State of California THE DEPARTMENT OF WATER RESOURCES The Resources Agency Project -East Branch Extension Feature: Crafton Hills Parcel No.: SGP-8, APN: 168-362-02 RIGHT OF ENTRY The undersigned"Permittor hereby grants permission to The State of California, Department of Water Resources, its agents and contractors, hereinafter referred to as"Permittee," to enter upon PermittotJs land in the County of San Bernardino, described as that portion of Assessors Parcel Number(s) 168-363-02, and outlined in red on the attached map for the purpose of and for the installation of appurtenances, and incidental uses thereto subject to the following conditions: 1. This permission is not a waiver in any way of the right to just compensation for such land or of any remedy authorized by law to secure payment thereof, or of any right to relocation assistance. 2. Permittee will,without unnecessary delay, negotiate with the undersigned Permittor and any other person, having any right, title or interest in said property, to agree upon terms of compensation, and if agreement cannot be reached, Permittee will promptly commence eminent domain proceedings to have such compensation determined. Where a condemnation action is commenced, this permission shall extend until final determination of said action. 1 The effective date of"possession"shall be the date signed as'accepted" by Permittee, as written below. 4. Permittee will pay interest at the rate of the State Surplus Money Investment Fund to accrue from the date of possession to the date a warrant is issued by Permittee. Such interest shall be computed on the amount of payment for the real property area set forth on the attached description or outlined on the attached map, and damages thereto, irrespective of settlements or payments made for other adjoining lands. 5. Permittee agrees to indemnify and hold harmless Permittor and to either repair or pay for any damage caused by reason of the use authorized by this Right of Entry. & Permittee reserves the right to terminate this Right of Entry upon Permittee's determination that no additional permanent rights are necessary over this property. The purpose of the Right of Entry is to install DWR's 54 inch pipeline to accommodate the East Branch Extension Project. Please see the enclosed drawing. The exact location will be determined prior to construction. Due to the urgency of the job, DWR is requesting permission to enter the property and begin construction in the spring of 1998, with the understanding that negotiations will continue and that the City of Redlands will receive just compensation for the purchase of any property rights.
