tenant. Tenant agrees to and shall defend City, and
its elected officials, officers , agents and employees from any
suits or actions at law or in equity for damage caused, or alleged
to have been caused, by reason of any of the aforesaid.
S. SUCCESSORS IN INTEREST. This Agreement and the terms ,
covenants, and conditions hereof apply to and are binding on the
heirs, successors, executors , administrators, and assigns of the
parties hereto.
6 . PREVENTION OF WASTE. Tenant shall not commit, or allow
to be committed, any waste on the City Property, or nuisance, nor
shall it use or allow the City Property to be used for any unlaw-
ful purpose.
7 . UTILITIES. City shall provide and pay for all reasonable
water, sewer and refuse charges incurred by Tenant. Tenant shall
pay for all electrical and natural gas utilities and telephone.
8 . SURRENDER OF PREMISES. Upon termination of this Agree-
ment, Tenant shall surrender the premises in as good condition and
repair as reasonable and proper use shall permit.
9 . EFFECT OF BREACH. If Tenant fails to perform any of
his/her duties hereunder, it shall constitute a Breach of this
Agreement and City shall have the right to immediately terminate
this Agreement in accordance with law.
10. INSPECTION. The City' s Community Services Director , or
his designee, shall have the right to enter on the City Property
at reasonable times to inspect the residence and surrounding
areas to insure compliance with this Agreement.
11 . TERM. The term of this Agreement shall be from month
to month and shall continue thereafter subject to termination
by either party by thirty ( 30 ) days written notice to the other,
and this Agreement shall terminate forthwith thirty ( 30 ) days
following the date said written notice is given.
12 . AMENDMENT. This Agreement may be amended or modified
only by written agreement signed by both parties. Failure on the
part of either party to enforce any provision of this Agreement
shall not be construed as a waiver of the right to compel
enforcement of such provision or provisions.
13 . NOTICE. All notices herein required shall be in writing
and delivered in person or sent by first class mail, postage
prepaid, addressed as follows:

14 . ATTORNEYS FEES. In the event any legal action is
commenced to enforce or interpret the terms or conditions of
this Agreement the prevailing party shall, in addition to any
other costs or relief, be entitled to recover its reasonable
attorney' s fees and costs, including court costs.
