HomeMy WebLinkAbout5608RESOLUTION NO 5608 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS ORDERING TERRITORY ANNEXED TO THE CITY OF REDLANDS LAFCO NO 2839C ANNEXATION NO 76C WHEREAS, this action is being taken pursuant to the Cortese/Knox Local Government Reorganization Act of 1985 (commencing with Section 56000 of the California Government Code); and WHEREAS, the Local Agency Formation Commission of the County of San Bernardino (LAFCO) adopted its Resolution No. 2629 on January 20, 1999 making determinations and approving the proposed annexation of territory which encompasses 41± acres consisting of City of Redlands property generally bordered by the City of Redlands on the north, Alabama Street on the west, and parcel lines on the south and east, more specifically described in Exhibits "A and A 1, attached hereto and by this reference incorporated herein; and WHEREAS, the terms and conditions of annexation as approved by the LAFCO, and contained in LAFCO Resolution No. 2629 are as follows: "Condition No. 1 The conducting authority for this proceeding shall be the City of Redlands (hereinafter referred to as 'the City'). Condition No. 2. The boundaries are approved as set forth in Exhibits attached. A and A 1 Condition No. 3 The conducting authority shall provide individual property owner notification of its hearing pursuant to the provisions of Government Code Section 57025(c). Condition No. 4 The following distinctive short -form designation shall be used throughout this proceeding: LAFCO 2839C. Condition No. 5 All previously authorized charges, fees, assessments, and/or taxes currently in effect by the City (annexing agency) shall be assumed by the annexing territory in the sane manner as provided in the original authorization pursuant to Government Code Section 56844(t). Condition No. 6 County Service Area 110 (East Valley Corridor) shall continue to overlay the subject area following annexation. Condition No. 7 The City agrees to indemnify defend, and hold harmless the San Bernardino County Local Agency Formation Commission from any legal expense, legal action, or judgment arising out of the Resolution No. 5608 Page 1 of 6 Commission's approval of this proposal, including any reimbursement of legal fees and costs incurred by the Commission. Condition No. 8. The date of issuance of the Certificate of Completion shall be the effective date of this annexation, and WHEREAS, the reasons for this annexation are: the annexation of this territory will contribute to the orderly growth of the City of Redlands; insure the proper use of land in conformity with the General Plan of the City of Redlands; and the territory will benefit from the full range of services available from the City of Redlands as evidenced by the City of Redlands' Plan for Services reviewed by the LAFCO This proposal would accomplish the proposed change of organization in a reasonsable manner with a maximum chance of success and a minimum disruption of service to the functions of other local agencies in the area. WHEREAS, the regular County of San Bemardino assessment roll is utilized by the City of Redlands; and WHEREAS, the affected territory will be taxed for existing general bonded indebtedness and contractual obligations of the City of Redlands; and WHEREAS, a public hearing on this annexation was called for and held by the City Council of the City of Redlands on March 16, 1999 at the time and place for which notice was given, and the City Council of the City of Redlands finds and determines that the value of written protests filed and not withdrawn represents owners of land who own less than 50 percent of the total assessed value of land within the affected territory NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Redlands hereby orders the territory described in Exhibits A and "A 1 annexed, and directs the City Clerk to transmit a certified copy of this resolution with applicable fees required by Section 54902.5 of the California Government Code to the Executive Officer of the San Bernardino County Local Agency Formation Conunission.
