HomeMy WebLinkAbout02-10-04_CCv0001.pdf MINUTES of the Planning Commission Meeting of the City of Redlands held Tuesday, February 10, 2004, at 2:00 p.m. are as follows: PRESENT: George Webber, Chair James Macdonald, Vice-Chairman Ruth Cook, Commissioner Caroline Laymon, Commissioner Thomas Osborne, Commissioner Paul Thompson, Commissioner ABSENT: Gary Miller, Commissioner ADVISORY STAFF PRESENT: Jeffrey L. Shaw, Director John Jaquess, Assistant Director Leslie E. Murad II, Assistant City Attorney Robert Dalquest, Principal Planner/Project Manager Richard Malacoff, Associate Planner Alicia Heideman, Junior Planner I. CALL TO ORDER AND PUBLIC COMMENT PERIOD Chairman Webber called the meeting to order. All commissioners were present except Commissioners Cook and Miller. II. CONSENT ITEMS - NONE III. OLD BUSINESS - NONE IV. NEW BUSINESS A. BUILDING MOVING PERMIT NO. 114 - Public Hearing for the Planning Commission to consider the relocation of a mobile home to property located on the north side of Lugonia Avenue, 600 feet east of Judson Street(APN 168-161-06) in the A-1, Agricultural Zone. Request submitted by PETER BUOYE. Commissioner Cook arrived at 2:03 p.m. Ms. Alicia Heideman gave a brief PowerPoint presentation on the proposed project. Chairman Webber opened the public hearing. The applicant's representative declined to speak but stated he would be available to answer questions. Chairman Webber closed the public hearing. MOTION It was moved by Commissioner Macdonald,seconded by Commissioner Thompson,and carried on a 6-0 vote that the Planning Commission approve Building Moving Permit No. 114 based on the following findings and attached conditions of approval: 1. The relocation of this structure will have no detrimental effect on the existing living Planning Commission Minutes of February 10, 2004 Pagel environment nor impact the visual aesthetics of the area. 2. The dwelling to be moved relates well with the main residence and its architectural design is compatible with the structures in the vicinity. B. ORDINANCE TEXT AMENDMENT NO. 303 - PUBLIC HEARING for the Planning Commission to consider a recommendation to the City Council on an Ordinance Text Amendment to modify Sections 18.168.050 and 18.168.060 of the Redlands Municipal Code to establish the authority to grant a minor exception permit for the parking of a detached camper, trailer or water craft in the front-yard driveway. Request submitted by the CITY OF REDLANDS. Mr. Bob Dalquest stated this is a follow-up action to the approved Ordinance Text Amendment that allows a minor exception permit to be granted for parking a detached camper,trailer or water craft in the front yard driveway. During its review of the Ordinance Text Amendment, City Council directed staff to include a hardship clause in the amendment where strict compliance is impractical or impossible for the resident. Mr. Dalquest stated the amendment establishes the authority to grant a minor exception permit to park a water craft or recreational vehicle in the front yard driveway. Commissioner Thompson asked if there is a time limit for the minor exception permit. Mr. Dalquest stated the minor exception permit is valid for two(2)years and it applies to one(1)vehicle only. Mr. Dalquest stated if the homeowner moves from the residence, the permit is void. Commissioner Laymon asked if there is a size limitation. Mr. Dalquest stated the vehicle may not overlap onto the City right-of-way. Mr. Shaw noted that there is a sight visibility standard as well.The vehicle may not block the view of pedestrians or vehicular traffic. Chairman Webber asked for information on the conditions that must be met in order for the minor exception permit to be approved. Mr. Dalquest stated the conditions are contained in the Ordinance Text Amendment. Chairman Webber opened the public hearing.Seeing no comments forthcoming, Chairman Webber closed the public hearing. MOTION It was moved by Commissioner Thompson, seconded by Commissioner Cook,and carried on a 6-0 vote that the Planning Commission approve Planning Commission Resolution No. 1023, recommending that the City Council adopt Ordinance Text Amendment No. 303. C. GENERAL PLAN AMENDMENT NO. 97 - PUBLIC HEARING for the Planning Commission to consider a recommendation to the City Council on a Negative Declaration and a General Plan Amendment to change the land use designation from Commercial/Industrial to Commercial on eleven (11) noncontiguous parcels located along the south side of Redlands Boulevard from the west side of Iowa Street to 650 feet west of New Jersey Street. Request submitted by the CITY OF REDLANDS. D. SPECIFIC PLAN NO. 40 (AMENDMENT NO. 27) - PUBLIC HEARING for the Planning Commission to consider a recommendation to the City Council on a Negative