Box 5906 San Bernardino, CA, 92412-5906 Attn: Sam Fuller, Chief Engineer SPACE ABOVE THIS LINE FOR RECORDER'S USE TEMPORARY CONSTRUCTION EASEMENT The City of Redlands, a municipal corporation, ("GRANTOR"), hereby grants to the San Bernardino Valley Municipal Water District, a municipal water district, ("GRANTEE"), and its successors and assigns, a temporary construction easement as described below, over, under, across and through the real property as described in the legal description set forth in EXHIBIT "A," (the "Property") which is attached hereto and by this reference made a part hereof. WITNESSETH: WHEREAS, GRANTOR represents and warrants that it is the owner of that certain parcel of land described as follows: PARCEL 3 of PARCEL MAP NO. 17558, as recorded in BOOK 216, PAGES 92 and 93 of PARCEL MAPS of the COUNTY OF SAN BERNARDINO, STATE OF CALIFORNIA. and, Page 1 of 2 WHEREAS, GRANTEE proposes to undertake certain capital improvement work fpr GRANTEE's CENTRAL FEEDER GROUND WATER BANKING CONJUCTIVE USE PROJECT NOW, THEREFORE, it is agreed as follows: For valuable consideration, receipt of which is hereby acknowledged, GRANTOR hereby grants to GRANTEE, its successors and assigns, by this Temporary Easement, the right to locate equipment, materials and to perform work on the Property for the purpose of carrying said construction activities consistent with the purposes of the project. GRANTOR and GRANTEE, respectively, shall each defend, indemnify and hold harmless the other from and against any and all claims, actions, damages, liability or losses, including reasonable attorneys' fees and other professional costs, in connection with loss of life, personal injury and/or damages to property arising from or out of the negligent and/or intentionally wrongful acts or omissions of such parties, and their respective officers, agents, representatives, contractors, employees or invitees. Immediately after completion of the construction, GRANTEE shall restore the Property as near as may be to its original condition immediately before such construction or entry. This Temporary Construction Easement shall remain in existence until such time as GRANTEE will have fully carried out the original construction necessary to complete the Project, but in any event will terminate two (2) years after the recordation of this agreement.
