THIS AGREEMENT is concluded by and between the City of
Redlands hereinafter sometimes called "Redlands" and the City
of Loma Linda, hereinafter sometimes called "Loma Linda", is dated
the 9th dav of June 1975.
RECITALS
1. The construction of the Veterans Administration Hospital
facilities by the United States Government is desirable to the area
surrounding the City of Loma Linda for economic and professional
reasons.
2. The Hospital requires a' water supply for fire suppression
purposes and this water requirement places a severe demand upon the
existing facilities of Loma Linda.
3. Loma Linda plans to develop sources of water supply and
construct pipelines and storage capabilities to meet the requirements
of its water users within the next ten (10) years.
4. Loma Linda desires a source of water for emergency use
until the time Loma Linda develops additional water sources .
5. Redlands is capable of providing emergency water to Loma
Linda under the terms hereinafter agreed upon.
COVENANTS
For and in consideration of the covenants contained herein, the
parties agree as follows:
1. Currently Loma Linda and Redlands have a six inch emergency
connection at Richardson Street and Redlands Boulevard. This
connection provides sufficient flow for meeting emergency require-
ments of only a small localized area.
Z. Deliveries of emergency domestic water by Redlands to
Loma Linda shall be made at a metered location on Mountain View
Avenue approximately 300 feet north of Redlands Boulevard.
3. Water delivered by Redlands to Loma Linda will be for
emergency standby service. Any modification of such service will
require subsequent negotiation between Redlands and Loma Linda.
4. All the deliveries of water hereunder shall be made during
a period of ten (10) years , commencing with the date of this Agree-
ment, provided that the term may be extended by mutual written
Agreements of said 4-4eS Parj &_.L.
5. Loma Linda shall hold Redlands harmless from claims of
personal injury or property damage resulting from the delivery of
water at the point of metered delivery, or as to the quality of
water so supplied, providing that it meets State Health Department
requirements.
6. Loma Linda shall pay for Redlands ' time and material not
to exceed $ 3,500.00 cost of installation of an eight inch metered
water connection suitable to deliver a flow of 1,000 GPM.
7. Loma Linda agrees to furnish, install and maintain an approved
load double check valve at the point of the Loma Linda booster
pump in order to prevent a water backflow condition into the Redlands
Water System .

8. Loma Linda shall pay Redlands for emergency water it
receives under this agreement at the rate of Redlands ' lowest
Inside City Block Rate for Domestic Water at the time of delivery.
9. Loma Linda shall pay Redlands for standby water service
at the bi-monthly rate of $180. 00.
10. Loma Linda shall not acquire or claim any right, title,
or interest in water supplied under this Agreement other than the
contractual interest established in this Agreement.
11. Redlands shall supply no more than a total of 400 acre
feet of water per year in accordance with this Agreement, provided
that such total may be increased by written mutual agreement of both
parties. Loma Linda 's use would be only in emergency conditions and
for limited periods of time and not on any continuous basis for water
supply.
12. This Agreement shall not be assigned, conveyed, or hypothe-
cated without mutual consent of the parties to this Agreement.
13. Emergency water deliveries to Loma Linda from Redlands are
contingent upon water being available from Redlands ' supply. Reasonable
notice shall be given by Redlands to Loma Linda in the event Redlands
cannot provide water.
