HomeMy WebLinkAbout8185RESOLUTION NO. 8185 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS APPROVING A REDUCED LEVEL OF TRAFFIC SERVICE FOR THE INTERSECTION OF UNIVERSITY AVENUE AND BROCKTON STREET DURING PEAK HOURS FOR THE CASA LOMA RESIDENCES PROJECT, A 147-UNIT MULTI -FAMILY PROJECT ON 5.7 ACRES LOCATED AT 1205- 1219 NORTH UNIVERSITY STREET WHEREAS, Dynamic Redlands, LLC ("Applicant') has filed applications for a Socio- Economic Cost Benefit Study, General Plan Amendment No. 39, Zone Change No. 462, Conditional Use Permit No. 1096, Commission Review and Approval No. 927, and Tentative Tract Map No. 20162 for a 147-unit multi -family residential development located on a 5.7-acre parcel of property at 1205-1219 N. University Street (APNs: 1212-371-01-0000, 1212-371-05-0000, 1212-371-06-0000, 1212-371-07-0000, 1212-371-08-0000, 1212-371-09-0000, 1212-371-10- 0000, 1212-371-11-0000, 1212-371-12-0000, 1212-371-13-0000, 1212-371-14-0000, 1212-371- 15-0000, 1212-371-16-0000, 1212-371-17-0000, 1212-371-18-0000, 1212-371-19-0000, and 1212-371-20-0000) (the "Project'); and WHEREAS, in 1997, Measure "U," a voter -approved initiative ordinance, amended the Redlands General Plan to establish comprehensive growth management principles to preserve, enhance and maintain the quality of life in the Redlands community; and WHEREAS, Principal 1A.60 (a) of Measure U requires in any location where the level of service ("LOS") is lower than LOS C at the time an application for a development project is submitted, that the level of traffic service be maintained at levels of service that are no worse than those existing at the time an application for development is filed, expect as provided in Section 5.20b of the Redlands General Plan; and WHEREAS, Section 5.20b of the Redlands General Plan allows a reduced LOS on a case by case basis upon approval by a four -fifths (4/5ths) vote of the total authorized membership of the City Council; and WHEREAS, the intersection of University Street and Brockton Avenue is operating at LOS D during AM peak hours and LOS C during PM peak hours under existing traffic conditions; and WHEREAS, the intersection of University Street and Brockton Avenue is projected to operate at LOS E during the AM peals hours and LOS D during the PM peak hours with the addition of Project -related traffic to existing traffic conditions; and WHEREAS, the Traffic hnpact Report prepared by Linscott, Law & Greenspan, dated March 26, 2020, conducted an analysis on traffic warrants and identified the intersections of University Street and Brockton Avenue and the intersection of University Street and Colton Avenue, which is currently operating at LOS F without Project traffic, as recommended intersections for traffic signals under existing traffic conditions; and 1 [\Resolutions\Res 8100-8199\8185 Casa Loma Measure U Traa ffic.doex WHEREAS, the intersection of University Street and Colton Avenue is listed on the City's nexus list as a high priority intersection for a traffic signal; and WHEREAS, the Applicant claims it is financially infeasible for it to construct two traffic signals for the Project, based on its scope and scale; and WHEREAS, the Applicant further asserts that the construction of a traffic signal at University Street and Colton Avenue, which is currently operating at LOS F, without Project traffic, would serve the greatest public need; and WHEREAS, the Applicant has requested the City Council accept a lower LOS at the intersection of University Street and Brockton Avenue to allow for the focus of traffic signal improvements to occur at the intersection of University Street and Colton Street; and WHEREAS, on December 16, 2020, the Planning Commission held a noticed public hearing at which interested persons had an opportunity to testify in support of, or in opposition to, the Project, and at which the Planning Commission considered and subsequently recommended to the City Council that the Project be approved; and WHEREAS on March 25, 2021, notice of the City Council's public hearing for the Amendment was published in the Redlands Daily Facts by the City Clerk; and WHEREAS, on April 6, 2021, the City Council held a public hearing and considered the staff written and oral reports, the recommendation of the Planning Commission, the testimony and written evidence submitted by and on behalf of the Applicant, and testimony by members of the public; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF REDLANDS AS FOLLOWS: Section 1. In accordance with Policy 5.20b of the Redlands General Plan, the City Council of the City of Redlands hereby approves a reduced Level of Service for the intersection of University Avenue and Brockton Street during peak hours for the Casa Loma Residences Proj ect. Section 2. In accordance with Measure "U," this resolution has been adopted by a 4/5ths vote of the total membership of the City Council. Section 3.
