A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS
DETERMINING THE PROPERTY LOCATED AT 565 WALNUT AVENUE,
REDLANDS, CALIFORNIA (ASSESSOR'S PARCEL NO. 173-213-17) TO BE A
PUBLIC NUISANCE AND AUTHORIZING CITY STAFF TO COMMENCE
ABATEMENT PROCEEDINGS REGARDING THE SAME
WHEREAS, pursuant to the authority of California Health and Safety Code Sections 17980
et seq. and Chapter 8.04 of the Redlands Municipal Code, the City Council of the City of Redlands
("this City Council") may determine that all unsafe buildings, structures or appendages are public
nuisances; and
WHEREAS, the Chief Building Official of the City has presented this City Council with oral
and written testimony regarding the unsafe, dangerous and hazardous conditions present at a three
story vacant apartment structure located at 565 Walnut Avenue in the City of Redlands and
designated as Assessor's Parcel No. 173-213-17 (the 'Property"); and
WHEREAS, on repeated occasions, both verbally and in writing, the owner of the property
has been notified of such unsafe, dangerous and hazardous conditions and has been requested to
abate the same; and
WHEREAS, the owner of the Property has failed to take any action to correct the unsafe,
dangerous and hazardous conditions located on the Property. and
WHEREAS, the owner of the Property has been given written notice, by certified mail,
return receipt requested, of a hearing before this City Council on November 21, 1995 relating to the
question of whether or not the Property should be declared a public nuisance;
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF REDLANDS AS
FOLLOWS:
Section 1 The City Council of the City of Redlands hereby finds:
A. That the three-story building on the Property has been structurally damaged
and is in an unsafe, unreinforced and unstable condition.
B. The Property is out of harmony and conformity with the maintenance
standards of adjacent properties as to cause substantial diminution in the
enjoyment, use, and property values of such properties.

C. The work to be performed to abate the nuisance is described in Exhibit A
of this resolution which is attached hereto and incorporated herein by this
reference.
D. The owner of the Property shall have sixty (60) days from the date of this
resolution to perform the work necessary to abate the nuisance.
E. That the occupant, lessee, or other person in charge, or any mortgagee,
beneficiary under any deed of trust, or other person having an interest or
estate in such premises, may at his own risk, abate the nuisance.
Section 2. The City Council of the City of Redlands hereby determines that the three
story vacant apartment structure located at 565 Walnut Avenue (Assessor's Parcel No. 173-213-17)
constitutes a public nuisance pursuant to Chapter 8.04 of the Redlands Municipal Code and Section
17980 et seq. of the California Health and Safety Code.
Section 3. The City Council hereby authorizes the Chief Building Official to commence
abatement proceedings for the public nuisance located at 565 Walnut Avenue by securing the main
building against access by persons if the owner of the Property has not done so, to the satisfaction
of the Chief Building Official, within twenty (20) days from the date of this resolution.

On January 27, 1995, the Fire Department's yearly fire inspection
revealed mayor concerns with the conditions of the building and
grounds at 565 Walnut Avenue The conditions were at a level that
were beyond the Fire Department's expertise To address the
concerns, the City staff assembled a Task Force
On March 3, 1995 the assembled Task Force reviewed the building and
grounds at 565 Walnut Avenue This inspection also gave the city's
representatives an opportunity to review the conditions of the main
three story building
Before this building can be granted occupancy, we shall insure
compliance with the Uniform Housing Code, 1991 edition The
Housing Code shall provide minimum standards to safeguard life or
limb, health, property and public welfare by regulating and
controlling the use and occupancy, location and maintenance of all
residential buildings and structures
The attached correspondence is from all concerned individuals that
participated in the inspection on March 3 The findings and
comments pertain to the three story main building, the south two
story building, bungalows, apartments and the dwelling unit at 634
Highland Avenue

