r A G R E E M E N T This Agreement , made this 3rd day of June 1975 by and between West Redlands Water Company, a corporation, hereinafter called "Company", and the City of Redlands , a municipal corporation, hereinafter called "City". WITNESSETH WHEREAS, the Company owns a certain water well known as Well No . 14 (State of California Recordation No. 3601295) adjacent to City property known as Ford Park; WHEREAS, said Well No . 14 is equipped with City-owned pumping equipment and is operated and maintained by the City pursuant to a contract with the Company; WHEREAS, said Well No . 14 is currently being utilized by the City as a source of supply for the City' s public water system; WHEREAS, the Company owns a certain parcel of land located within the City of Redlands , County of San Bernardino, as described in Exhibit "A" attached hereto, and incorporated by reference herein; WHEREAS, the aforesaid parcel of land, described in Exhibit "A". together with Well No . 14, can be beneficially used by the City for public purposes ; NOW THEREFORE, in consideration of the mutual promises and benefits to be derived by each of the parties hereto , it is agreed as follows : 1. The Company shall convey by deed to the City all rights , title, and interest in the above-described real property set forth in Exhibit s§A't ,, together with the existing Well No . 14 (State of California Recordation No. 3601295) located on the aforesaid real property. i 2. At all times hereafter, so long as the Company is in existence, the City shall make available to the Company irrigation water not to exceed 500 acre feet per year during all such periods of time as the Company shall have insufficient irrigation water for the Company' s irrigation water purposes . All water made available by the City to the Company hereunder shall come from the Cityts stock ownership entitlement in the Bear Valley Mutual Company, or water of like irrigation quality, from any other source available to the City except through City stock entitlement in West Redlands Water Company. M 3. All irrigation water supplied by the City to the Company hereunder from the date of this agreement for ten years thereafter shall be without cost to the Company. All such deliveries of water by the City to the Company thereafter for a period of ten years shall be at the rate of $0. 30 per miners inch day (1728 cubic feet) . All water deliveries made by the City to the Company from and after twenty years from the date of this agreement shall be at a rate equivalent to the lowest cost water available to the City. 4. The Company shall sell water made available by the City only to Company shareholders for use by the shareholders . 5. The City agrees to, at all times hereafter while the City water stock program is in effect, maintain the ratio of seven inches of City water entitlement for each share of Company stock sold by a shareholder to the City for development or building purposes . 6. By mutual agreement of each of the parties hereto , this agreement may be amended, terminated or extended for such periods as the parties may agree upon. NEW BUSINESS Resolution No. 3179, a resolution requesting the Federal Resolution Government to modify the Ho-.:.sing and Community Develop- No. 3179 ment Act of 1974 to allocate block grant fu.ds for Housing and cities with populations of 50, 000 or less, was presented. Community This was discussed at length and was tabled to a later Development date to allow the Housing Commission to review the Act resolution at their meeting rear the end of June. Mr. Medina, of 25502 San Bernardino Avenie, addressed Council. He commented on the work of the ABLE Committee toward a Federal Grant for a senior citizens ` center. He requested that the Council keep in mind applying for funds in 1975 for a community center for the north side. CITY MANAGER Following lengthy discussion, on motion of Councilman Miller, seconded by Councilwoman Grace, unanimous SBTS approval was given to an agreement between. Sar: Bernardino Agreement Transit System and the City of San Bernardino for the purchase of San Bernardino cityow.ed vehicles and vehicles & equipment. The Council was assuxed that t:ere were Equipment ample funds remaining in the 325 monies to cover the Redlands portion of this cost.
