RECOMMENDATION: Ap-Drove azreement with the Ci+Cv of Redlands
f--r the formation of County Service Area 110 .
BACKGROUND: On January 23 , 1984 , the Board of Supervisors
initiated an application with the Local Agency Formation Commission
for the formation of County Service Area 110 . The boundaries of the
proposed County Service Area generally include the unincorporated
areas north and south of the Interstate 10 Freeway between the
Cities of Loma Linda and Redlands , as well as portions of these
unincorporated Cities . The purpose for formation of the County
Service Area is to provide a mechanism for t-he financing and
implementation of the East Valley Corridor Study.
Section 25210 . 10a of the Government Code requires that when a
County Service Area is to include all or any part of a City, a

reso ion of consent adopted by a majority vote of the membersh--
o the City legislative body must be filed with the Clerk of the
f .
Board of Supervisors before the Board adopts the. resolut-ion. of
intention on - the CSA. A resolution of support was adopted by the
Redlands City Council on February 21, 1984. This resolution includes
wording which makesthe resolution contingent upon the signing of
an agreement between the City and the County of San Bernardino.
The proposed agreement provides that CSA 110 will not construct
or operate any service facilities within the City boundaries ,
except pursuant to later agreement of the City . The agreement
was drafted by County Counsel after concerns were expressed by the
Cit-v of' Redlands regarding the approval of County Service Area
powers , such as water and sewer powers within City boundaries .
The Agreement has been signed by the City of Redlands .

AGREEMENT
(EAST VALLEY CORRIDOR STUDY)
This agreement is entered into as of the 12thday of
March, 1984, by and between the CITY OF REDLANDS, a municipal
corporation of the State of California, and the BOARD OF
SUPERVISORS OF THE COUNTY OF SAN BERNARDINO, a charter county and
Political subdivision of the State of California, and witnesses
as follows:
Section 1. Definitions :
Unless the context clearly requires otherwise, the
following words, when used in this agreement with initial
capitalization, and whether used in the singular or the plural,
shall have the meaning ascribed by this section.
1.1 Agreement - this Agreement.
1. 2 City - the City of Redlands, a party to the
Agreement.
1.3 County - The County of San Bernardino.
1. 4 CSA 110 or County Service Area No. 110 - a county
service area proposed by the County to be established and to
function pursuant to County Service Area Law, California
Government Code Sections 25210. 1 and following.
1.5 East Valley Corridor - that territory within the
County of San Bernardino lying generally along Interstate
Route 10 which encompasses portions of the City of Redlands, the
City of Loma Linda and unincorporated territory contiguous to or
in the vicinity of said cities, and which the County proposes to
form into County Service Area No. 110.
Section 2. Recitals:
2. 1 The County proposes that CSA 110 be established and
empowered to furnish the following services:

2. 1. 2 Water
2.1. 3 Sewer
2. 1. 4 Street lighting
2.1. 5 Roads
2. 1. 6 Parkways
2.1.7 Fire protection
2. 1.8 Soil conservation and drainage control
2.1.9 Miscellaneous extended services to be
defined before the formation of CSA 110 is
approved.
2. 2 The principal purposes for which CSA 110 is
proposed to be established are to provide coordinated planning
and design within the East Valley Corridor and to facilitate
financing for the engineering, construction, operation and
maintenance of public facilities within the East Valley Corridor.
2. 3 It is in the best interests of the City and the
County to implement the above-stated purposes for which CSA 110
is proposed to be formed.
2. 4 Territory within the boundaries of the City may not
be included within CSA 110 except by consent of the City set
forth in a resolution of the City Council.
2.5 If CSA 110 is duly established, the Countv Board of
Supervisors will constitute, .ex officio, the governing body of
CSA 110.
2.6 It is difficult, if not impossible, at this time to
prepare or enter into any agreement which provides the duties and
obligations of the City, CSA 110 and the County with respect to
the construction, operation and maintenance of capital facilities
which CSA 110 might propose to be located within the boundaries
of the City.

