CERTIFICATE OF ACCEPTANCE: This is to certify that the easement granted to the City of Redlands,a governmental agency,dated ME 2,2001 from San Bernardino Associated Governments, a public agency existing under the authority of the State of California is hereby accepted and the Grantee consents to the recordation thereof by its duly authorized officer. Dated: -T.oe ger,City-/Redlands (Revised 06,A)VOI) �!Ja 7 EASEMENT EASEMENT, made this 2nd day of May 2001, from SAN BERN.ARDINO ASSOCIATED GOVERNMENTS, a public agency existing under the authority of the laws of the State of California, hereinafter refer-red to as "SANBAG", to CITY OF REDLANDS, a Municipal Corporation, hereinafter referred to as "Grantee". FOR A VALUABLE CONSIDERATION, receipt of which is hereby acknowledged, zn I SANBAG hereby GRANTS to Grantee an Easement for public street, highway, and/or public utility purposes upon, over, and across the following described real property: SEE ATTACHED EXHIBITS "A", "B", "C", and "D EXCEPTING AND RESERVING the right, to be exercised by SANBAG, and by any other who have obtained, or may obtain, permission or authority from SANBAG to do so, (a) to operate, maintain, renew andJor relocate any and all existing railroad track or tracks, wires, fiber optic cables, pipes, and other facilities of like character upon, over, or under the surface of the hereinabove described premises; and (b) from time to time to construct, operate, maintain, renew and/or relocate upon said premises additional facilities of the character described in Clause (a) of this paragraph, consistent with the rights granted herein, without in any instance being required to obtain the consent of Grantee the same as if this easement had not been executed. TO HAVE AND TO HOLD said easement unto Grantee solely for public street, highway, and/or public utility purposes so long as the premises hereinabove described shall be so used, subject, however, to all licenses, leases, easements, restrictions, reservations, conditions, covenants, encumbrances, rights and rights of way, liens and clainis of title -which may in anywise affect the said premises and subject, also, to the express condition subsequent that if said premises, or any portion hereof, shall cease to be used for the purposes above stated, then, and in that event, the easement hereby given shall, as to such portion, or portions. as the case may be, thereupon cease and determine and SANBAG, its successors and assigns, shall resume possession thereof the same as though this instrument had not been executed. zn This Instrument is given without warranty of title of any kind, express or implied, and no covenant of warranty of title shall be implied from the use of any word or words herein contained. In case of the eviction of Grantee by anyone owning, or claiming title to or any interest in the premises hereinabove described. SANBAG shall not be liable to Grantee for any damage of any nature whatsoever.
