Purpose of this agreement between the City of Redlands Parks Department and the Friends of Prospect Park (Redlands Theater Festival) is to provide for the management and supervision of the Prospect Park Amphitheater, Redlands, California. This agreement does not supersede Ordinance No. 1590, City of Redlands Park Rules and Regulations, (Attachment #1) B. This agreement expires two years after its effective date. C. Prior to expiration of the agreement, participants will recommend to the City Council that said agreement be renewed, modified, or allowed to expire. IT. RESPONSIBILITIES A. City of Redlands is responsible for: 1. Overall performance monitorship. 2. Major maintenance and repairs to both theater and grounds. 3. Removal of production trash and residue that is deposited in regular trash receptacles. 4. If any disputes or disagreementsoccur over interpretations of policy regarding the use of Prospect Park Amphitheater, the Parks and Cemetery Director shall review the facts and shall make the final decision as to the resolution, of the matter. B. Friends of Prospect Park (Redlands Theater Festival) is responsible for: 1. Direct supervision of the amphitheater use. (Attachment #2) 2. Scheduling the use of the Theater. 3. Provision of a qualified stage manager for all producing organizations at a rate of $4.00 per hour (not to exceed $16.00 per day) for the full time the theater is in use. This includes rehearsal time. Fee is to be paid by each using agency. 4. Supervision of parking at performances. 5. Insuring the security of the facility (doors and chains locked, etc) 6. Insuring that no modification is made to the existing structures and installed fixtures without prior coordination with the City:- of ityof Redlands Parks Department. USER FEES A. Due to the extensive use of the facility by the Redlands Theater Festival,- the entire opening night proceeds will be allocated to the City. The opening night performance will serve as a benefit for the theater. Ticket prices will be $8.00 and $10.00 a seat at 400 seats. Said funds are to defray costs of periodic maintenance. B. Fees for the one-time use of the theater will be $45.00 for two hours, payable in advance. C. Use of the theater beyond the two hours will be $20.00 per hour. D. Cleanup fee of $20.00 per man hour will be charged if any cleanup is necessary by Park Department employees. E. All utilities expenditures, except service head fee, are to be paid by producing agency. F. All fees will be collected by the Friends of Prospect Park (Redlands Theater Festival) and a periodic accounting of such collections made to the City Parks Department, G. City of Redlands will maintain separate accounting of funds received from Prospect Park Theater to insure fund dedication to Prospect Park Theater maintenance. IV. PARKING A. Parking in the turnaround area adjacent to the public restrooms will be limited to a total of 30 vehicles, 15 for handicapped and 15 for performers and technicians. 1. The fire lanes must be clear at all times. Vehicles must be parked on the edge of the road. 2. The speed limit will be posted at 5 mph in and out of the park. V. APPLICATION All organizations shall make regular application for theater usage and pay the existing rates or fees and none of these fees or charges will be waived for any group or organization. ur C., �7 4- Cl Cabanpirf a M. Blakeley, President Friends of Prospect Park ORDINANCE NO. 1590 AN ORDINANCE OF THE CITY OF REDLANDS ESTABLISHING RULES AND REGULA- TIONS GOVERNING THE USE OF PUBLIC PARKS AND PLAYGROUNDS IN THE CITY OF REDLANDS, AMENDING THE REDLANDS ORDINANCE CODE, AND RESCINDING ORDINANCE NO. 918 THE CITY COUNCIL OF THE CITY OF REDLANDS DOES ORDAIN AS FOLLOWS : SECTION 1. Title. This ordinance shall be known as the "Park Ordinance of the ZI—tYof Redlands. " SECTION 2. Definitions. The following words shall have the meaning indicated when used in this ordinance: (a) "Park" means any park, reservation playground, recreation area or centers, or any other area or Structure maintained and operated by the Parks Department. (b) "Director" means the Parks Director, or any other person authorized by him, pursuant to law, to act in his stead. (c) "Amplified sound" means music, sound wave, vibration, or speech projected or transmitted by electronic equipment, including amplifiers. (d) "Permit or reservation" means written authorization for exclusive use of parks or buildings or Portions thereof, as provided for and defined in this ordinance. (e) "Vehicle" means any device by which any person or property may be propelled, moved, or drawn, excepting a device moved by human power, SECTION 3. but toComl �. No person shall enter, be, or remain in any park unless he complies at all times with all of the regula- tions set forth in this ordinance applicable to such park and with all other applicable laws, ordinances, rules and regulations. Roads for Public Use . The provisions Of the California Vehicle Code ale applicable in -the 'city parks upon any way or place of whatever nature which is publicly maintained and open to the use of the public for pur- poses of vehicular travel. All violations of said Vehicle Code shall be enforced and prosecuted in accordance with the provisions thereof. (2) Surfaces other than Roads