Section 3. Duties of City:
3. 1 City will provide reasonable cooperation to the
County toward the end that CSA 110 may be duly established.
3. 2 In the event that CSA 110 is duly established, City
will provide reasonable cooperation to CSA 110 and the County
toward the end that the purposes for which CSA 110 was
established are implemented.
Section 4. Duty and Covenant of County:
4.1 In the event that CSA 110 is duly established,
CSA 110 and the County will provide reasonable cooperation to the
City toward the end that the purposes for which CSA 110 was
established are implemented.
4. 2 The County Board of Supervisors hereby covenants
that, in the event of its due establishment, CSA 110 will neither
construct nor operate nor maintain any capital improvement, other
than administrative facilities, within the territorial boundaries
of the City except pursuant to the prior written approval of the
City Council of City set forth in a written agreement between the
City and CSA 110.
4.3 Section 4. 2 shall have no application to capital
improvements or other property or facilities which are owned or
used by contractors or consultants of CSA 110 in the ordinary
course of the business of such contractors or consultants .
Section 5. Operative Effect:
5. 1 Except as to Section 3. 1, which shall become
operative as of the date first above written, this Agreement
shall have no force or effect unless or until the formation of
CSA 110 has been duly effectuated.
5. 2 This Agreement shall expire and be of no further
force or effect from and after January 1, 1989 , if CSA 110 has
not been duly established before such date.

Section 6. Indemnification:
6.1 Each of the parties to this Agreement hereby
covenants to indemnify, defend and hold the other party harmless
from all claims and liability arising out of any act or omission
attributable to the indemnifying party in the performance of this
Agreement.
IN WITNESS WHEREOF, the City and the County have caused
this Agreement to be executed as of the day and year first above
written

(EAST VALLEY CURRlDOR STUDY )
This agreement is entered into as of the 14th day of
May , 1984 , by and between the CITY OF REDLANDS, A municipal
corporation of the State of California, and the BOARD OF
SUPERVISORS OF THE COUNTY OF SAN BERNARDINO, a charter county
and political subdivision of the State of California .
This acreement also amends Section 4 . 3 as follows :
"The Board of Supervisors further covenants that a twelve
member committee to be composed of four members from each
involved entity; four selected by the County of San
Bernardino, four selected by the City of Rc6l&nds ana four
selected by the City of Loma Linda , will be appointed by the
County Board of Supervisors , the governing body of the CSA,
to act as the Advisory Committee for CSA 110. Of the four
members selectea by each involved entity, three shall be
representatives of the public agency and one shall be a
private citizen owning property in the present boundaries of
that agency within CSA 11G. "

RESOLUTION NO. 3949
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS
SUPPORTING THE FORMATION OF COUNTY SERVICE AREA 110
WHEREAS , on Monday, January 23, 1984 , the Board of Supervisors
of the County of San Bernardino forwarded an application and pro-
posal to the Local Agency Formation Commission of the County of
San Bernardino for the formation of County Service Area 110 ; and
WHEREAS , the exterior boundaries of the territory proposed
to be included within County Service Area 110 are described in
Exhibit A, which is attached hereto and incorporated by this
reference; and
WHEREAS , these proposed boundaries include an area within
the City of Redlands , as well as substantial unincorporated lands
within the Sphere of Influence of the City of Redlands; and
WHEREAS , the following services are to be provided to this
area through the proposed County Service Area pursuant to Govern-
ment Code Sections 25210 . 4 and 25210 .4a :
1. Area Planning
2. Water Service
3. Street Lighting
4 . Sewer Service
5. Roads
6. Parking Facilities and Services
7. Structural Fire Protection
8. Soil Conservation and Drainage Control
9. Miscellaneous Extended Services
WHEREAS, County Service Area 110 is proposed to be established
to provide coordinated planning and design within the East Valley
Corridor and to facilitate financing for the engineering, construc-
tion, operation, and maintenance of public facilities within the
East Valley Corridor; and
WHEREAS, it is in the best interest of the City of Redlands
to support coordinated planning and design for the East Valley
Corridor; and
WHEREAS, the County Board of Supervisors will constitute,
ex-officio, the governing body of CSA 110 if duly established;
and
WHEREAS, an agreement will be entered into between the City
of Redlands and the County of San Bernardino prior to establish-
ment of the County Service Area 110 , incorporating assurances of
cooperation between the City of Redlands and the County of San
Bernardino; and
WHEREAS, said agreement will also insure that County Service
Area 110 will neither construct nor operate nor maintain any
capital improvement other than administrative facilities within
the territorial boundaries of the City of Redlands , except
pursuant to the prior written approval of the City Council of
the City of Redlands set forth in a written agreement between
the City and CSA 110;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the
City of Redlands directs that this resolution be forwarded to the
Board of Supervisors and the Local Agency Formation Commission of
the County of San Bernardino as evidence of the City' s support for
the formation of County Service Area 110 as defined by Exhibit A
attached.

