HomeMy WebLinkAbout8184RESOLUTION NO. 8184 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS APPROVING A DEVELOPMENT PROJECT EXCEEDING 18 DWELLING UNITS/ACRE WITH STRUCTURES IN EXCESS OF TWO STORIES OR GREATER THAN 35 FEET IN HEIGHT FOR THE CASA LOMA RESIDENCES PROJECT, A 147-UNIT RESIDENTIAL UNITS IN THREE BUILDINGS ON 5.7 ACRES LOCATED AT 1205-1219 N. UNIVERSITY STREET WHEREAS, in 1997, Measure "U," a voter -approved initiative ordinance, amended the Redlands General Plan to establish comprehensive growth management principles to preserve, enhance and maintain the quality of life in the Redlands community; and WHEREAS, section 4.0 of Measure "U" provides, in relevant part, that within the High Density Residential Land Use classification, "No proposed development project with density levels in excess of 18 dwelling units to the acre or a structure in excess of two stories or greater than 35 feet in height shall be approved unless the following mandatory findings are made and the development project is approved by four -fifths (4/5) vote of the total authorized membership of the City Council, specifically, that: • There are substantial and overriding economic or social benefits to the City and it residents and taxpayers from the proposed density or height increase; and • The proposed density or height increase will not cause adverse environmental impacts, either individually or cumulatively, directly or in directly; and • The proposed density or height increase will not have a growth -inducing effect on other property; and • There resulting use will be compatible with uses on adjacent land; and • The proposed density or height increase will not require substantial expansion of public infrastructure, facilities or services;" and WHEREAS, Dynamic Redlands, LLC ("Applicant") has filed applications for a Socio- Economic Cost Benefit Study, General Plan Amendment No. 139, Zone Change No. 462, Conditional Use Permit No. 1096, Commission Review and Approval No. 927, and Tentative Tract Map No. 20162 for a 147-unit multi -family residential development located on a 5.7-acre parcel of property at t205-1219 N. University Street (APNs: 1212-371-01-0000, 1212-371-05-0000, 1212-371-06-0000, 1212-371-07-0000, 1212-371-08-0000, 1212-371-09-0000, 1212-371-10- 0000, 1212-371-11-0000,1212-371-12-0000, 1212-371-13-0000,1212-371-14-0000, 1212-371- 15-0000, 1212-371-16-0000, 1212-371-17-0000, 1212-371-18-0000, 1212-371-19-0000, and 1212-371-20-0000) (collectively, the "Project"); and WHEREAS, the Project proposes a multi -family residential development with a density of 25.7 units per acre with three 3-story buildings, with variable building heights from 38'10" to 49'4" at the top of decorative tower element; and 1AResolutions\Res 8100-8199\8184 Casa Loma Measure U Density.docx WHEREAS, the Multi -Family Residential District (R-3) allows building heights up to four stories and the High Density Residential General Plan designation allows density greater than 18 units and up to 27 units per acre with a supermajority vote of the City Council; and WHEREAS, on December 16, 2020, the Planning Commission held a noticed public hearing at which interested persons had an opportunity to testify in support of, or in opposition to, the Project, and at which the Planning Commission considered, and subsequently recommended to the City Council that Project be approved; and WHEREAS on March 25, 2021, notice of the City Council's public hearing for the Amendment was published in the Redlands Daily Facts by the City Clerk; and WHEREAS, on April 6, 2021, the City Council held a public hearing and considered the staff written and oral reports, the recommendation of the Planning Commission, the testimony and written evidence submitted by and on behalf of the applicant, and testimony by members of the public; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF REDLANDS AS FOLLOWS: Section 1. In accordance with the Redlands General Plan, the City Council of the City of Redlands hereby approves the development project with density levels in excess of 18 dwelling units to the acre and structures in excess of two stories or greater than 35 feet, based upon the following mandatory findings and a four -fifths (4/5ths) vote of the total authorized membership of the City Council: A. There are substantial and overriding economic or social benefits to the City and its residents and taxpayers from the proposed density or height increase. The proposed development will provide additional housing opportunities during a state- wide housing crisis, including additional housing stock adjacent to a university. The development will increase property tax revenues from the property by increasing the property's valuation and the applicant will be responsible for paying development impact fees. In addition, the development will contribute towards and aid in facilitating the construction of a traffic signal at the intersection of Colton Avenue and University Street. The project would also contribute towards off -site street improvements, such as widening, curb, gutter, and sidewalks. The portion of the project site along University Street includes an unwidened segment of that street abutting the project site, which will be widened as a result of the project's development. B. The proposed densityor increase will not cause adverse environmental impacts, either individually or cumulatively, directly or indirectly. An Initial Study/Mitigated Negative Declaration (MND) has been prepared by EPD Solutions, Inc., supported by technical studies that have evaluated the potential for environmental impacts. The MND concludes that the project will not cause any significant adverse environmental 1AResolutionsTes 8100-8199\8184 Casa Loma Measure U Densily,doex impacts, with the incorporation of mitigation measures that will reduce impacts to a level less than significant. C. The proposed density or height increase will not have a growth-inducingeffect ffect on other property. The proposed density and height increase will not have a growth -inducing effect on other properties. The properties along the south side of Lugonia Avenue, between Occidental Drive and Grove Street, are already designated in the City's General Plan for High Density Residential development allowing up to 27 units per acre. Furthermore, the surrounding residentially zoned parcels are already developed with multi -family and single-family development. The vacant parcels located to the south of the project site are zoned Educational (E) and are under ownership of the University of Redlands. D. The resulting use will be compatible with the uses on adjacent land. The multi -family residential use will serve as a transition between the minor arterials of Lugonia Avenue and University Street, and the single-family residential development located to the west and south of the project site. This particular segment of Lugonia Avenue is zoned similarly, providing multi -family residential zoning districts along the minor arterial, adjacent to single-family residential districts like the R-1 District. This development pattern demonstrates compatibility between multi -family and single-family zoning designations in the area of major streets. Additionally, the development of multi -family apartments will be a continuation of the multi -family development located on the north and east sides of the project site. E. The proposed density or height increase will not require substantial expansion of public infrastructure, facilities or services. The project is located adjacent to major streets, sewer and water lines, and all other infrastructure necessary to serve the project. Additionally, the project will contribute its fair share toward development impact fees for city facilities and services. Section 2. In accordance with Measure "U," this resolution has been adopted by a 415ths vote of the membership of the City Council. Section 3. This Resolution shall become effective upon adoption.
