THE CITY OF REDLANDS, hereinafter called "City" , and Glenn
W. Emmerson. His assignees, heirs, and successors in interest,
hereinafter called "Owner" , do hereby agree as follows:
The City agrees to relieve Owner of the property -described
-on Exhibit "A" of the responsibility of installing or enclosing
drainage facilities along the existing alignment of the drainage
canal through the southwesterlv Portion of said property, which
existing alignment is generally shown on Exhibit "A" attached.
The drainage improvements consist of installing a reinforced con-
crete pipe of adequate size to convey storm water through the pro-
perty as required by the Planning Commission as a condition to
approving a building project requested by Owner and identified as
Commission Review and Approval No. 288.
Owner agrees to perform all maintenance and repairs to the
ditch and not to use or present claims for damages from flooding
or requests for ditch maintenance to the City of Redlands or any
County, State or Federal public agency, hereinafter called "Public
Agency" , that may be responsible for flood protection in other
parts of the citv,,
Owner further agrees to hold harmless the City and any other
Public Agency from any damage claims that may be subrii tted from any
adjoining property owners that may be damaged because of protective
works, levees, walls or other devices that may divert water from
said property onto adjoining properties, and to idemnify the City
or any other such Public Agency from such claims .
The City Council has determined that improvements to this
portion of the drain will be required at some future date and the
Owner does hereby agree to install all improvements and to pay all
expenses for the installation of said improvements when determined
necessary by the City Council.

owner also agrees to provide a 4 ' high concrete block wall
along the north property line of Parcel No. 1 , (as shown on Parcel
Map #`5071 on file in the City of Redlands as Minor Subdivision No.
68) , and a 3' planter with 6" high concrete curb adjacent to and
north of said wall at such time as a change of ownership occurs
and the usage of the building ceases to be a caretaker's home.
This agreement shall be recorded with the County Recorder 's
office and shall be binding as a covenant running against the land
upon all subsequent owners of the property described in Exhibit "A" .
