CERTAIN IMPROVEMENTS TO THE ORANGE BLOSSOM TRAIL
PHASE 1 PROJECT
This first amendment ("First Amendment") to the public works construction contract to
provide certain improvements to the Orange Blossom Trail Phase 1 project dated May 1,2014,(the
"Contract") by and between the City of Redlands, a municipal corporation ("City"), and KAD
Paving Company("Contractor"), is made and entered into this 21 S` day of July, 2015.
RECITALS
WHEREAS, it is the desire of City and Contractor to amend the"The Contract Sum"of the
Contract for the provision of additional services. City and Contractor hereby agree as follows:
AGREEMENT
Section 1. "SCOPE OF WORK"to the Contract is hereby amended to read as follows:
"SCOPE OF WORK: Contractor shall furnish all materials and perform all of the work for
the following: ORANGE BLOSSOM TRAIL PHASE 1,complete all items in the Base Bid,Additive
Bid "C", and Additive "D", less the placement of the plants listed in item 36, and substituting the
tree species for a City selected tree in item 37, as required by the Contract Documents (as herein
defined) and Specifications for the City's ORANGE BLOSSOM TRAIL PHASE 1, Project No.
47015."
Section 2. "THE CONTRACT SUM" to the Contract is hereby amended to read as
follows:
"THE CONTRACT SUM: City shall pay Contractor the sum of$979,813.90 as consideration for its
performance of the Work in accordance with the terms and conditions set forth in the Contract
Documents. Pursuant to Public Contract Code section 22300, Contractor has the option to deposit
securities with an escrow agent as a substitute for retention of earnings required to be withheld by
City pursuant to an escrow agreement as set forth in the Public Contract Code Section 22300."
All other provisions of the Contract shall remain in full force and effect.
IN WITNESS WHEREOF,the parties have executed this First Amendment,to be effective as
of July 21, 2015.
