HomeMy WebLinkAbout5646 RESOLUTION NO. 5646 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS RELATING TO THE STREET CUT WORKMANSHIP AND PERFORMANCE WARRANTY FEE. WHEREAS, Chapter 12.20 of the Redlands Municipal Code requires that all permits issued under the requirements of this chapter will include the payment of a non-refundable Workmanship and Performance Warranty Fee to the City, and WHEREAS, utilities that are a part of the City of Redlands and utilities operating under a franchise granted by the City that clearly includes an explicit obligation to repair (warranty) any restoration defects are exempt from payment of the Workmanship and Performance Warranty Fee, and WHEREAS, utilities operating under a franchise that does not have explicit obligation to warranty and repair may enter into an agreement with City that provides a warranty and security satisfactory to City and thereby, during the term of the agreement, be exempt from payment of the warranty fee, and WHEREAS, where permission to excavate in newly renovated streets has been granted, excepting therefrom those items provided in Section 12.20.030 of the Redlands Municipal Code, payment of the Workmanship and Performance Warranty Fee shall be required regardless of franchise status. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Redlands as follows: Section 1. The Workmanship and Performance Warranty Fee shall be as set forth in Exhibit "A" attached hereto are hereby adopted. ADOPTED, SIGNED AND APPROVED this 4th day of May, 1999. In cases of disputes over the existing roadway condition, the decision of the Director will be final. 'This fee is based on the City's cost to repair and resurface street trenches and includes design, cold planing, striping, etc. The square footage of cut shall be the actual footage of trench, pothole or bellhole. 3 No permittee shall be issued a permit to excavate any street which has been resurfaced or reconstructed within the past three calendar years from the date of permit application, except as provided for in RMC §12.20.030.
