HomeMy WebLinkAbout6440RESOLUTION NO. 6440 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS REMOVING PROPERTY FROM THE CITY'S AGRICULTURAL PRESERVE AGRICULTURAL PRESERVE REMOVAL NO. 108 WHEREAS, the City of Redlands has established an agricultural preserve pursuant to the California Land Conservation Act of 1965; and WHEREAS, the City Council has established criteria for removal of lands from within the City's Agricultural Preserve; and WHEREAS, an application has been made to remove Assessor's Parcel Nos. 300-222-21, 27, 28 and 30 from agricultural preserve status; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Redlands that: Section 1. The City Council of the City of Redlands hereby determines that (1) the applicant, Bonita Development Company, LLC is the legal owner of the property designated as Assessor's Parcel Nos. 300-222-21, 27, 28 and 30 and has filed an application in conformity with Redlands' General Plan; and (2) the land requested to be removed from the preserve abuts a developed zone other than agricultural. The site abuts a developed zone at a corner and is adjacent to land not in an agricultural preserve being proposed for re -zoning to a developed zone; (3) the application is in conformity with the City of Redlands' General Plan. The applicant's proposal will be consistent with the Guiding Policies of the Southeast Area Plan of the City's General Plan; (4) the land requested to be removed from the Preserve does not circumvent land under contract in accordance with the California Land Conservation Act of 1965. The project site is not under Williamson Act Contract; and (5) the development does not adjoin lands under Williamson Act Contract and thus will not share a common boundary with contract lands. Development of the project will not impact agricultural uses found on contract land; and (6) that the removal of the property will not adversely impact the City's goal of discouraging premature and unnecessary conversion of agricultural land to urban uses, and will not encourage discontinuous urban development patterns that unnecessarily increase the costs of community services to Redlands' citizens. Section 2. Assessor's Parcel Nos. 300-222-21, 27, 28 and 30 are hereby removed from the City's Agricultural Preserve and the City Clerk is hereby directed to amend the City's map accordingly to show the revised boundaries of the City's agricultural preserve as shown on the map attached hereto as Exhibit "A."
