THIS CONTRACT is entered into in the State of California by and between the San Bernardino County Flood
Control District, hereafter called the District, and

IT IS HEREBY AGREED AS FOLLOWS:

for performance or completion, determination of satisfactory performance and cause for termination, other terms and
conditions,and attach plans,specifications,and addenda,if any.)
City of Redlands, hereinafter called CITY.
WHEREAS, severe flooding has occurred in the City of Redlands
on Redlands Boulevard at the outlet of Reservoir Canyon Storm Drain; and
WHEREAS, County and CITY desire to cooperate and jointly participate
in the improvement of Reservoir Canyon Storm Drain from Fern Avenue to Zanja
Channel, herein referred to as PROJECT; and
WHEREAS, PROJECT will consist of constructing approximately a double
10 x 5 reinforced concrete box culvert and appurtenant structures; and
WHEREAS, the CITY has sent out proposals to consultant engineers to provide
a cost estimate of various alignments and design the PROJECT; and
WHEREAS, PROJECT is proposed to be constructed utilizing CITY's
funds; and
WHEREAS, COUNTY and CITY desire to set forth the responsibility and oblig-
ations of each as pertains to participation of design, construction, and future
maintenance of the PROJECT.
NOW, THERM"01RE, IT IS MUTUALLY AG=,4D AS FOIWIWS:
1 .0 CITY shall:
1 .1 Act as lead agency and advertize and award the PROJECT.

1 .2 Accept responsibility for hiring and paying all costs of a consultant
civil engineer to report on the hydrology and hydraulics of the
PROJECT; provide cost estimates on various economical alignments;
prepare final contract plans and specifications.
1 .3 Accept responsibility for completing the environmental clearance
for the PROJECT.
1 .4 Fund the total cost of the construction of the PROJECT and pay the
construction contractor.
1 .5 Provide a source of funds to pay for any unforeseen capital costs
not constructed as a part of the PROJECT that become evident within
three years after the construction completion of the PROJECT.
1 .6 Accept responsibility for the cost of relocating all utilities which
interfere with the construction of the PROJECT.
1 .7 Transmit preliminary and final plans and specifications of the PRWBM
to the COUNTY for review, comment and written approval of acceptance
prior to,advertising the PROJECT.
2.0 COUNTY shqll:
2.1 Accept responsibility and all costs to administer, inspect and provide
construction survey for the construction of the PROJECT at its own
.expense.
2.2 Accept responsibility for the future maintenance of the PROJECT
at the completion of construction except as set forth in Section
1 .5.
THIS CONTRACT, shall inure to the benefit of and be binding upon the
successors and assigns of both parties.
IN WITNESS WHEREOF, the parties hereto have caused this contract to be
executed by their respective officials thereunto duly authorized.
