AGREEMENT TO PARTICIPATE IN THE zii "ARDF CALIFORNIA AIRPORT STORM WATER MONITORING GROUP" For purposes of complying with the California storm water general permit, the Airport Research and Development Foundation (ARDF), a not-for-profit research n;,,,,r,,,ons organization, is organizing the"California Airport Storm Water Monitoring Group" c Jj�-tr Arne—con (CASWMG). ARDF has retained legal counsel to review all compliance activities Ze^s as to th© neccd r_;cmprot ed and guidance for airports participating in CASWMG.ARDF will assist participating o>ncrt occrotron, fechnofogy, airports with permit compliance as outlined in this agreement. ccnVfOu:rrJn, h;ndincl ona'c'^er prct7tems� c.,Iectin�nanonof and MONrroRING PROGRAM ,retno1,onot orf trovet Participating airport understands that ARDF will submit CASWMG's group monitoring plan to the State Water Resources Control Board (State) and Regional Water Quality Boards by August 1, 1992.ARDF may, in consultation with affected regional boards, divide the group according to regional board boundaries in order to gain approval of the group monitoring plan if necessary. Approval of the monitoring plan(s) is(are)discretionary with the State and regional boards. In the event that the CASWMG group monitoring plan(s) is(are) rejected by the State and regional boards, ARDF will dissolve the group and issue compliance guidance and materials on an individual basis. In this event, each participating airport will be required to perform sampling at their facility and costs of compliance will increase. Also, in such event,ARDF will renegotiate terms of this agreement in order to provide assistance to participating airports under a new program. However, ARDF is confident that the CASWMG group monitoring plan(s)will be accepted by the State and regional boards. WATER SAMPLING T 4Eq]NG AND ANALYSIS Participating airport understands that ARDF has selected a consultant to assist in training airport personnel to perform the quantitative storm water sampling. Sampling must take place during the"wet season"of each year,between 1992 and 1996, at a minimum of 20 percent of the group members' facilities. ARDF will designate the sampling facilities based on their representativeness of the group as a whole and based on other State and regional board requirements. Airport understands that it may be selected by ARDF and agrees to participate as a sampling facility if selected.Airport understands that airport personnel, not ARDF or consultant,will perform actual retrieval of storm water discharge samples and is responsible for accuracy of sampling data. Airport understands that designated sampling facilities must sample storm water 4212 King street twice per year,for the term of the general permit during the wet season(October 1 Alexandria,Virginia to April 30)beginning with the first storm after October 1, 1992. Because of these 22302 703-824-0500 regulatory time constraints, the training for sample collection may take place prior FAX#703-820-1395 to State and regional board approval of the group monitoring plan(s). Two training Agmurant to partkipato in CASWMG Pop 2 workshops will be held in California in late summer for airport personnel to attend. Personnel from each airport will need to be in attendance at one of these workshops to be trained in sampling and monitoring observation methods.A video tape will also be provided to each participating airport for review of sampling procedures. Designated sampling facilities will receive equipment kits and sample collection kits from ARDF prior to the sampling event.Airport personnel will conduct the sampling using the protocol knowledge obtained from the workshops,workbook and video tape. The samples will be sent to a pre-designated laboratory for analyses. EvALuAinoN AND REPORTING OF DATA ARDF will submit on behalf of CASWMG all monitoring data obtained from the sampling facilities to the State or regional boards, as appropriate,by July 1 of each year,beginning in 1993 and ending in 1996. STORM WATER PoLLunON PREVENTION PLANS (SWPPP) Participating airport understands that a Storm Water Pollution Prevention Plan (SWPPP) must be developed and implemented for each airport covered by the California general permit. The SWPPP must be written to comply with Best Available Technology Economically Achievable (BAT) and best Conventional Pollutant Control Technology {BCT}. ARDF, in consultation with consultant,will prepare and distribute a generic airport SWPPP which each participating airport will modify and complete using instruction provided. Costs for implementing specific SWPPP requirements (e.g., topographic map, site map and other requirements outlined in the California General Industrial Storm Water Permit,Water Order No. 91-13-DWQ at 5-8)are not included in the cost of participating in the CASWMG. NoN-SToRm WATER GumANcE AND CERTmcAnor4 Participating airport understands that the California general permit prohibits non-storm water discharges, including illicit connections and discharges containing hazardous substances in excess of reportable quantities. Each airport must conduct special tests to verify the absence of non-storm water discharges twice a year during the dry season. These tests must be certified,documented and kept on file at the airport. Airports must certify that these discharges, if any, have been eliminated. ARDF will prepare a guidance manual with instructions on methods to evaluate and eliminate all non-storm water discharges. The manual will include methods for tenant interviews, storm drainage audits, evaluator techniques,testing methods and reporting instructions. Agrewmmt to parkipate in CASWMG Pogo 3 ftcomKmAnoN OF BEST MANAGEmEN-r PRAcncEs (BM[Ps) ARDF will develop appropriate BMPs for airports to accompany the reporting of data each year to the state. The plans will provide comprehensive and cost effective options for ensuring compliance with the general permit. ARDF will continue to assist participating airports in regulatory compliance with the California general permit.The cost of sampling, along with other administrative costs—that is, legal, administrative, analytical and developmental— associated with this ongoing service will be shared among the entire CASWMG. Contract costs are based on: consultant estimates of average outfalls per sample airport size to be sufficient for monitoring; existing California state permit requirements, and existing number of participating airports(110). If any of these elements change, program costs will be subject to increase without notice. If such increase exceeds 15 percent, participating airport can reconsider this agreement. Participating airport assumes liability for personnel injury during sampling; assumes liability for any necessary storm water system mitigation for that airport required by the state of California, and assumes liability for any state issued fines or permit compliance violations for that particular airport. to padkipcft in CASWMG Pogo 4 Participating airport has read the California General Industrial Storm Water Permit,Water Quality Order No. 91-13-DWQ (Nov. 19, 1991), and fully under- stands the implications of compliance options. Airport understands that certification of accuracy for sampling will be required by each designated sampling facility. Airport understands that certification of non-storm water discharge will also be required by both sampling and non-sampling facilities. Airport has or will submit Notice Of Intent(NOI)directly to the State by March 30, 1992, along with the appropriate permit fee of$250 or$500, for coverage under general permit. Participating airport will be invoiced annually and payment will be due on or before April 30 of each year. Airport understands that any CASWMG member that fails to make sufficient payment within payment schedule deadlines is subject to being dropped from the group. Airport further understands that all payments are non- refundable. By signing below, airport, or executive officer,confirms authority to commit to this agreement and to making such payments. Participating airport agrees to participate in the CASWMG and agrees to this agreement beginning April 30, 1992 and ending on November 19, 1996 or when CASWMG obligations under the California general permit have been fully satisfied, which ever comes first.
