Settlement Agreement re Plaintiff City of Redlands' Motion to Strike and
Tax Defendant Wilbur-Ellis Company's Memorandum of Costs
Dear Mr. Lecky:
This letter confirms the agreement between plaintiff City of Redlands(the"City")and
defendant Wilbur-Ellis Company ("Wilbur-Ellis") (collectively the "Parties") concerning
Wilbur-Ellis' September 2, 2010, Memorandum of Costs("Memorandum")and the City's
September 16, 2010, Motion to Strike and Tax Wilbur-Ellis' costs.
Agreement
The City agrees to withdraw its motion to strike and tax Wilbur-Ellis' costs, and in lieu of
a hearing on this matter, Wilbur-Ellis agrees that,when or if payable, it will accept$7,000.00 as
full satisfaction of any and all costs claimed in its Memorandum. This agreement does not affect
the City's right to appeal any judgment or order made in the San Bernardino Superior Court.
If this proposed agreement is acceptable to your and your client, please sign two copies
where indicated, and return to our office for counter-signature. We will then forward you a fuliv
executed copy of the agreement.
