This second amendment ("Second Amendment") to the agreement to provide citrus
farming services dated January 17, 2012 ("the Agreement"), by and between the City of
Redlands, a municipal corporation ("City") and Larry Jacinto Farming ("Contractor") is made
and entered into this 15th day of December, 2015. City and Contractor are sometimes
individually referred to herein as a"Party"and, together, as the "Parties."
RECITALS
WHEREAS, it is the desire of the City and Contractor to amend their existing
Agreement, specifically Section 2.1, to revise the Contractor's scope of work and total
compensation for the performance of certain Services;
NOW,THEREFORE,City and Contractor agree as follows:
AGREEMENT
Section 1. Section 2.1 of the Agreement is hereby amended to increase Contractor
compensation and shall read as follows:
"2.1 The farming services which Contractor shall perform are more particularly
described in Contractor's proposal and the Contract Documents for City's "Care,
Maintenance and Harvest of the City owned Citrus Groves" project ("Services") which
are attached hereto as Exhibit "A," and incorporated herein by this reference. In addition,
contractor shall perform addition services necessary for the replanting of I I lower acres
of Prospect. Park Citrus Grove. The Scope of services for the replanting include the
removal of the existing citrus trees, disking the soil, planting 1,400 new trees, and
installing a new and more efficient irrigation system for the additional sum of$170,000
and $126,252.56 for additional expenditures on unexpected equipment failure."
IN WITNESS WHEREOF,the parties have executed this Second Amendment, to be
effective as of December 15, 2015.