Declaration and an amendment to the East Valley Corridor Specific Plan to Planning Commission Minutes of February 10, 2004 Page 2 change the land use designation from EV/IC (Commercial Industrial) District to EV/CG (General Commercial)District on eleven (11)noncontiguous parcels located along the south side of Redlands Boulevard from the west side of Iowa Street to 650 feet west of New Jersey Street, and one 1.88 acre parcel located on the east side of Kansas Street approximately 300 feet south of Redlands Boulevard. Request submitted by the CITY OF REDLANDS. Mr. Dalquest stated the City proposes to change the land use designation for twelve (12) noncontiguous parcels from EV/IC (Commercial Industrial)to EV/CG (General Commercial)within the East Valley Corridor Specific Plan. Mr. Dalquest stated the General Plan amendment is intended to prevent any non-commercial uses from absorbing the remaining viable commercial frontage on Redlands Boulevard. Mr. Dalquest stated the current land use designation, Commercial Industrial, allowed for a mix of commercial and industrial uses including manufacturing, that would not be a compatible land use within this retail corridor. Chairman Webber opened the public hearing. Seeing no comments forthcoming, Chairman Webber closed the public hearing. Mr. Shaw stated that there may be an issue relative to the map of the East Valley Corridor Specific Plan included with the staff report. Mr. Shaw requested that the motion be revised to note corrections to the map. MOTION It was moved by Commissioner Laymon, seconded by Commissioner Macdonald,and carried on a 6-0 vote that the Planning Commission recommend approval to the City Council on the Negative Declaration for General Plan Amendment No. 97 and Specific Plan No. 40 (Amendment No. 27), and direct staff to file and post a "Notice of Determination" in accordance with City guidelines. It is recommended that this project will not individually or cumulatively affectwildlife resources as defined in Section 711.2 of the California Fish and Game Code. MOTION It was moved by Commissioner Laymon, seconded by Commissioner Macdonald,and carried on a 6-0 vote that the Planning Commission approve Planning Commission Resolution No. 1024 recommending to the City Council approval of General Plan Amendment No. 97, changing the designation of the subject properties from Commercial/Industrial to Commercial with designated corrections to the map. MOTION It was moved by Commissioner Laymon, seconded by Commissioner Macdonald,and carried on a 6-0 vote that the Planning Commission approve Planning Commission Resolution No. 1025 recommending to the City Council approval of Specific Plan No.40(Amendment No.27),changing the designation of the subject properties from EV/IC (Commercial Industrial) District to EV/CG (General Commercial) District with designated corrections to the map. E. VARIANCE NO.668-PUBLIC HEARING for Planning Commission consideration of a Variance from Section 18.164 of the Redlands Municipal Code to allow a decrease in the required width of a driveway from twenty-six(26)feet to fourteen (14)feet for Planning Commission Minutes of February 10, 2004 Page 3 two proposed offices located at 224-226 Nordina Street in the A-P, Administrative and Professional Office District. Request submitted by RUSS HUSTON AND JAMES BALLARD. F. VARIANCE NO.671 -PUBLIC HEARING for Planning Commission consideration of a Variance from Section 18.164 of the Redlands Municipal Code to allow a decrease in the required side ward setback from five (5) feet to two (2) feet for an office located at 224-226 Nordina Street in the A-P,Administrative and Professional Office District. Request submitted by JAMES BALLARD. G. COMMISSION REVIEW AND APPROVAL NO. 764 - PUBLIC HEARING for Planning Commission consideration of a recommendation to the City Council on a Mitigated Negative Declaration and a Commission Review Approval for the construction of a 1,748 square foot office building on an 8,250 square foot parcel located at 224 Nordina Street in the A-P, Administrative and Professional Office District. Request submitted by RUSS HUSTON. H. CONDITIONAL USE PERMIT NO. 811 - PUBLIC HEARING for Planning Commission consideration of a recommendation to the City Council on a Mitigated Negative Declaration and a Conditional Use Permit to convert an existing house to an office building located at 226 Nordina Street on an 8,250 square foot parcel in the A-P, Administrative and Professional Office District. Request submitted by JAMES BALLARD. Mr. John Jaquess stated that staff is recommending a continuance to February 24th to provide staff and the applicant sufficient time to work out an agreement on architectural revisions. Mr. Richard Malacoff distributed a corrected copy of the Waiver and Release