That the City of Redlands has condemned parcel number 169-011-19 for the purposes of conducting 23 Z, 24 street widening improvements on Lugonia Avenue and for the Home Depot,U.S.A.,Inc.Project within the City of Redlands; 25 26 2. That the City of Redlands filed a Notice of Pendency of Proceeding(Document No. 20000365674} for the above-entitled case with the County Recorder on October 6, 2000; 27 3 That the City of Redlands has satisfied all terms of the judgment entered on December`?7,12000 by 28 lerniplead\5018 Lugo ernin dom final order condern FINAL ODDER IN CONDEMNATION I paying just compensation to the County Treasurer for the County of San Bernardino; and 2 4. That all other parties of record having an interest in the subject property have been defaulted by the 3 City of Redlands or have filed a disclaimer within this action or have been dismissed from this action. 4 Based upon the foregoing: 5 IT IS HEREBY ORDERED, ADJUDGED AND DECREED: 6 1 That by recordation of this Final Order of Condemnation,the City of Redlands acquires fee simple 7 title to Assessor's Parcel No. 169-011-19, as more particularly described below; 8 2. That the real property in interest referred to in this Final Order of Condemnation, Parcel No. 169- 9 011-19, is more particularly described in Exhibit "A" which is attached hereto and incorporated herein by 10 reference; 11 3. That City was entitled to take possession of the above-described real property on or about November 12 9,2400,pursuant to an Order of Possession issued on October 6,2000,and in accordance with Section 5082 13 of the Revenue and Taxation Code,the real property taxes,assessments, interests and penalties thereon shall 14 be apportioned as of said date and shall be terminated,canceled and extinguished from and after said date, 15 as may be authorized by law. 16 4. That the interest acquired by the City of Redlands hereby shall have priority as of October 6,2000, 17 the date upon which City filed the Notice of Pendency of Action for the above-entitled case, against all 18 interest holders bound by the Judgment herein or any person or entity who acquired an interest in the 19 property after October 6, 2000; 20 5.
