WHEREAS, County and City entered into an agreement relating to
criminal history information which agreement is incorporated herein: and
attached hereto as Exhibit "A; " and
WHEREAS , the parties; desire to amend the aforesaid agreement
effective April 1 , 1981 .

Paragraphs 5 , '; and. 10 of the .aforesaid agreement are amended ,
effective April 1 , 1 981 , to read as follow,

Subscriber-Controller agrees to furnish the User Agency access to
such criminal offender record information and other criminal justice
information as is made available from the state through CEETS network . in
add + on to the CLE`f'S network, Subscriber-Controller agrees to provide
record information through the Sheriff 's CNN { Central Name Index ) through
CLETS terminals .

Basic installation of service will be assumed by the Subscriber-
Controller as provided for in Federal Crane A 4054-2-80. The total cost
of additional services , equipment, related supplies and changes or
modifications ;gill. be paid for by User Agency. The total cost to repair
or replace equipment damaged by neglect , malicious actions or accident
hili be the responsibility of the User Agency . Time costs, maintenance
and diagnostic costs will be paid by User Agency . (Refer to attached Cott
chedule 1 .

The 1ser Agency agrees to Limit access to information furnished
by Subscriber—Controller to its own employees and other criminal
justice/law enforcement agencies. The User Agency further agrees to
comply with Federal and State laws, rules, procedures and policies
formally adopted in the California Law Enforcement Telecommunication
System Subscriber Agreement , and in regard to criminal history information
furnished through the FBI/NCIC/CCH (California Criminal History ) and NLETS
Program, to rules , procedures and policies approved by the NCIC advisory
policy board adopted by NCIC . The User Agency agrees to cause employees ,
having access to the Sheriff ' s Central Name Index ( CNI ) , to complete
clearance forms as provided by the Subscriber-Controller before such
access will be allowed.
All other provisions of the aforesaid agreement shall
remain in full force and effect .

COST SCHEDULE
Monthly maintenance charges will be billed on a quarterly basis in
advance by County Communications.

County Communications will perform maintenance (change out and

SUBJECT AMEND CONTRACTS FOR USE OF NEW COMPUTERIZED CLETS NETWORK
RECOyMENDATION: Approve the following contract amendments
for the use and preservation of new CLETS network:

REASONS FOR RECOMMENDATION: it is necessary to amend the
original Telecomunica,tions Contracts to spread the overall costs
of the new computerized system among all of the agencies using
the system. The amendment also provides for costs to be paid by
User agency for repairs or replacement equipment damaged by
nt. g,-.,,ot, malicious action- or accident. The amendment further-
presrJdes for security clearance for all User Agency employees
having access to the Sheriff ' s Central Name Index (CNI) vie: the
Automated tore and Forward Sy stein.
