HomeMy WebLinkAbout6266RESOLUTION NO. 6266 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS RELATIVE TO AN APPLICATION TO THE LOCAL AGENCY FORMATION COMMISSION TO INITIATE PROCEEDINGS FOR ANNEXATION OF CERTAIN UNINHABITED TERRITORY (ANNEXATION 81) Whereas, the City has received an application, required fees, and a petition from AKS and BEK Partners for annexation of 8.93 acres located on the south side of Madeira Avenue, west of Sapphire Avenue and east of Plumwood Lane into the City of Redlands; and Whereas, the subject property is uninhabited and is located in the City's Sphere of Influence in the Mentone area; and Whereas, this City Council is interested in responding to the interest of the property owner to annex the above described site into the City of Redlands by initiating an application for annexation with the Local Agency Formation Commission; and Whereas, it is desired that the proposed annexation be subject to the following terms and conditions: 1. The area proposed for annexation is being developed as a single family residential subdivision known as Tentative Tract 16402 and approved by the City Council on December 16, 2003. Pre -zoning of the property was approved at the same time to R-1, Single Family Residential and R -E, Residential Estate. The property owner has requested this annexation by the City of Redlands. The City is, therefore, requesting that the Local Agency Formation Commission approve the proposal with the waiver of further conducting authority proceedings as authorized by Government Code Section 56663(c). 2. The proposed annexation shall be subject to all standard conditions required by the Local Agency Formation Commission; and Whereas, an initial study was prepared under the California Environmental Quality Act for the pre -zoning and tentative tract map. It was reviewed by the Environmental Review Committee on August 4, 2003 and a mitigated negative declaration was recommended. This action was referred to the Local Agency Formation Commission for their review as well. On December 16, 2003, the City Council adopted the mitigated negative declaration and directed that staff file and post a "Notice of Determination" in accordance with City Guidelines. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF REDLANDS AS FOLLOWS: Section 1 That the City Council of the City of Redlands, for the reasons hereinafter mentioned, intends to file an application with LAFCO to initiate proceedmgs to annex to the City of Redlands certain temtory hereinafter descnbed, as uninhabited temtory, pursuant to the Cortese -Knox -Hertzberg Local Government Reorganization Act of 2000, Division 3, commencing with Section 56000 of the Government Code of the State of California Section 2 That the City Council's reasons for imtiatmg the annexation proceedings are as follows The annexation of the hereinafter descnbed temtory will contribute to the orderly growth of the City, provide the proper control of street layout, drainage and sanitary sewer design, ensure the proper use of land in conformity with the overall plan of the City, and the property owner has requested that the property be annexed to the City in order to facilitate development of a subdivision of the subject property Section 3 That this proposal is consistent with the City's General Plan governing the Sphere of Influence of the City of Redlands Section 4 That the temtory which the City Council proposes to annex is hereby identified as Annexation 81 and consists of all that real property situated in the County of San Bernardino, State of California, descnbed m Exhibit "A", attached hereto, and as shown on the maps attached hereto as Exhibit "B" Section 5 That the City Clerk of the City of Redlands is hereby directed to file with LAFCO of the County of San Bernardino, State of California, a copy of this resolution to initiate annexation of the territory descnbed herein to the City of Redlands, to request a report by the Commission provided for by the Cortese -Knox -Hertzberg Local Government Reorganization Act of 2000, and to submit and execute such other applications and reports as may be required by law in such annexation proceedings ADOPTED, SIGNED AND APPROVED this 21st day of December, 2004 Attest City lerk , City of Redlands I, Lorne Poyzer, City Clerk of the City of Redlands, hereby certify that the foregoing resolution was adopted by the City Council at a regular meeting thereof held on the 21st day of December, 2004, by the following vote AYES Councilmembers Gil, Gilbreath, George, Harrison, Mayor Peppler NOES None ABSENT None ABSTAIN None Lorri = ' oyzer, EXHIBIT "A" LEGAL DESCRIPTION CITY OF REDLANDS, ANNEXATION NO. 81 A PORTION OF LOTS 3 AND 4 OF BLOCK 12 OF THE STRETCH MAP OF MENTONE, LOCATED IN THE UNINCORPORATED PORTION OF SAN BERNARDINO COUNTY, AS RECORDED IN BOOK 8 OF MAPS, PAGE 81 OF THE OFFICIAL RECORDS OF SAN BERNARDINO COUNTY, MORE PARTICULARLY DESCRIBED AS FOLLOWS: COMMENCING AT THE INTERSECTION OF THE SOUTHERLY MARGIN OF MADEIRA AVENUE AND WESTERLY MARGIN SAPPHIRE STREET, THENCE NORTH 88°51'10" WEST ALONG THE SOUTHERLY MARGIN OF MADEIRA AVENUE A DISTANCE OF 439.10, SAID POINT BEING THE TRUE POINT OF BEGINNING; THENCE NORTH 01'08'07" EAST A DISTANCE OF 30.00 FEET TO A POINT ON THE CENTERLINE OF MADEIRA AVENUE; THENCE ALONG SAID CENTERLINE NORTH 88°51'10" WEST A DISTANCE OF 655.24 FEET TO A POINT, SAID POINT BEING THE INTERSECTION OF SAID CENTERLINE AND THE PROLONGATION OF THE WEST LINE OF THE EAST Y2 OF LOT 3, BLOCK. 12 OF THE STRETCH MAP OF MENTONE AND THE EAST LINE OF TRACT 15694 AS RECORDED IN BOOK. 267 OF MAPS, PAGES 55 - 56 O.R.
