Box 280 Redlands, CA (Covenant Running With The Land) 92373 THIS COVENANT, dated the 18 day of March 19 74 is made and entered by and between THE CITY OF REDLANDS, hereinafter called "CITY" and Kenneth Kimura and Mae S. Kimura hereinafter called "OWNER" as a covenant Running With The Land. Recitals 1. Owner owns the real property situate in the County of San Bernardino, State of California, described on Exhibit A attached hereto, and incorporated as a part of this covenant, and hereinafter referred to as 11propertylt,. 2. Owner desires to obtain a domestic family dwelling water/sewer connection to the Redlands Domestic Water System/Sewerage System, FOR AND IN CONSIDERATION of the covenant contained herein the City and the Owner agree as ±ollows-. 1. That Owner may make a connection to the Redlands Domestic Water System/Sewerage System for a domestic family dwelling subject to the terms, conditions, and requirements of all ordinances, resolutions, rules, and rates adopted by the City, and performance by Owner of the covenants herein. 2. That Owner shall annex property to the City of Redlands no later than 120 days after the City makes a written request for such annexation by personal delivery to owner or by registered letter, deposited at a United States Post Office, bearing the following address: Owner: Kenneth Kimura & Mae S. Kimura Address: 16555 Arrow Highway, Azusa, Calif. 91702 3. That Owner shall be charged and pay twice the water/sewer rates established by City ordinance or resolution for service to properties situate outside City upon Ownerts failure to consent to annexation of property no later than 120 days after the request to do so. The rates which shall be doubled in the event of owner 's refusal 63M to annex shall be the outside rates in effect on the 121st day after the City' s request for annexation. 4. That this covenant shall be recorded in the office of the County Recorder of San Bernardino County, a covenant running with the :.and described herein, which covenant shall obligate and be binding upon Owner, his assigns, transferees, executors, trustees, and every other successor in interest.
