Re: Construction of sewer, storm drain, curb and gutter under, on and
across property located in Redlands, California.
This agreement is entered into this day of d&L-)CLj 1986 between
Alan M. Smotkin and Michele S. Smotkin, hereafter referred to as Party
A, and William E. Jahn and Pridemark Construction Company, Inc. , and/or
their agents or assignees, hereafter referred to as Party B.
Party A herein gives Party B access to Party A's property located con-
tiguous to and west of University Street (extended) between Pennsylvania
Avenue on the south and San Bernardino Avenue on the north in the City
of Redlands, County of San Bernardino, State of California for the follow-
ing purposes:
A. Construction of a storm drain system as depicted in the street
improvement plans for tract number 12797 for the City of Redlands,
drawn by Hicks and Hartwick Engineers and Surveyors, attached
hereto.
B. Construction of a sewer system as depicted in the sewer improve-
ment plans for tract number 12797 for the City of Redlands, drawn
by Hicks and Hartwick Engineers and Surveyors, attached hereto.
All of the above mentioned construction will be on and below ground along
lines within the City of Redlands required future extention of Kimberly
Avenue.
Bartv B will incur all expenses and liabilities pursuant to the construc-
tion of the above mentioned items A and B, and agrees to hold Party A
harmless from any expense, liability or damages caused by Party B from
the construction of said items.
This agreement represents the only agreement between Party A and Party
B concerning the construction of a storm drain system and sewer system
under, on and across Party A's property described herein.