for Public use. No person Th—af_1 _driv_e—Or orherwise operate a ';�e_hl_c.le in a city park, and no person shall ride a bicycle (as defined in the California Vehicle Code) in a city park, upon surfaces other than those maintained and open to the public for Purposes of vehicular travel, except upon temporary parking areas as may be designated from time to time by the Director, and further excepting vehicles in the service of the City. (b) Solicitation Prohibited. No person shall practice, carry on, conduct or solicit for any occupation, business, or profession in any city park or building, Or sell or offer for sale any merchan- dise, article, or anything whatsoever. This section shallhotapply to any person acting pursuant to a contract with the City of Redlands, or under an authorization granted by the Parks ,Director, (C) Prohibition of Animals in Parks. No person shall cause, permit, or al1_1'o`w __�_' any animal Owned or possessed day 'lain,, or any animal in his care, custody, or control to be present in said park except: (1) Equine animals being led or ridden under reasonab"Le control upon any bridle paths or trails provided for such purposes; (2) Equine or other animals which are hitched or fastened at a Place expressly designated for such purpose; (3) Dogs or cats when led by a cord or chain not more than six (6) feet long, or when confined within the interior of a vehicle; (4) Dogs which have been specially trained and are being used by blind or disabled persons to aid and guide them in their movements; (5) Small pets which are kept on the person of the possessor at all times; (6) In connection with activities authorized in writing by the Director; (7) Fowls or animals tuned loose at the direction of the Director. Duty to Care >for Animals. It shall be the mandatory duty of all persons owning, possessing, in control of, or otherwise res- ponsible for a dog, cat, or an equine animal in a city park to promptly C011ect, pick up, and remove all fecal matter left behind by said animal in or upon said park,- provided, however, that this subsection shall not apply to guide dogs for blind or disabled persons. No person shall make or kindle a fire except in stoves provided for that purpose, or camp or lodge therein, except by permission of the Parks Director. (k) Picnicking. No person shall cook, prepare, serve, or eat any lunch, barbecue, or picnic except at the area provided therefor. I (1) Waste Liquids and Refuse. No person shall wash dishes, or empty salt water or other-waste liquids, or leave garbage, cans, bottles, papers, or other refuse elsewhere than in the receptacles provided therefor. (m) es. No person shall play or engage in any game, except- ing at such place as shall be especially set apart for that purpose, (n) Gamblina. No person shall play or bet at or against any game which is played, conducted, dealt, or carried on with cards, dice, or other device, for money, chips, shells, credit, or any other representative of value, or maintain or exhibit any gambling table or other instrument of gambling or gaming. (0) Noise. No person shall indulge in riotous, boisterous, threat enin�_, or indecent conduct, or abusive, threatening, profane, or indecent language, or disturb in any manner any picnic, meeting, services, concert, exercise, or exhibition. * (p) Advertising Matter. No person shall distribute any hand- bills or c rcula.rs, or post, place, or erect any bills, notice, paper, or advertising device or matter of any kind. I (t) Meetipqs. No person shall hold any meeting, service, con- cert, exercise, parade, or exhibition in any public park without first obtaining a permit from the Parks Director. (u) LDLriLnakkin No person shall drink any spiritous, vinous, ._a malt, or mixed liquors without obtaiaing a formal written pennit from the Parks Director. SECTION 5. Reservation of Park Areas and Structures. (a) Reservations for Activities in Park Structures. The Director s Za ae ntrolling the use of parks, or portions -thereof, for the maximum benefit and partici- pation by interested persons or groups, both public and private. All reservable areas Shall be subject to reservation from April 1 to September 15. Activities sponsored by the Parks or Recreation Depart- ments shall be given preference in the use of City parks. (b) Reservations without Formal Permits. Groups of less than fifty (50) persons desiring -16-.he use of park areas or- structures may request the Director to reserve designated park areas for such use. All picnic areas reserved by groups or persons not residing within the boundaries of the city limits of Redlands are subject to the fee schedules for these reserved areas. Persons or groups from within the city limits are not subject, to reservation fees and will have priority over persons or groups from outside the city limits . If the Director is satisfied from the information presented to him that the desired area may be reserved for the intended use with- out unreasonably interferinits the use of the park by other persons and without disturbing the peace of the surrounding neighbor- hood, he may grant said reservation upon such conditions as he deems necessary. The Director will issue reservation forms as necessary to verify the granting of such reservations. If for any