AGREEMENT CO., CALIF.
(covenant Running With The Land)
THIS COVENANT, dated the 13th day of August 1979
is made and entered by and between THE CITY OF REDLANDS, hereinafter
called "CITY" , and John Sousa and Ines A. Sousa
hereinafter called "OWNER" , as a Covenant Running With The Land.
Recitals
1. Owner owns the real property situate in the County of
San Bernardino, State of California, described on Exhibit A attached
hereto, and incorporated as a part of this covenant, and hereinafter
referred to as "property" .
2 . Owner desires to obtain a domestic family dwelling water
connection to the Redlands Domestic Water System.
FOR AND IN CONSIDERATION of the covenant contained herein
the City and the Owner agree as follows :
1. That Owner may wake a connection to the Redlands Domestic
Water System for a domestic family dwelling subject to the terms,
conditions, and requirements of all ordinances, resolutions, rules,
and rates adopted by the City, and performance by Owner of the
covenants herein.
2 . That Owner shall annex property to the City of Redlands
no later than 120 days after the. City makes a written request for
such annexation by personal delivery to Owner or by registered letter,
deposited at a United States Post Office, bearing the following
address :

Address: 1309 Sapphire Street, Mentone, Calif . 92359
3 . That Owner shall be charged and pay twice the water rates
established by City ordinance or resolution for service to properties

situate outside City upon Owner' s failure to consent to annexation
of property no later than 120 days after the request to do so.
The rates which shall be doubled in the event of Owner ' s refusal
to annex shall be the outside rates in effect on the 121st day
after the City' s request for annexation.
4. That this covenant shall be recorded in the office of
the County Recorder of San Bernardino County, a covenant running
with the land described herein, which covenant shall obligate and
be binding upon Owner , his assigns , transferees, executors , trustees ,
and every other successor in interest.

PARCEL NO. 1: All of Lot 2 and the East 1/2 of Lot 1, Block 21,
a—cc-6—rd"Ing to the Map of Mentone, as per plat recorded in Book 8
of Maps, page 81, records of said County, excepting therefrom
that portion of the East 1/2 of said Lot 1, described as follows:
BEGINNING at a point in the South Line of said Lot 1 which is 10
feet West of the Southeast corner thereof; thence West along said
Line 313 .70 feet to the Southwest corner of the East 1/2 of said
Lot; thence North along the West line of said East 1/2, 473 feet
to a point which is 137 feet South of the North line of said
Lot; thence East and parallel to said North line 295.00 feet;
thence Southandparallel to the West- line of said East 1/2, 219
feet to -a-_.point.yhich is 254 feet North of the South line of said
Lot; thence East and parallel to said South line 18 .82 feet to

March 17, 1949 in Book 2376, page 227, official records of said
County.
PARCEL NO. 2: Three miner 's inches of water measured under a
four inch pressure, being a portion of the 34 . 5 inches as set
off to the Mentone Groves Company, under Decree quieting title
in the case of Nelson vs Mentone Groves Company, et al. , in
Case No. 19388 in the Superior Court of the State of California in
and for the County of San Bernardino a certified copy of said
Decree having been recorded in Book 748 of Deeds, page 101,
records of said Countv.