Government Code Sections 25210. 1 and following.
1 . 5 East Valley Corridor - that territory within the County
oil San Bernardino lying generally along interstate Route 10
which encompasses portions of the City of Redlands , the City of
Loma Linda and unincorporated territory contiguous to or in the
V 41'cinity of said cities, and which the County proposes to forin
into County Service Area No. 110.
Section 2 . Recit-a-31SI.
2 . 1 The County proposes that CSA 110 be established and
empowered to furnisn the followino services :

2 .1 . 2 Water
2 . 1 .3 Sewer
2.1 .4 Street lighting
2 . 1 . 5 Roads
2 . 1 .6 Parkways
2 . 1 . 7 Fire protection
2 .1 .6 Soil conservation and drainage control
2 . 2 -,he principal purposes for which CSA 11C is proposed to
be establ-�.shed are to Provide coordinated master planning and
pre-lin-inary design ,,ithin the East Valley Corridor and to
facilitate financinq for the engineering, construction,
operation and maintenance of public facilities within the East
Valley Corridor .
2 . 3 It is in the best interests of the City and the County
to imp" ement the above-stated purposes for which CSA 110 is

proposed to be formed, .

2 .4 Territory within the boundaries of the City way not be
included within CSA 110 except by consent of the City set forth
in a resolution of the City Council.
2 . 5 If CSA 110 is duly established, the County Board of
Su�ervisors will constitute , ex officio, the governing body of
CSA 110 .
2 .6 It is difficult , at this tine, to prepare or enter into
any agreenent which provides the dut, �.es and obligations of the
Citv, CSA 110 and the County with respect to the construction,
operation and maintenance of capital facilities which might be
proposed by CSA sponsored area planning studies to be located
Within the boundaries of the City.
Section 3. - Duties of City :
3 .1 City will provide reasonable cooperation to the County
toward the end that CSA 110 is duly established.
3 . 2 In the event that CSA 110 is duly established, City
will provide reasonable cooperation to CSA. 110 and the County
toward the end that the purposes for which CSA 14-10 was
established are imvIernent-ed.
Section 4. Duty and Covenant of County-

A.n the event that CSk 110 is duly established, CSA 110
and the County will provide reasonable cooperation to the City
toward ',the end that the purposes for which CSR 110 was
established are implerented.

4. 2 The County Board of Supervisors hereby covenants that,
in the event of its due establishment, csA 110 will neither
construct nor operate nor maintain any capital improvement,
other than adnin4stra+, � ve jac-' , ities, within the ter. -itorial
boundaries or Svhere 'of Interes4t, of the City except pursUan, �O

4. 3 The Board of Supervisors further covenants that a nine

Section 6. Indemnification:
6 .1 Eacn of the parties to this agreement hereby covenants
to inderinify, defend and hold the other party harmless from all
clains and liability arising out oil any act or omission
attributable to the indemnifying party in the performance of
this Agreement .
IN WITNESS WHEREOF, the City and the County have caused this
Agreement to be executed as of the day and year first above
written.