reason the Director is not satisfied as to the reasonableness of the proposed activity in relation to the use of the park by other persons, or as to the effect of such use upon the peace of the neighborhood, or if he finds that he is unable to agree 4 Ordinance No. 1590 Page five with. the applicant as to conditions to be imposed, he shall ask the applicant to fill out a Request for Formal Permit in accordance with the procedures in the following sub-section. (c) Reservations !!Y -formal Permit. The following procedures shall be followed by persons de's-iring to reserve Park areas for C (50) or more persons, and by .Jatherings or assemblies of fifty persons requested by the Director to complete a Request for Formal Permit under the provisions as listed above in sub-section (b) . (1) Applications for fonnal pennits must be submitted in writing upon forms available at the office of the City Paeks Department, not less than five (5) working days nor more than ninety (90) calendar days in advance of intended use. (2) The Director may impose such reasonable conditions upon the issuance of the formal permit as he deems necessary for the protection of the public health, safety, and welfare, including, without limitations, conditions related to time, place, freauency, duration, fees, consumption of alcoholic beverages, maximum attendance, parking restrictions, and placement of apparatus and equipment. (3) The Director may also require the applicant to provide additional water and sanitary facilities and refuse receptacles as he reasonably believes to be necessary for the protection of public health, safety, and wel- fare in connection with the intended use. (4) All fees in support of park areas and structures will be paid prior to the issuance of the formal permit. Waiver of said fees must be requested of the it Council thirty (30) days prior to the intended use. Said fees or deposits may include, without limitations, such amounts as may be determined by the Director or the Chief of Police to be reasonably necessary as security for repair of damage to park property, for cost of cleanup, and for extra personnel to regulate conduct and traffic. (5) The Director may require the applicant to provide a designated number of approved security personnel for the purposes set forth by the Chief of police Upon such application. (6) The applicant shall agree to reimburse the City for aOxy unusual cleanup and facility repair expenses and for services provided by the Parks or Police Depart- ments incurred as a result of the activity authorized by the permit. SECTION 9. Enforcement. The .theatre is equipped- with a portable dimming capacity and the recommended dimer pack is TTI's IMMSl - 2.41, or 3.6k with a Rubble; GCI amp 4 prong reccptical. The use of any gather portable dimmers must be approved by the stage manager. B. All =lighting and electrical, effects equipment rust be U.L. listed: and >approved. G. IM lighting and electrical effects equipment must use the 20 ramp; twist lock grounded connector. D. All electrical equipment must be grouaded in accordance with the local electrical code. E. No "Re icing $ o f 'permanent fixtures connectors will be, permitted. F. Microphone connectors must be the Cannon 3 conductor type. G. Removal of doors must be under supervision of knowledgeable personnel, and by the approval of the technical director or stage- manager* 2. Use and removal or mounting of doors must always be done with extreme care and caution. 3. Doors must be stored offstage in a safe position and in a secure manner. Rigging and securing to stage floor and poles must be done with Oleson improved stage screws 1070350 (Oleson'Catalog) and Oleson, improved stage screw plugs #70360 (Oleson Catalog). Oleson plugs require a 1/2 inch drill bit. a. Any holes drilled must be done on upstage side of pole, unless approved by Stage I-Tanager to drill on downstage side. All existing-stage screw plugs must be taken into consideration C) for use before new.holes are drilled into structure. b. Upon completion'of use of theatre, all stage screw plugs must be removed and replaced wiih a 9116" dowel to plug 'hole. Wood plugs should be sanded down or placed in hole so as to return drilled hole to its original finish. 5. All 'scenery to be flown (ie. : flats, banners, emblems) must be equipped with Oleson top hanger irons,, P'72300 (Oleson Catalog) for scenery under 40 lbs. Scenery 40 lbs. and over must be equipped with Oleson bottom hanger iton #72320 and the Oleson top -hanger iron., a. Appropriately tested cable ana/or.rope must be used on, all flown scenery.. III. Authorized Areas A. The control booth is off-limits to all but the following personnel: technical director, one lighting technician, one sound technician and two follow-spat operators. B. The ticket booth is off-li-mits to all but the following: persons involved with the sale and/or distribution of tickets. C.- The backstage area is off--li_mits> to the general public. IV. Clean-Up and Trash A. The removal of production refuse from the theatre area is the responsibility. of the user. If this condition is not met, a fee will be levied against the producing organization by the City for said clean-up and removal. B. All refuse must be deposited in the nearest city dL115pStCr- C.
