Right-of-way at any time, or from time to time, to construct, maintain, operate replace, and renew the roadway described on Exhibit "A" and shown on Exhibit W, and appurtenant structures in, upon and across said Easement Area or any part thereot and B. Enrique Martinez, City Manager I 0-1 ry FROM: Rosemary Noerning, City Engineer - DATE: December 2, 2010 SUBJECT: Roadway Easement at CUP # 971 Recommendation: 1 am recommending the City Manager execute the attached Certificate of Acceptance for a roadway easement. Background: As a condition of approval for the CUP # 971 entitlement, the owner is required to provide an additional ten (10) feet of roadway width (easement) dedication along the property frontage of Redlands Boulevard to meet the City's East Valley Corridor Specific Plan designated street half width. The project owner is Redlands Body Shop Property, LLC. The property is located at 1139 West Redlands Boulevard, in the City of Redlands. Redlands Body Shop Property, LLC has requested the certificate of acceptance from the City (see attached original). The form of the easement document was reviewed by the City Attorney and is deemed acceptable. The legal description was reviewed by the MUED engineering staff and is also deemed acceptable. The San Bernardino County Recorder requires all easements offered to a public agency to have a Certificate of Acceptance executed by a representative of the agency. The City Manager is authorized to accept the Road Easement on behalf of the City per Council Resolution No. 6766 approved on September 3, 2008.
