HomeMy WebLinkAboutDeeds & Easements-17-1998E_CCv0001.pdf RIGHT-OF-ENTRY CITY OF REDLANDS, a municipal corporation, does hereby grant to the SAN BERNARDINO COUNTY FLOOD CONTROL DISTRICT, its officers, agents, employees and those under contract to it, including but not limited to the United States Army Corps of Engineers and the United States Fish and Wildlife Service, hereinafter referred to as GRANTEES permission to enter upon the hereinafter identified real property for the purpose of biological surveys, including trapping, identifing and releasing native wildlife as well as investigating for the presence of sensitive plant life, in conjunction with GRANTEES proposed San Timoteo Creek Improvement Project located within Section 4, Township 2 South, Range 3 West, San Bernardino Meridian. REAL PROPERTY DESCRIPTION: THE PROPERTY COVERED BY THIS RIGHT-OF-ENTRY IS SHOWN IN YELLOW COLOR ON EXHIBIT "A" ATTACHED HERETO AND MADE A PART HEREOF. The right to trap, identify and release wildlife includes the right to enter the property during daylight hours to place traps and the right to enter the property between dusk and dawn to bait traps as well as to indentify and release any trapped wildlife. The right to investigate for sensitive plant life includes the right to enter the property during daylight hours to examine areas of native habitat. It is understood that the rights granted herein are for a 45 day period beginning on the date shown below. The GRANTEES agree to only use the property for seven days during the time period stated above. That seven day period will begin on the date of initial occupancy for either of the above stated purposes. The permission hereby granted also includes the right to use said property for access to adjoining properties. It is also understood that GRANTEES shall leave the subject property in as close to its current condition as is reasonably possible. As I am sure you are aware, the U. S. Army Corps of Engineers is currently working on a redesign of the proposed improvements on San Timoteo Creek from California Street upstream to easterly of San Timoteo Road. That redesign requires additional biological investigations to determine if there are any endangered wildlife or sensitive plant life located within the new project limits. The Corps of Engineers has asked the District to act as the lead agency in gaining permission to enter onto various parcels of land to perform the necessary biological surveys. Attached, for your consideration, is a Right-of-Entry to the District allowing it, the Corps of Engineers, and the U. S. Fish and Wildlife Service to enter onto your property to perform the necessary surveys. Please accept this letter as the District's official request for a Right-of-Entry to perform the required surveys. If you are willing to allow the proposed use, please sign and return the attached original Right-of-Entry.