The following areas are major concerns that will need to be
corrected or analyzed before the main building can be occupied
STRUCTURAL
1 The unoccupied main building's basement consists of an
unreinforced foundation consisting of rock with lime mortar
The structural integrity of the building's floors and its
supporting beams are questionable for structural strength The
foundation floors and supporting beams will be required to be
analyzed by a Structural Engineer for its stability A letter
from the engineer will be required to substantiate their
findings The south two story building s foundation shall
also be analyzed
2 The rain damaged ceiling and ceiling panels in the main
building's kitchen shall be repaired or replaced
3 All exit and passage doors shall be unbolted and in working
order
4 All windows shall be weather protected
5 All stairs stair handrails and guardrails shall be
structurally secured and analyzed by a Structural Engineer
6 All roofs that are in need of repair shall be repaired to
protect the occupants against the elements and to exclude
dampness
MECHANICAL
1 All habitable rooms shall provide heating facilities capable
of maintaining a room temperature of 70 degrees at a point 3
feet above the floor
2 All habitable rooms bathrooms and fuel burning appliances
shall be provide with ventilation
3 All mechanical systems will be certified by a licensed
mechanical contractor
PLUMBING
1 All plumbing fixtures shall be connected to a sanitary sewer
2 All plumbing fixtures shall be connected to an approved system
of water supply and provide hot and cold running water
necessary for its normal operation
3 All bathrooms shall be equipped with facilities consisting of
a water closet lavatory and either a bathtub or shower
4 All plumbing fixtures shall be vented to the exterior of the
building

5 All plumbing systems will be certified by a licensed plumbing
contractor
ELECTRICAL
1 All electrical wiring shall be placed in approved electrical
conduit covered or protected
2 All electrical switches receptacles and junction boxes shall
have an approved electrical cover plate
3 All electrical wiring shall be certified by a licensed
electrical contractor
I strongly urge you to obtain permits for building mechanical
plumbing and electrical when you change replace alter or install
any of the above items When you obtain permits this will provide
an inspector to inspect the correct installation of any items that
you install

the yard, and the neighborhood will be kept free of rodents. These measures are necessary to control and eliminate
these animals and the ectoparasites which are a nuisance and can carry diseases.

TASK FORCE INSPECTION OF WISSAHICKON INN
On March 3 1995 Redlands Fire Department conducted another
inspection of the Wissahickon Inn as part of a Task Force
In response to previous inspections (see attached memos) of
the Wissahickon Inn on 10/27/94 and 1/27/95 the buildings
and grounds were again reinspected for compliance The
following conditions were found
1 The rooms where excessive amounts of
were found on 1/27/95 have mostly
the exception of some remaining trash
apartment south of the main house
2 The other items of unhealthful conditions still exist
and will be addressed by Building & Safety via a letter
to Mr Israel Aspe the owner of the Inn
3 The main building of 565 Walnut Avenue shows evidence of
water damage to various locations throughout the
structure (see attached photos taken by
Investigator/Code Enforcement Officer Rich Lindner on
3/3/95) This building s sub -floor area has been
repaired by Mr Aspe in an attempt to stabilize and
secure the structure

The main issue with all of these buildings is that the lack
of maintenance is dangerous to human health as outlined in
the 1991 Uniform Fire Code Section 2 201(a b)
The use of alternate heating equipment is also in violation
of the UFC Section 11 404
Fire resistive construction in all of the buildings shows
lack of maintenance and has also been compromised by water
damage in violation of UFC Section 10 601
The repair and maintenance of the the exitways in the
two-story buildings as discussed with Mr Aspe on 1/31/95
has as yet not been completed in violation of UFC 12 101
The building located at 534 W Highland Avenue has an open
gas line with a gate valve which had previously served a
since -removed stove The occupant of this room stated in my
presence that he would open the gas valve to kill bugs I
advised Mr Aspe to cap and remove this gas valve
immediately
The conditions observed on 3/3/95 were identical to previous
inspections (see attached memos) The Redlands Fire
Department is not going to release the main structure at 565
Walnut Avenue until Mr Aspe complies with all previously
mentioned items and satisfies and complies with the concerns
of the Chief Building Official as outlined in his letter
and when all structures meet Uniform Building Fire, Plumbing
and Mechanical Codes requirements for life safety

On January 27, 1995, an annual fire safety inspection was
conducted by Investigator Rich Lindner and myself of the
buildings and grounds at the Wissahickon Inn, 565 Walnut
Avenue Redlands California In several locations, occupied
rooms had very unsafe and unhealthful conditions The
violations observed at the facility are listed below
A Photos 1 & 2 (copies attached) show a sampling of these
conditions at the upstairs apartment east of the main
house, where two adults reside;
B Photos 3 4 & 5 were taken of the living room in the
cottage structure south of the main house
C Photos 6 & 7 show food preparation in the bathroom at
the cottage during our inspection

