Set forth service to be rendered,amount to be paid,manner of payment, time for performance or completion, determination of satisfactory performance and cause for termination, other terms and conditions,and attach plans,specifications,and addenda,if any,) WHEREAS, COUNTY and CITY desire to cooperate and jointly participate in the resurfacing of Lugonia Avenue from Alabama Street to State Highway 30 referred to hereinafter to the "PROJECT"; and WHEREAS, Approximately 50% of the proposed PROJECT is within in the unincorporated area of the COUNTY and 50% within the incorporated area of the CITY, and the project will be of mutual benefit to the COUNTY and CITY; and WHEREAS, it is anticipated that the primary funding for resurfacing of the PROJECT will be from COUNTY and CITY apportionments of funds , made available to local agencies under SB 300; and WHEREAS, COUNTY and CITY desire to set forth the responsibilities and obligations of each for the implementation of the PROJECT and participation in the funding of the proposed improvements. NOW, THEREFORE, IT 19 MUTUALLY AGREED AS FOLLOWS. COUNTY SHALL: 1. Act as lead agency for the PROJECT. 2. Contract for full width resurfacing of Luaonia Avenue , between 0 Alabama Street and State Highway 30, with a 0.20 foot thickness of asphalt concrete and replace traffic striping and pavement markings. 3. Initially finance ',-,he total cost of the proposed resurfacing, estimated at $50,000. 4. Obtain a no—cost Permit from CITY for work within the CITY'S right of way. 1 2 5. Require its contractors to maintain Worker 's Compensation Insurance ~ . on all employees and a Public and Property Liability insurance ' Policy of out less than *1 ,000,080 combined single limit liability coverage for bodily injury and/or property damage which obaII name the City of Redlands and the County of San Bernardino as additional insured parties. CITY SHALL: l. Reimburse the COUNTY for the cost incurred for resurfacing the . portion of Lugonie Avenue that is under jurisdiction of the CITY within thirty (30) days after receipt of a billing from the COUNTY. The CITY'S share shall be 50% of the total PROJECT cost and is estimated to be $25.000; but in no event shall exceed $28°000 unless approved in writing by the CITY. BE IT FURTHER AGREED THAT: 1. Neither party to this agreement nor officers nor employees thereof shall be responsible for any damage or llabiIity occurring by reason of anything done or omitted to be done by the other party to the agreement under or in connection with any work authority or jurisdiction not delegated to the parties under this agreement. It in also agreed that, pursuant to Government Code Section 895,4 each party shall fully indemnify and bold the other party harmless from any liability imposed for injury (as defined by Government Coda Section 810.8) occurring by reason of anything done or omitted to be done under or in connection with any work authority of jurisdiction under this agreement. 2. Upon completion of the resurfacing, the CITY and COUNTY will maintain the portion of the work within their respective areas of jurisdiction. ]. In the event any action is commenced to enforce or interpret the terms or conditions of this agreement, the prevailing party shall, in addition to any other costs and relief, be entitled to reasonable attorney's fees. THIS AGREEMENT shall inure to the benefit of and be binding upon the successors and assigns of the parties involved. WALKER, Director Transportation/Flood Control/Airports SUBJECT: COUNTY/CITY OF REDLANDS COOPERATIVE AGREEMENT RE: LUGONIA AVENUE RESURFACING PROJECT (ALABAMA/STATE HIGHWAY 30) RECOMMENDATION: Approve cooperative agreement between the County and the City of Redlands for resurfacing of Lugonia Avenue from Alabama Street to State Highway 30. BACKGROUND: This agreement sets forth the conditions under which the County and City of Redlands will cooperate in the resurfacing of Lugonia Avenue. The County will act as the lead agency. The north side of Lugonia Avenue is within the unincorporated area of the County and the south side is in the incorporated area of the City of Redlands. The project is included in the SB 300 Special Road Resurfacing Program. REASON FOR RECOMMENDATION: This agreement is needed to set forth the respon- sibilities of the City and the County in this cooperative agreement. REVIEW BY OTHER DEPARTMENTS: On July 25, 1986, the agreement was approved by Deputy County Counsel Ed Robinson as to legal form. On July 28. 1986, the agreement was found to be consistent with County Affirmative Action policies by the Departmental Contract Compliance Officer. FINANCIAL DATA: The total estimated cost for this project is $50,000. The County's estimated share of the total cost is $25,000. The project is included in the FY 1986-87 County Road Budget.
