RECOMMENDATION: Approve Maintenance Agreement No. A834/08001 between the City
of Redlands and the Flood Control District for the Brown Ditch drainage facility
located in the Redlands area.
BACKGROUND INFORMATION: In the past, the existing Brown Ditch drainage facility
has not functioned adequately due to the high maintenance requirements. The
enclosed portion of the existing facility is not able to convey the heavy debris
laden runoff and is therefore continually plugging, making it difficult to keep
operational. In order to reduce the debris problem, a small debris basin will
be constructed at the upstream end of the facility. The District will maintain
the debris basin and outlet pipe across San Timoteo Canyon Road and the City of
Redlands will maintain the remaining portion downstream.
REASON FOR RECOIRIENDATION: Presently, storm runoff overtops the existing Brown
Ditch inlets and badly erodes San Timoteo Canyon Road downstream in the City of
Redlands. Since the existing Brown Ditch facility is under the cognizance of the
District, the City of Redlands has agreed to participate with the ongoing
maintenance to eliminate the downstream problem, which will benefit both agencies.
REVIEW BY OTHER DEPARTMENTS: This matter was reviewed by Deputy County Counsel
E. H. Robinson, on August 2, 1983.
FINANCIAL DATA: The District's cost to obtain right-of-way and construct the
debris basin is estimated to be $16,000. Funds for this project are available
in Zone 3 of the Flood Control District's 1983/84 budget under Work Order
No. F00980.

WHEREAS, both DISTRICT and CITY desire to cooperatively operate and
maintain that certain drainage facility known as the Brown Ditch located in the
Redlands area, and desire to specify herein the responsibilities to each to provide
for the future, ongoing operation and maintenance,
NOW THEREFORE, THE PARTIES AGREE AS FOLLOWS:
I. DISTRICT SHALL:
A. Acquire right-of-way, construct, operate and maintain a debris
basin on the south side of San Timoteo Canyon Road. (See
Exhibit A) .
B. Operate and maintain existing thirty (30) inch corrugated
metal pipe under San Timoteo Canyon Road. (See Exhibit A) .
C. Operate and maintain concrete junction structure, as recon-
structed by CITY, located on the north side of San Timoteo
Canyon Road. (See Exhibit A) .
II. CITY SHALL:
A. Remove and reconstruct the above said concrete junction
structure.

B. operate and maintain Brown Ditch from the concrete junction
structure northerly to the Southern Pacific Railroad right-
of-way, within the existing 12-foot wide Flood Control
District easement.
IT IS FURTHER UNDERSTOOD AND AGREED THAT:
A. In order for the facility to function adequately, it is
essential each party's reach of the system be properly main-
tained and kept operational at all times. Ongoing maintenance
shall generally consist of the following:
1. Annual debris removal from the basin and outlet facility
following the storm season (additional debris removal may
be necessary during heavy storm activity and debris
transport into the system) .
2. Restoration work to damaged portions of the facility to be
completed prior to the coming year's storm season.
3. Maintenance activities shall be coordinated between DISTRICT
and CITY, to minimize costs and insure long term use of the
facility. Thirty (30) days prior notice for coordination
purposes shall be given by either DISTRICT or CITY before
commencing annual maintenance of the facility.
B. DISTRICT, its officers and employees shall not be deemed to assume
any liability for the negligence of CITY or of any officer or
employee thereof, arising from the operation and maintenance
function, and CITY shall hold DISTRICT and its officers and
employees harmless from, and shall defend DISTRICT and its officers
and employees thereof against any claim for damages resulting
therefrom.
C. CITY, its officers and employees, shall not be deemed to assume
any liability for the negligence of DISTRICT or of any officer or
employee thereof, arising from the operation and maintenance
function, and DISTRICT shall hold CITY and its officers and
employees harmless from, and shall defend CITY and its officers
and employees thereof against any claim for damages resulting
therefrom.

D. Either party can terminate this agreement upon notice in
writing to the other party not less than sixty {60} days prior
to the date of termination.
E. This agreement shall inure to the benefit of and be binding
upon the successors and assigns of both parties.
IN WITNESS THEREOF, the parties hereto have caused this agreement to be
executed by their respective officals thereunto duly authorized.
