GRANT OF CONSERVATION EASEMENT
Recitals
WHEREAS, Bank of America, a national banking association,
successor to Security Pacific Bank, Trustee, under True. No. 7-5-18377-0
and 7-5-18379_0, ("Grantor") , is, the owner of that certain real property
described in Exhibit "A" attachedhereto and incorporated by reference
herein ("Property")
WHEREAS, the City of Redlands, a Municipal Corporation (the
"City") has purchased property contiguous to and; on both sides of
Grantor's Property.
WHEREAS, Grantor as part of the purchase noted above is
obligated to grant a conservation easement to the City which conservation
easement shall encumber and burden the Property, and the City wishes to
receive and hold a conservation easement burdening the Property on the
terms and conditions set forth herein,
NOW, THEREFORE, Granton hereby grants to the City a conservation
easement burdening the Property on the terms and conditions set forth below::
Terms and Conditions of Grant
1 : Purpose of the Easement. The purpose of this easement is to;
grant a conservation easement pursuant to Chapter 4, Title II, Part 2, Divi-
sion 2 of the California Civil Code and this grant of easement shall be
construed in accordance with and subject to such provisions of law..
2. Nature of Easement. The easement granted hereunder is a
conservation easement which has the affect of prohibiting the use of
Property for uses which would interfere with using the Property for open'
space, natural , scenic, historical , and agricultural rises. In accordance
with this general restriction upon the use of the Property, the following
specific uses or activities with respect to the Property shall be prohibited:
a The construction or placing of any additional buildings
upon the Property, except for those buildings used for agricultural purposes,
or the dwelling presently on the Property
