HomeMy WebLinkAboutContracts & Agreements_122-2021FIRST AMENDMENT TO AGREEMENT TO PERFORM PROFESSIONAL SERVICES This first amendment ("First Amendment") to the agreement for professional planning consulting services to prepare the 6th Cycle Housing Element Update dated the 21st of July, 2020 ("Agreement"), by and between the City of Redlands, a municipal corporation ("City"), and Michael Baker International, Inc. ("Consultant"), is made and entered into this 6th day of July, 2021 RECITALS WHEREAS, it is the desire of the City and Consultant to amend their existing Agreement, specifically the scope of services, cost estimate, and project schedule, for the purpose of complying with additional new guidelines and requirements of the California Department of Housing and Community Development related to preparing the 6th Cycle Housing Element; and WHEREAS, it is the desire of City and Consultant to amend Exhibit "A" of the Agreement, titled "Scope of Services," to increase the scope of services to include those described in Exhibit "1," which is attached hereto and incorporated herein by reference; and WHEREAS, it is the desire of the City and Consultant to amend their existing Agreement to extend the time for completion of the services to February 28, 2022, and WHEREAS, it is the desire of City and Consultant to amend Article 5 1 of their existing Agreement to increase Consultant's present total compensation of two hundred forty-one thousand forty-five dollars ($241,045) to the amount of two hundred sixty five thousand one hundred fifteen dollars ($265,115), NOW, THEREFORE, City and Consultant agree as follows AGREEMENT Section 1 The scope of work performed by Consultant pursuant to Exhibit "A" of the Agreement, titled "Scope of Services," is hereby amended to include the work that is identified in Exhibit "1 " Section 2. The project schedule contained within Exhibit "B" of the Agreement is hereby deleted in its entirety, and substituted with a new project schedule in the form attached hereto as Exhibit "2." Section 3. Section 4 1 of the Agreement, titled "Performance of Services," is hereby amended to read as follows "4 1 Consultant shall perform and complete the Services by February 28, 2022, unless the Services are terminated earlier as provided for herein." 1 L.\ca\djm\Agreements\Michael Baker First Amend Housing Blement.FY20-0155.docx.jn Section 4 Section 5 1 of the Agreement, titled "Payments to Consultant," is hereby amended as follows "5 1 Total compensation for Consultant's performance of the Services shall not exceed the amount of Two Hundred Sixty Five Thousand One Hundred Fifteen Dollars ($265,115). City shall pay Consultant on a time and materials basis up to the not to exceed amount in accordance with Exhibit "C," titled "Compensation," which is attached hereto and incorporated herem by reference " Section 5 All other provisions of the Agreement shall remain unchanged by this First Amendment and in effect IN WITNESS WHEREOF, the parties have executed this First Amendment, to be effective as of July 6, 2021 CITY OF REDLANDS Paul T. Barich, Mayor ATTEST nne Donaldson, City Clerk MICHAEL BAKER INTERNATIONAL, INC By Tanya Bi e kjian, Vice President 2 L•\ca\djm\Agreements\lvhchael Baker First Amend Housing Element.FY20-0155.doex.jn EXHIBIT 1 The amended Scope of Work shall consist of the original scope or work plus the addition of Tasks 8 1 and 8.2 as described below "Task 8 Affirmatively Furthering Fair Housing Appendix Task 8 1 — AFFH Appendix Michael Baker will prepare an AFFH appendix that identifies strengths and weaknesses in fair housing practices and identifies the relationship between the fair housing findings and the Housing Element Sites Inventory We will use data provided by SBCTA via the local jurisdiction data packet and the regional AFFH analysis and other sources (i.e. local knowledge, service provider records, San Bernardino County 2020 Analysis of Impediments/Consolidated Plan, etc.) to analyze the fair housing issues and their contributing factors in the City of Redlands. The appendix will be developed through a public process that engages local stakeholders in the determination of priority needs, as described in Task 8.2. Key elements will include. • Introduction — overview of AB 686 and a brief history of Redlands summarizing existing demographic composition including race/ethnicity, age, housing tenure, familial status, etc., and compare it to the region. • Outreach — a summary of engagement conducted with and outcome of that engagement with fair housing service providers. • Assessment of Fair Housing — this section is the bulk of the AFFH analysis and covers o Fair Housing Enforcement and Outreach Capacity o Integration and Segregation Patterns and Trends Related to People with Protected Characteristics and Lower Incomes o Racially and Ethnically Concentrated Areas of Poverty o Disproportionate Housing Needs, Including Displacement o Summary of Fair Housing Issues, Including Local Knowledge • Site Inventory — Improved/Exacerbated Conditions o Segregation and Integration o Racially and Ethnically Concentrated Areas of Poverty and Affluence o Disparities in Access to Opportunity o Disproportionate Housing Needs, Including Displacement o Isolation of the RHNA 3 L.\ca\djm\Agreements\Michael Baker First Amend Housing Element.FY20-0155.doex.jn • Identification and Prioritization of Contributing Factors — this section identifies Fair Housing Issues and Contributing Factors, prioritizes the contributing factors and address their influence on the Goals and Actions. • Goals and Actions — this section identifies specific goals and actions that address the contributing factors and provides a timeline for each contributing factor Michael Baker will prepare and administrative draft of the AFFH appendix for City review and comment. Michael Baker will then prepare a clean public review draft incorporating City comments for submission to HCD It is assumed the AFFH appendix will contain no more than 25 maps/figures and no more than 12 tables. Task Deliverables AFFHAppendix, Administrative Draft (1), AFFHAppendix Public Review Draft (1) in electronic format. Task 8.2 — Outreach Michael Baker has completed the public engagement under the current contract for the purposes of the Housing Element Update This task will allow Michael Baker to reengage service provider stakeholders already interviewed to gather specific feedback related to fair housing practices and to assist the City with prioritizing needs and services. Michael Baker will make contact with, and gather information necessary from, the Inland Fair Housing and Mediation Board (IFHMB) for the AFFH appendix. This outreach to service providers and the IFHMB will take place over phone or video conferencing. Finally, Michael Baker will host a virtual focus group for local stakeholders to provide input and feedback on goals and policies related to AFFH.
