O. Box 280., Redlands, CA 92373 hereafter called CITY IT IS HEREBY -AGREED AS FOLLOWS: (Use soace below and reverse side of form if needed. Set forth service to be rendered,amount to be paid,manner of payment, time for performance or completion, determination of satisfactory performance and cause for termination,other terms and conditions, and attach plans, specifications, and addenda, if any.) The City desires the County of San Bernardino, Environmental Public Works Agency, Architecture and Enginering/Real Property Division, herein-after referred to as "Division.,11 to' act on behalf of the City in the performance of appraisal, acquisition, and relocation assistance program services in conjunction with the development of any projects funded under the Community Development Block Grant Program, or an)° such other programs as the City may be entitled to in the future. 1. The Division agrees to provide the necessary manpower to render apprai- sal, acquisition and relocation assistance program services as requested in writing by the City. 2 The Division shall perform all services in accordance with federal and state statutory requirements; and, policies and procedures established by the County's Board of Supervisors. 3. No services shall be performed by the Division unless the City has suffi- cient funds available previously appropriated to cover costs of services rendered. 4. The City shall provide direction to the Division as to which properties are to be appraised and subsequently acquired. Rrzer sucn approvai the Division 2 shall negotiate on behalf of the City for the purchase of the property. 3 S. The City authorizes the County to select and hire the services of an 4 independent fee appraiser, at City's expense, if two appraisals are required 5 for any project. 6 6. The City shall appoint a Liaison Officer whose duties shall include 7 the prompt presentation of all items requiring City Management's decisions 8 and/or City Council's approval; and, assist in obtaining all items and informa- 9 tion required to accomplish prompt and professional services through City 10 Departments, such as Planning and Building and Safety. 11 7. - The Division shall keep the Liaison Officer informed of progress on 12 current projects and estimated costs as requested. 13 S. The City shall promptly disburse monies necessary to consummate the 14 acquisition of property and relocation assistance program payments when re- 15 quested by the Division. 16 9. If the Division determines that it cannot complete the acquisition 17 of any property in a reasonable amount of time it shall promptly notify the 18 City's Liaison Officer so that eminent domain proceedings- can. be started. The 19 Division shall furnish City Attorneys with appraisals and other information 20 developed during the project and shall also provide expert appraisers to 21 testify on behalf of the City in any such eminent domain proceedings. 22 10. The City shall permit the Division to proceed with all stages of 23 acquisition without interference or intervention so as to minimize any problem 24 which might arise from such interference or intervention. 25 11. The City shall disburse all monies necessary iecomraended for payment 26 by the Division regardless of any dispute between City and County and not 27 withhold any payments pending the final resolution of such dispute. 28 12. The City shall reimburse the County for funds expended in the per- 29 formance of this Agreement as billed. Billings are to be presented to the 30 City at the completion of any project, or at periodic intervals during the 31 project at the discretion of the County. 32 13. The Division shall maintain a proper accounting system in accordance 33 with the requirements of the County Auditor and make available all pertinent 34 records for City's inspection at City's request. 35 14. The City agrees to compensate the Division for services renddred as 36 follows: t!t t.151 q,I t,I Page 2 of 3 Labor - at the rate of $20.00 per working hour Transportation - at the rate of $0.20 per mile Other - material and miscellaneous expenses at actual cost is. This Agreement may be terminated upon fifteen (15) days written notice by either party. Upon such termination, the Division shall be promptly compensated for all services performed by it and shall be reimbursed for all reimbursable expenses incurred up to the effective date of termination. Unless so terminated, this Agreement shall continue in full force and effect subject to any amendments which may be approved from time to time. 16. If action be brought by the Division for the recovery of monies due or to become due under this Agreement by reason of the City's default or breach of any of the covenants or conditions here incontained, City will pay to Division all costs of suit or actions, including reasonable attorney's fees.
