2 THIS AGREEMENT is entered into this 7th day of April
3 1975, by and between the San Bernardino Transit System (Hereinafter referred
4 to as "SBTS"), and the City of Redlands (hereinafter referred to as "Contrac-
5 ting Entity") .
6 WITNESSETH:
-i WHEREAS, public transit service is an essential ingredient in the
8 metropolitan community of the 1970'5 and is destined to play an even more
9 important role in Southern California as the years progress; and
10 WHEREAS, the "SBTS", a Joint Powers Authority, currently provides
11 public transportation service for the citizens of San Bernardino, Colton,
12 Rialto, Fontana, Loma Linda, Redlands, and several sections of County
13 territory; and
14 WHEREAS, the passage of SB 325 has made available critically needed
15 funds for the support of public transportation to better serve the tran-spor-
16 itation needs of the commuter, the elderly, the severely handicapped, the
1,7 disadvantaged and other segments of the population as well as to assist the
1 8 general public in the mass transit field; and
19 WHEREAS, the "Contracting Entity" is desirous of additional service
20 above that currently provided in it's area, and is willing to reimburse the
"SBTS" for the added service rendered to said area, from revenue received

22 as a result of the operation of SB 325, the Transportation Development Act
23 of 1971 ;
24 NOW, THEREFORE, in consideration of the foregoing, .the several and
25 Imutual promises and agreements hereinafter contained and all Tgoverning
govrning
26 Isuch matters, the parties hereto do covenant and agree as follM'Ils:
I The "SETS'" shall provi,de public transit service as follows :
2 By means of Route 23 as indicated on. the bus schedule
3 attached hereto, and marked Exhibit "A".
4 2. Said transit service will operate on the above Route six
5 days per week - Monday thru Saturday - as indicated on
6 Exhibit "A".
'7 3. Residents of the "Contracting Entity" will be eligible
8 for any and all special programs , reduced rates, and
9 no-cost rider privileges for Senior Citizens, the Blind
10 and the Handicapped, etc. , as established by "SBTS".
4. The "SETS" will cooperate to the maximum extent possible
11
12 in the augmentation of such fare validation.or other
13 special programs as the "Contracting Entity" may wish to
14 develop and implement relative to increasing the utility
15 of bus transportation within it's area. Final determination
Iv 13 regarding the degree to which such assistance and
17 cooperation can be provided shall be made by "SETS".
18 5. Term. The term of this Agreement shall be for the period
19 April 7, 1975, thru June 30, 1975, it being the intent
20 and desire of the parties to continue the service on a
21 fiscal year-to-year basis thereafter.
22 6. Financial Support. The "Contracting Entity" shall assign
23 to "SETS", by resolution, or minute order, that portion
24 of it's local transportation fund allocation required to
finance the estimated net cost for the tern, of this
25
26 agreement and comply with such other claim procedures as
may be established by the regional transportation agency
27
(SCAG) and the State Business and Transportation Agency.

The estimated net costis $29,497 based on 498.15 miles per day
for 72 days, totaling 35,867 miles at $0.8224 Per mile.

3 7. Cancellation. This Agreement can be cancelled, effective
4 June 30th of any contract year, by either party, by the
5 serving of written notice upon the other, said notice to be
6 received at least seventy-five (75) days prior to said
7 cancellation date.
8 8. The "SBTS" shall save, keep and hold harmless the "Contracting
9 Entity" from all claims or liability for damage to property
io or death or injury to persons which may at any time arise
11 as a direct result of the operation of the public transit
12 service contemplated herein.
