COVENANT RUNNING WITH THE LAND

AGREEMENT made this day of April, 1979,
between NILES N. HOGUE and JOSEPHINE L. HOGUE, husband and
wife, hereinafter referred to as "Hogues, " and the CITY OF
PEDLANDS, CALIFORNIA, hereinafter referred to as "Redlands, "
witnesseth:
WHEREAS:
(1) The Hogues are owners as joint tenants of
real property and a family home (presently under construction)
located at an address commonly known as 801 San Timoteo
Canyon Road, Redlands, California 92373; and
(2) Redlands has conditioned granting of a final
building permit for the family home aforementioned on the
execution of this agreement by the Hogues; and
(3) The Hogues need the said building permit in
order to obtain appropriate future financing connected with
their aforementioned home.
NOW, THEREFORE, in consideration of Redlands` agreement
to grant the said final building permit upon execution of
this document, the Hogues agree that they will indemnify and
save harmless Redlands and its employees and agents from all
damage to the aforementioned property caused by flooding, or
erosion.
The benefit and burden of this covenant shall inure

to the Hogues, their heirs, executors, administrators,
successors, or assigns and shall constitute a covenant
running with the land.
IN TESTIMONY WHEREOF, the parties, intending to be
legally bound hereby, have hereunto set their hands on
the date aforementioned.
