BOX 3005 REDLANDS, CA 92373 (THIS SPACE FOR RECORDER'S USE ONLY) GRANT OF WATERLINE EASEMENT (AFFECTS ASSESSOR'S PARCEL NOS. 0292-071-28, 50 AND 52) For valuable consideration, receipt of which is hereby acknowledged, Prologis, a Maryland real estate limited trust ("Grantor"), hereby grants to the City of Redlands a non- exclusive, permanent and perpetual easement together with the right to forever maintain, operate, improve, alter, relocate, reconstruct, inspect, repair and use, and otherwise install necessary appurtenances thereto, for the construction and maintenance of a waterline, as determined by the City of Redlands, and its successors and assigns (collectively, the "City"), together with all necessary rights of ingress and egress to said easement over and across paved portions, to the extent possible of contiguous land now owned by Grantor, under and across that certain real property in the County of San Bernardino, State of California, (the "Easements") described on Exhibit "A" and shown on Exhibit "B", which are attached hereto and incorporated herein by this reference(the"Easement Area"). A. Grantor shall be entitled to utilize the Easement Area for parking, drive aisles, curbing, paving and landscaping and related purposes, other than as set forth above. Grantor shall not erect or construct, or permit to be erected or constructed, any building, structure or permanent improvement on, over, or under any portion of the Easement Area. B. City shall be entitled to reasonably trim, cut or clear away any trees, brush, or other Vegetation or flora from time to time within the Easement Area as City determines, in its sole discretion, without paying any compensation to Grantor. C. Grantor shall not increase or decrease, or permit to be increased or decreased,the existing ground elevation of the Easement Area which exists at the time this document is executed, without obtaining the prior written consent of City. D. City shall return parking, drive aisles, curbing, paving, landscaping and related improvements to their pre-existing condition following construction or maintenance of waterline improvements. -Z4 Dated this . day of June, 2012.
