Home My WebLink AboutContracts & Agreements_73A-2021.r FIRST AMENDMENT TO AGREEMENT TO PERFORM PROFESSIONAL SERVICES This first amendment ("First Amendment") to the agreement for the provision of wastewater pretreatment program and local limit study consulting services ("Agreement") dated March 17, 2020 ("Agreement"), by and between the City of Redlands, a municipal corporation and general law city ("City"), and. Krieger & Stewart, Incorporated, a California corporation ("Consultant"), is made and entered into this 18t1' day of May, 2021. RF.CTTAT .0 WHEREAS, it is the desire of City and Consultant to amend. Article 3.2 of their existing Agreement to correct the name of the City's representative from Ru.d.olph Chow to John R. Harris; and. WHEREAS, it is the desire of City and. Consultant to amend. Article 4.2 of their existing Agreement to extend the date for completion of the Services to February 28, 2022; and. WHEREAS, it is the desire of City and. Consultant to amend. Article 4.2 of their existing Agreement to increase the payment to consultant from one hundred. forty four thousand eight hundred fifty dollars ($144,850) to one hundred sixty nine thousand eight hundred fifty dollars ($169,850); NOW, THEREFORE, City and Consultant agree as follows: A (TR FFI\A]P-NTT Section 1. Article 3 of the Agreement, titled. "Responsibilities of City," is hereby amended to read as follows: "3.2 City designates John R. Harris, Municipal Utilities and. Engineering Department Director, as City's representative with respect to performance of the Services, and such person shall have the authority to transmit Instructions, receive information, interpret and define City's policies and decisions with respect to performance of the Services." Section 2. Article 4 of the Agreement, titled "Performance of Services," is hereby amended to read as follows: "4.2 Consultant shall complete the Services by February 28, 2022, unless the Services are terminated earlier as provided for herein." Section 3. Article 5 of the Agreement, titled "Payments to Consultant," is hereby amended to read as follows: "5.1 Total compensation for Consultant's performance of the Services shall not exceed the amount of one hundred sixty-nine thousand eight hundred fifty dollars ($169,850).
