On November 22, 1999, this court entered that Judgment in Condemnation pursuant to
19
Stipulation with regard to a portion of Assessor's Parcel No. 299-011-23 in the above-entitled
20
action in the County of San Bernardino, California, adjudging that Plaintiff City of Redlands is
21
entitled to take from Defendant Union Pacific Railroad Company by condemnation,a fee parcel of
22
3 a portion of Parcel No. 299-011-23. The Court finds:

1. That the City of Redlands has condemned a portion of Parcel No. 299-011-23 for the
24
purpose of constructing street improvements to the intersection of Wabash Avenue and Colton
25
Avenue in the City of Redlands.

2. That the City of Redlands filed a Notice of Pendency of Proceeding (Doc. No.
27
19990364432) for the above-entitled case with the County Recorder on August 27, 1999;

1 3. That the City of Redlands has satisfied the terms of the Judgment entered November 22,
2 1999 by paying just compensation as provided herein to Union Pacific; and
3 4. That all other parties of record having an interest in the subject property have been
4 defaulted by the City of Redlands or have filed a disclaimer within this action or have been
5 dismissed from the action.

7 Based on the foregoing:
8 IT IS HEREBY ORDERED, ADJUDGED AND DECREED:
9 1. That by recordation of this Final Order of Condemnation,the City of Redlands acquires
10 fee simple title to a portion of Parcel No. 299-011-23, as more particularly described below;
11 2. That the real property in interest referred to in this Final Order of Condemnation is a
12 portion of Parcel No. 2.99-011-23 is more particularly described in Exhibit"A,"attached hereto and
13 incorporated herein by reference;
14 3. That the interest acquired by the City of Redlands herein shall have priority as of August
15 27, 1999, the date upon which Redlands filed the Notice of Pendency of Action for the above-
16 entitled case against all interest holders bound by the judgment herein or any person or entity who
17 acquired an interest in the property after August 27, 1999.
18 4. That the Notice of Pendency of Action is hereby released.
