HomeMy WebLinkAbout8215RESOLUTION NO. 8215 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS DETERMINING THAT A PROPOSED MIXED -USE AND TRANSIT - ORIENTED DEVELOPMENT PROJECT FOR THE REDLANDS MALL SITE AND ASSOCIATED ADJACENT PROPERTIES QUALIFIES FOR EXEMPTION FROM THE REDLANDS GENERAL PLAN PROVISIONS ESTABLISHED BY MEASURE "U" WHEREAS, on November 4, 1997, the qualified voters of the City of Redlands approved a citizen -sponsored initiative measure, commonly known as Measure "U," as an amendment to the Redlands General Plan to implement comprehensive growth management principles to preserve, enhance, and maintain the quality of life in the Redlands community; and WHEREAS, Measure "U," by its own provisions, recognizes that certain types of development or projects may be determined to be exempt from those provisions of the Redlands General Plan established by Measure "U," including five "Special Categories of Development" specifically listed in the measure; and WHEREAS, the City's development entitlement applications request an applicant to inform the City whether its proposed project qualifies for any of the exemptions of Measure "U" in order to assist the City in determining which Redlands General Plan provisions will be applicable to the project for determining first, whether the application is "complete" in accordance with section 65943 of the California Government Code and second, to identify the applicable Redlands General Plan provisions, and other City laws govern the City's subsequent processing of the proj ect; and WHEREAS, Village Partners Ventures, - LLC, has filed development entitlement applications with the City for a Commission Review and Approval, Conditional Use Permit, Tentative Tract Map, General Plan Amendment, and Zoning Ordinance Text Amendment for the proposed construction of a transit -oriented mixed use project on the Redlands Mall site including the demolition of existing on -site buildings and improvements, constructing multiple buildings with up to 722 multifamily dwelling units, up to 73,000 square -feet of retail and commercial space on ground floors and a rooftop restaurant, up to 12,000 square -feet of office space on upper floors, parking structures, public and private open space areas, landscaping and shade trees, public realm amenities, and related site improvements on approximately 12.25 acres total (the "Project"); and WHEREAS, among the Special Categories of Development, Measure "U" provides a specific exemption for "development directly related to proposed Metrolink stations in the City of Redlands, including one at the University of Redlands;" and WHEREAS, for more than two decades, the City has planned cooperatively with the San Bernardino County Transportation Authority (formerly known as the San Bernardino Associated Governments), other local public authorities, and private interests, to establish a Metrolink rail line, Arrow passenger rail line, and train stations to serve the City; and I:\Resolutions\Res 8200-8299\8215 Redlands Mall Measure U Exemption.docx WHEREAS, on June 19, 2012, the City Council adopted Resolution No. 7173 determining that the creation of a General Plan "Transit Village Overlay" land use classification was exempt from Measure "U" to promote the development of high density residential and non-residential uses within walking distance of Metrolink stations to reduce vehicular usage, improve air quality, provide health benefits, and provide economic development opportunities, among other public benefits; and WHEREAS, on December 5, 2017, the City Council adopted the Redlands General Plan which features the Transit Villages Concept as an organizing strategy around which more than one hundred "Principles and Actions" are designed to promote sustainable infill-development within a half -mile radius of the future train stations in Redlands; and WHEREAS, on December 5, 2017, the City Council adopted the Climate Action Plan that provides policies and guidelines to enable the City's residents and businesses to operate effectively while reducing their environmental impacts from motor vehicle trips, electricity consumption/production, water use, and other effects from urbanized development; and WHEREAS, the 2035 General Plan incorporates the Transit Villages Concept and seeks to encourage transit -oriented development that will reduce motor vehicle trips and vehicle miles traveled; reduce greenhouse gases emissions, improve air quality both within Redlands and regionally, promote infill development and discourage sprawl, preserve agricultural land within and around Redlands, protect open space and conservation areas around the periphery of the city, and preserve natural hills and scenic views around the periphery of the City; and WHEREAS, the City has prepared a draft Transit Villages Specific Plan to fully implement the •community's vision for compact, efficient, attractive, transit -oriented, environmentally - sustainable, and pedestrian -friendly urban form with higher density developments consistent with Redlands' historical character within approximately half -mile radius of the three future train stations in Redlands, including the new Metrolink platform and Arrow platform adjacent to the historic Santa Fe Depot at the Downtown Station location; and WHEREAS, the proposed Project site is approximately 650 feet to the south of the Santa Fe Depot train station at its closest point (with three routes of pedestrian access available along Third Street, Orange Street, and Eureka Street), and approximately 1,300 feet to the south of the Santa Fe Depot train station at its farthest point, which is no more than 1/4-mile from the Metrolink and Arrow train platforms; and WHEREAS, the preliminary site plan for the proposed Project indicates the Project will be in substantial conformance with the design intent and pedestrian -orientation requirements contained in the draft Transit Villages Specific Plan (not yet adopted) for the preferred future buildout of the transit villages areas around the train stations, including the Project site; and WHEREAS, on April 27, 2021, the Redlands Planning Commission held a public meeting and reviewed the application for Measure "U" Exemption related to the Project, considered the written staff report, testimony from staff and the applicant, and the public comments that were submitted and read into the public record; and 2 I:\Resolutions\Res 8200-8299\8215 Redlands Mall Measure U Exemption.docx WHEREAS, on April 27, 2021, the Redlands Planning Commission found the requested Measure "U" Exemption to be consistent with the intent and provisions of Section 2, Part B, subsection 2 (titled "Special Categories of Development") of Measure "U" for "Development directly related to proposed Metrolink stations in the City of Redlands, including one at the University of Redlands" and voted 7 to 0 recommending that City Council determine the Project to be exempt from Measure "U;" NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF REDLANDS AS FOLLOWS: Section 1. The City Council of the City of Redlands hereby determines that the proposed Project (depicted in the preliminary Site Plan in Exhibit "A" attached hereto) is exempt from those provisions of the Redlands General Plan established by Measure "U," in accordance with the exemption provided for "Development directly related to proposed Metrolink stations in the City of Redlands, including one at the University of Redlands" contained in Section 2, Part B, subsection 2 (titled "Special Categories of Development") of Measure "U."
