THIS INDENTURE, made by and between,
City of Redlands, A Municipal Corporation
hereinafter called the Grantor and SAN 131IRNARMNO VALLEY MUNICIPAL WATER DISTRICT, a
Municipal Water District,organized and existing under the laws of the State of California, hereinafter called
the Grantee,

THAT the Grantor, for a good and valuable consideration, the receipt and sufficiency whereof is Cq
hereby acknowledged, does hereby grant, bargain, sell and c01lvey unto Grantee, its successors and assigns, a
perpetual easement rorty feet ( 40 ) in width, hereinafter described, to con-
struct, reconstruct, remove, replace, repair, maintain, operate and use one or more pipelines together with
braces, connections, fastenings, communications cable arid other appliances and fixtures in connection
therewith or appurtenant thereto for the transmission and distribution of water oil, under, along and across
that certain real property located in the County of San Bernardino, State of California, and described as
follows:

This grant shall carry with it the right to inspect, alter, remove, replace, reconstruct and repair the said
pipelines and other appurtenances, the right to mark the location of said easement by suitable markers set
and maintained in the ground at locations which shall not interfere with such reasonable use as Grantor
shall make of the land within limits of said easement, the right to use such lands of the Grantor imilledi-
ately adjacent to either side of the easement as may reasonably be required by Grantee in connection with
the construction, reconstruction, maintenance, replacement and removal of the pipelines and other appurte-
nances and the right of ingress to and egress from the said easement across the lands of the Grantor for all
purposes useful or convenient in connection with or incidental to the exercise and enjoyment of the rights
herein granted.
TO HAVE AND TO HOLD the above-described rights and easement unto the Grantee, its successors
and assigns, for as long as Grantee desires to exercise the same, and Grantee may assign the rights and
easement herein granted, either in whole or in part, subject to the terms of this grant.
The pipe and other appurtenances shall at all times remain the property of Grarllee notwithstanding
the same may be annexed or affixed to the freehold, and shall at any time and 1'ronl time to time be
removable, in whole or in part, by Grantee, its successors or assigns.
In the event Grantee permanently abandons the pipelines, Grantee, at its option, may leave the pipe
and its appurtenances in place and shall execute and record a reconveyance and release of this grant.
Grantor reserves the right to full use and enjoyment of said premises, except for the purtioses herein
granted, provided that such use and enjoyment shall not hinder, conflict or interfere with the exercise of
Grantee's right hereunder, and that no excavation, building, structure or obstructions shall be constructed
on the said easement without Grantee's written consent, which consent shall not be unreasonably withheld.
Grantee, insofar as it is practicable to do so, shall bury all pipes and appurtenances M time of construc-
tion and shall restore the surface of the ground, so far as is practicable, to its condition prior to installation.
Grantee shall pay Grantor the reasonable amount of actual damages to crops, timber, fences, buildings,
private roads, and other improvements caused by it on said lands in the construction or reconstruction of
the pipelines or in exercise of the right of ingress or egress.
Grantor represents, convenants and warrants that such of the undersigned as are shown on record in
said County as owners in fee simple of the lands hereinabove described are indeed the owners of'such fee
simple title, subject only to outstanding encumbrances, if any, now on record in said County.
It is hereby understood that the parties securing this grant on behalf of Granlcc are without aulflority
to make any convenant or agreement not herein expressed.
The provisions hereof shall inure to the benefit of and be binding upon the parties hereto, their
respective heirs, representatives, executors, administrators, successors and assigns.

The Southerly 40 feet of Chat portion of Lots 1 and 2, of Block 27 of Mentone, in
the County of San Bernardino , State of California, as per plat commonly known as
"Stretch Map", recorded in Book 8 of Maps, Page 81 , Records of said County, more
particularly described as follows:
Beginning at a point on the West line of said Lot 1, 615.88 feet Southerly
Of the Northwest Corner thereof, said point being the Southwest corner of
Parcel No. 13, as described in the Final Order of Condemnation, filed in
Book 7047, Page 430, Official Records of said County;
Thence South 86'45 ' 18" Fast, 1955.62 feet along the Southerly line of said
Parcel No. 13 to its intersection with the Southerly line of that parcel of

This is to certify that the interest in real property conveyed by
the deed or grant dated April 2, 1986 from City of Redlands, a
Municipal Corporation to the SAN BERNARDINO VALLEY MUNICIPAL WATER
DISTRICT, a governmental agency, is hereby accepted by the undersigned
officer on behalf o the Board of Directors of the San Bernardino Valley
Municipal Water District pursuant to authority converred by Resolution

The Westerly 250 feet of that Portion of Lot 2, Block 27 of Mentone, in the County of
San Bernardino, State of California, as per Plat commonly known as "Stretch Map",
recorded in Book 8 of Maps, Page 81, Records of said County, more particularly
described as follows:
Commencing at an angle point in the North line of Tract No. 2875, (VALLE
VISTA TRACT) , as per plat recorded in Book 45 of Maps, Pages 48 through 50,
inclusive, Records of said County, said angle point being shown on said plat
as being on the North line of a 20 foot wide alley, and lying North 71°22' East,
a distance of 124.38 feet from its intersection with the centerline of
Julian Drive East;
