HomeMy WebLinkAboutContracts & Agreements_1948_CCv0001.pdf AMENDMENT TO LEASE THIS AMENDMENT TO LEASE, made and entered into this day of Nov. 3 1992, by and between the City of Redlands, a municipal corporation, hereinafter called lessor, and the State of California, acting by and through the Director of the Department of General Services, hereinafter called State with the approval of the Military Department. W I T N E S S E T H WHEREAS, under terms of lease dated September 2, 1948, as amended, by and between the City of Redlands and the State of California, the State hires certain premises in the City of Redlands, and more particularly described in said lease as amended; and WHEREAS, it is the desire of the parties hereto to extend the term of the lease for an additional twenty-five years, with a new termination date of September 15, 2022; and WHEREAS, it is a desire of the parties hereto to correct the legal description of the leased premises to incorporate those changes by previous amendments; and WHEREAS, so much of Paragraph 7 as pertains to notices to be given requires correction, NOW THEREFORE, it is hereby mutually agreed between the parties hereto as follows: 1. Effective November 3, 1992 said lease is hereby amended to extend the term for an additional 25 years from the original date of termination. 2 . The description of the leased premises is amended to read that portion of Block 28, of Barton Ranch, in the City of Redlands, County of San Bernardino, State of California, as per plat recorded in Book 6 of Maps, Page 19 thereof, Records of said County, described as follows. Beginning at the intersection of the West line of the Northeast Quarter of said Block 28 and the South Line of that parcel of land as conveyed to the State of California, by deed recorded April 21, 1959 in Book 4795, Page 264, Official Records of said County being marked by a one-inch iron pipe tagged RCE1901; thence South 010 01 ' 45" East, 7.29 feet to the TRUE POINT OF BEGINNING; thence South 730 14 ' 01" East, 202 .80 feet; thence Southeasterly along a non-tangent curve of 32501 radius, concave Northwesterly whose initial radius bears North 090 54 ' 48" East, through an included angle of 040 06' 0511, a distance of 232. 64 feet; thence North 890 35' 37" East, 196.89 feet to the West line of Texas Street, a street of 80 feet right-of-way; thence along said West line of Texas Street South 010 00' 07" 120. 15 feet; thence South 890 381 25" West 619.86 feet; thence North 010 01 ' 45" West 212.98 feet to the TRUE POINT OF BEGINNING. 3. Paragraph 7 is amended to read all notices herein provided to be given, or which may be given, by either party to the other, shall be deemed to have been fully given when made in writing and deposited in the United States mail, registered and postage prepaid, and addressed as follows: To the Lessor at City of Redlands, Redlands City Hall, Redlands, CA and to the State at Military Department, P.O. Box 214405, Sacramento, CA 95821-0405. The address to which the notices shall be mailed as aforesaid to either party shall or may be changed by written notice given by such party to the other, as hereinbefore provided; but nothing herein contained shall preclude the giving of any such notice by personal service. 4. Except as amended herein, all terms and condition of said lease shall remain unchanged and in full force and effect. IN WITNESS WHEREOF, this agreement has been executed by the parties hereto as of the date first hereinabove written.
