(Covenant Running with the Land)
THIS AGREEMENT by and between RICHARD L.TOMPINS and
NORMA E. TOMPKINS, hereinafter sometimes called "OWNER" , and
the CITY OF REDLANDS, a general law city of the State of
California, sometimes called "CITY" , is executed as a
covenant running with the land, dated this day of
June, 1975.
RECITALS
OWNER holds title and ownership to the real property
described on Exhibit "A" , attached hereto, and situate in the
County of San Bernardino, State of California.
The said real property consists of one parcel of land,
shown as Lot 69 on Exhibit B attached hereto, and incorporated
by reference herein, and a portion of Lot 70 as shown on
Exhibit B, which said combination of parcels is hereinafter
called property.
COVENANTS
For and in consideration of the mutual covenants herein
contained, OWNER and CITY agree as follows:
1. That the property may be built upon, used, and
developed only (1) if all provisions of City ordinances and
State laws are complied with, (2) if each and every requirement
of Building Permit No. 26518 is completed and performed, and
(3) with express permission from the CITY, subject to such
requirements and conditions as the CITY may impose.
2. That, for and in consideration of permission from the
CITY to maintain a building upon the real property, OWNER
agrees that the real property, as described on Exhibit A,
shall constitute and comprise, in perpetuity one parcel of
land and one lot, which shall at no time be subdivided or

separated for sale, transfer, development, or for any other
purpose, without the express approval and consent of the
CITY.
3 . That the mutual covenant contained herein shall run
with the land, and shall be binding as a contractual
obligation upon the OWNER, and the OWNER' s assignees,
transferees, trustees, mortgagees, personal representatives
and all other successors in interest, and that this covenant
shall be a burden to which the real property shall be
servient, which said covenant shall be enforceable by
injunction.

EXHIBIT A
Lots 69 and 70, Tract No. 7085, Smiley Heights, in the City
of Redlands, County of San Bernardino, State of California,
as per map recorded in Book 97, pages 40 through 45, of
Maps in the office of the Recorder of said County.
Excepting that portion of Lot 70 lying southerly of the
Easterly prolongation of the Southerly line of Lot 70,
said Southerly line being noted as N 700 00 ' E 99.22 feet
on the map of said tract.