The purpose of informing other City departments of the
numerous violations at the Wissahickon Inn and grounds is to
ask for assistance in creating a possible task force to
assure the correction of these poor living conditions and
code and permit violations Even though the owner of the
property Mr Israel Aspe attempts to correct the violations
following each annual inspection he has yet to complete them
to code The .City should take action on this issue as the
violations could prove to be dangerous for occupants of the
Wissahickon Inn as well as the surrounding neighborhood

SUBJECT WISSAHICKON INN - FIRE CODE VIOLATIONS
On October 27 1994, a follow-up inspection was performed at
the Wissahickon Inn, 565 Walnut Avenue, addressing the
violations noted by Division Chief Marshall Mead in his
letter dated January 14, 1994, following the annual fire
inspection of the premises (See attached.)
The violations remaining to be corrected include smoke
detectors working in all the sleeping units and the exposed
electrical wiring needs to be properly wired and contained
within protective boxes and approved enclosures
On the above visit I confirmed with Mr Israel Aspe, owner
of the Wissahickon Inn, that no occupants were in the
building or rooms as per Chief Mead's letter dated January
14, 1994 Yet in Room No 64 on the ground floor of the
main structure of 565 Walnut Avenue, we knocked on the door
and found a tenant inside this room with a dresser, TV, bed
and evidence that he had been smoking and occupying this
room At this point this individual was instructed to leave
the building and we escorted him to another structure on the
property that Mr Aspe indicated should have been his
residence Apparently this person had come into the
building either without the owner s knowledge or possibly
without his permission This building was not to be occupied
by anyone as per Chief Mead's letter
During the inspection of October 27 I also observed the
other buildings wherein 50 percent of the smoke detectors
were non -operational due to missing batteries
Regarding the two-story building located south of the main
structure The west staircase exit door is non -operational
has no door hardware and cannot be opened from the inside as
is required The east staircase on the same structure has
broken steps and a landing which is also showing signs of
damage and possibly would not support exiting occupants of
the building Thus these above conditions leave the
building with one center interior staircase being the
occupants only way out of this structure from the upper
floors
These items need to be corrected immediately Prior to
leaving on October 27 1994 I witnessed Mr Aspe replacing
batteries in all of the smoke detectors noted in rooms in all
of the out-buildings containing occupants Mr Aspe also
stated he would see to the necessary repair of the noted
staircases until in operational condition.
I also observed, on. the 27th of. October, areas of some
out-buildings, where remodeling work had been done, as well
as installation of gas appliances or stoves and/or plumbing
fixtures within sleeping compartments of various rooms A
porch has been enclosed for a tenant on one particular
building I asked Mr Aspe if he had acquired the proper
building permits required from the City of Redlands Building
& Safety Department prior to remodeling He stated that he
had not done so
On completion of the inspection on the 27th, I indicated to
Mr Aspe that we would consult with Building & Safety and
probably bring a representative of that department with the
Fire Department for another inspection, within the next few
days
On November 2 1994, I again conducted a follow-up inspection
with Rich Lindner of Code Enforcement City of Redlands and
Rich Pepper Building & Safety Dept , City of Redlands On
this date we observed remodeling work in progress In the
three-story large structure drywall repair and electrical
re-wiring or splicing (in an unapproved manner) was in
progress in some of the tenant rooms which were being
reinhabited following evacuation due to water damage, again
without the proper permits from the City of Redlands Building
& Safety Department We also observed some serious
structural fatigue within the three-story building designated
as Wissahickon Inn with numerous cracks and unlevel floors
inside the interior corridors on floors 1 2 and 3
When observing the basement in the underfloor area of this
structure we noted several large jacks which were in place
Mr Aspe indicated that this was an attempt to level or
stabilize the structure from what he believes is maybe a
sagging of the structure We noticed in the basement area
of the foundation that floor joists were split in several
places and showed physical damage
In the two-story building south of the main house again Mr
Aspe indicated that he had repaired all the smoke detectors
as per our previous visit However the Exit Door hardware
and the remaining staircasing repair work still needs to be
completed
In closing we feel that at this time we are not going to
release the hold on the main structure the three-story
structure at 565 Walnut Avenue Redlands California until
such time that all necessary permits are pulled in accordance
with the City of Redlands Building & Safety Department to
ensure fire life and building safety within this structure

