BOX 3005 REDLANDS, CA 92373 Document -13485674 -Page -1 0 Electronically Recorded in Official Records County of San Bernardino Bob Dutton Assessor -Recorder -County Clerk 12/18/2020 09:06 AM SAN H6313 DOC# 2020-0515828 Titles: 1 Pages: 8 Fees Taxes CA SB2 Fee Total $0.00 $0.00 Sum $0.00 THIS SPACE FOR RECORDER'S USE ONLY PER GOVERNMENT CODE SECTION 6103 RESOLUTION NO. 8139 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS FINDING THAT A PORTION OF IOWA STREET RIGHT -OF WAY IS UNNECESSARY FOR PRESENT OR PROSPECTIVE STREET PURPOSES AND ORDERING THE VACATION OF SAID EXCESS RIGHT-OF-WAY (CITY OF REDLANDS STREET VACATION NO. 170) WHEREAS, DKC Architects, Inc. as the authorized agent for the owner of 1702 West Park Avenue, has submitted an application requesting vacation of excess public right-of-way, seven (7) feet in width and approximately one hundred sixty eight (168) linear feet in length, along the property located adjacent to the project site on Iowa Street, located at 1702 West Park Avenue as more specifically described in Exhibit A, which is attached hereto and made a part hereto (the `Street Vacation"); and WHEREAS, the City is authorized to vacate all or part of a public street easement within the City pursuant to Streets and Highway Code section 8300 et seq. and WHEREAS, pursuant to Streets and Highway Code section 8340, the City may for public convenience and necessity, reserve and except public service easements from the Street Vacation; and WHEREAS, at its meeting on July 28, 2020, as required by Government Code Section 65402, the Planning Commission made a determination that the Street Vacation conforms to the City's General Plan; and WHEREAS, on September 15, 2020, the City Council of the City of Redlands adopted Resolution No. 8134, declaring its intention to vacate such portion of W Lugonia Avenue, and set a public hearing date and time for the proposed Street Vacation; and WHEREAS, pursuant to Streets and Highways Code section 8320, the Redlands City Clerk published notice in the Redlands Daily Facts, for two successive weeks prior to the hearing, and caused the posting of notices along the proposed Street Vacation two weeks prior to the date set for the public hearing, no more than 300 feet apart, with at least three notices posted; and 1 I:\Resolutions\Res 8100-8199\8139 Appiov ng Street Vacation No. 170.doc 1/1 WHEREAS, on December 15, 2020, the City Council held a duly noticed public hearing on the Street Vacation and considered all verbal and written testimony provided by City staff and all interested persons, WHEREAS, this City Council has adopted Resolution No 8150 determining that the Project, including Street Vacation No 170, is exempt from environmental review under the California Environmental Quality Act, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF REDLANDS as follows Section 1 Approval of the Street Vacation is exempt from environmental review in accordance with the California Environmental Quahty Act ("CEQA"), pursuant to section 15061(b)(3) of the State's CEQA Guidelines because, based on the information in the staff report and presented at this hearing, it can be seen with certainty that the approval of the Street Vacation will have no physical effect on the environment Section 2 The City Council having elected to proceed under the provisions of Streets and Highways Code Section 8300 et seq , and having held a public hearing as provided therein, finds from all evidence submitted that the Street Vacation is unnecessary for present or prospective public use, and that the public interest and convenience require the Street Vacation Section 3 Pursuant to Streets and Highways Code Section 8340, the City reserves and excepts from the Street Vacation a permanent easement for in-place and future public utility facilities Section 4 Pursuant to Streets and Highways Code section 892, the portion of the Street Vacation to be vacated is not useful as a non -motorized transportation facility.