In addition to the issuance of permits and site inspections
by the Building & Safety and Fire Department prior to
occupancy being granted, I also advised Mr Aspe to possibly
have a consultation with a structural engineer in regards to
the repair/remodeling activity that he is doing, in an
attempt to secure the structure and make it structurally
sound
If this is to be completed and Mr Aspe elects to have some
consultation from a structural engineer about the stability
of the structure, I have asked him to please forward any
documentation to the City of Redlands Building & Safety or
Fire Department for approval of those findings or comments
At this point we would like to conduct a follow-up
inspection once all the necessary repairs have been completed
to the facility and all smoke detectors are operational in
all the sleeping units of the main three-story building
located at 565 Walnut At the time of completion of the
above-mentioned items we will then allow occupants to move
back in

SUBJECT Building inspection at 565 Walnut Street, Wissahickon Inn
In response to your request for specific data regarding calls for service at the
Wissahickon Inn, attached you will find the police department's most recent analysis.
As you can see, the police department has not experienced an inordinate number of
calls for service, and those calls for service that have been documented, are not
grossly out of proportion. I say this taking into consideration the nature of the business
and the type tenants that live there.
With regard to the inspection itself, I would offer the following observations. The
overall condition of the structures that I observed is likely to insure that only the most
destitute tenants will take up residency there. This condition will almost certainly result
in less upkeep on the part of the owner Mr Aspe, which will almost certainly lead to
more calls for service from the police and fire departments. Also, the fact that a
number of the buildings on the property have no heat in them, which necessitates the
widespread use of space heaters, is the recipe for disaster
I should also note that in my experience as a police officer I have had occasion
to be involved with other low income, apartment like situations, similar to the
Wissahickon Inn. In those cases the overall condition of the property steadily declined
to the point where almost no one would rent there. At this point the owners abandon
the property which created an even worse problem. Although the Wissahickon Inn
doesn't appear to be at that point now it is my opinion that it will be if significant and
immediate preventive steps are not taken.

appropriate.

On January 27, 1995 an annual fire safety inspection was conducted
by Investigator Rich Lindner and Acting Assistant Fire Marshal
Leonard Temby of the buildings and grounds at 565 Walnut Avenue
Redlands California
The inspection revealed health and building code violations These
violations were brought to the attention of the various city
departments These violations were discussed with the Building and
Safety Division, Planning Department, Fire Department, Police
Department, City Attorney, and City Manager
The violations found at 565 Walnut Avenue deemed to constitute a
threat to life, health, and safety to your tenants The
deficiencies that were disclosed have caused the development of a
task force from the city to survey your buildings and grounds

Dear Mr Aspe
On October 27 1994 the Redlands Fire Department conducted a
follow-up inspection of Wissahickon Inn, 565 Walnut Avenue,
to assure compliance of previous Fire Code violations from
the January 13 1994 annual inspection by Division Chief
Marshall Mead
The previous violations (see attached) have been corrected,
with the exception of electrical wiring as noted, and absence
of working smoke detectors in all sleeping areas of the
structure at 565 Walnut Avenue
In addition to previous violations, I observed a resident
occupying a room at 565 Walnut Avenue which is NOT in
compliance with the conditions of Division Chief Mead's
letter dated January 14 1994
The present condition of this building and the lack of
maintenance of exits and smoke detectors in the other
buildings on the property plus the presence of remodel work
and installation of gas stoves in sleeping areas without
obtaining proper permits and inspections, will result in the
order NOT TO OCCUPY the building until all violations,
permits and inspections are obtained and completed

On Friday, September 15, 1989, a fire inspection was conducted
at 565 Walnut Avenue During the physical inspection phase in
the main building which houses the main office, dining room and
tenant apartments, some settling or shifting of the building was
noted on the third and .second floors as the corridor floors were
uneven The property manager was questioned as to why this
condition existed, he stated a main girder was broken and had
not been repaired as yet This condition appears to compromise
the integrity of the building
A second building on site is in various stages of deterioration
The roof covering has rotted off, exposing the interior to the
elements, the results from a fire that occurred three months
ago have not yet been repaired, yet the building is inhabited
These conditions would suggest that further investigation be
undertaken to determine structural soundness of these structures