of Claims. Chairman Webber opened the public hearing. Mr. Richard Hickey, representing the applicant,stated the proposed project has been continued due to scheduling conflicts with his calendar. Mr. Hickey asked the Commission for comments or concerns on the proposed project. Commissioner Osborne asked Mr. Hickey if parking for the project will be located at the 224 Nordina Street address. Mr. Hickey responded by saying that parking will be located between the two sites (224 and 226 Nordina Street). Chairman Webber closed the public hearing. MOTION It was moved by Commissioner Macdonald,seconded by Commissioner Thompson,and carried on a 6-0 vote that the Planning Commission continue Commission Review and Approval No. 764, Conditional Use Permit No. 811, Variance No. 668, and Variance No. 671 to February 24, 2004. I. VARIANCE NO.672-PUBLIC HEARING for Planning Commission consideration of a Variance from Section 18.36 of the Redlands Municipal Code to allow a variance to increase the maximum coverage of a building from twenty-five(25)percent to thirty- Planning Commission Minutes of February 10, 2004 Page 4 two (32) percent for a property located at 1339 La Loma Street in the R-E, Residential Estate District. Request submitted by J. STEPHEN HERMANSON. Mr. Malacoff gave a brief PowerPoint presentation on the proposed project. Mr. Malacoff stated the homeowner is going to sell his home and is attempting to obtain permits for a garage structure that has already been built. Mr. Malacoff stated that a condition of approval was added that requires the applicant to remove the temporary shed located in the front yard setback prior to the issuance of a Building Permit. Chairman Webber opened the public hearing. The applicant's representative declined to speak. Seeing no comments forthcoming, Chairman Webber closed the public hearing. MOTION It was moved by Commissioner Osborne,seconded by Commissioner Laymon,and carried on a 6-0 vote that the Planning Commission approve Variance No. 672 subject to the following findings and attached Conditions of Approval: 1. There are exceptional circumstances or conditions applicable to the property or the intended use that do not apply generally to other properties or uses in the same vicinity and zone, because the lot was subdivided prior to the current regulations and is currently non- conforming with respect to maximum coverage which makes it impossible to make any additions which would satisfy the code requirement. 2. The Variance is necessary for the preservation and enjoyment of a substantial property right possessed by other properties such as 919 La Feliz and granted previously under Variance Nos.553 and 565 which are in the same vicinity and zone district, but which is denied to the property in question. 3. The applicant's request to exceed the maximum coverage by seven (7) percent or 556 feet will not be detrimental to the public welfare or injurious to the property or improvements of others in the vicinity. 4. The granting of such variance will not adversely affect the General Plan of the City of Redlands with the addition of Condition of Approval 7 to read: 7. The applicant shall remove the temporary shed in the front yard setback prior to the issuance of a Building Permit. V. ADDENDA A. Report on Tentative Tract No. 16460 (Applicant: Patrick Meyer) Mr. Jaquess stated that a concern was expressed at the last Planning Commission meeting relative to a possible loss of trees due to the sewer hook up for Tentative Tract No. 16460. Planning Commission Minutes of February 10, 2004 Page 5 Mr. Jaquess stated the applicant is working on preliminary engineering for a sewer line that will run downstream from the houses being built to an existing sewer line. Mr.Jaquess stated at no point will the proposed sewer line go across or through other private property. Mr. Jaquess stated that staff believes the neighbor's concerns over off-site development impacts will not be an issue with this project. Chairman Webber requested that the Public Works Department and the Historic and Scenic Preservation Commission (HSPC) be made aware of their concerns relative to any disturbance to the Zanja or the existing trees. Mr. Jaquess stated he would pass on the information to the HSPC. Commissioner Macdonald asked that Ms. Sherli Leonard, who expressed her concern at the last meeting, be advised of staffs findings. B. Report on Final Landscape Plan for Burgeson's Heating Mr. Jaquess stated that staff went to the Burgeson property and met with the applicant's representative relative to the sign and planter in question. Mr. Jaquess noted that the landscape planter that is located to the south of the sign, is not owned by Burgeson Heating. Mr. Jaquess stated the applicant expressed concern on the trees that were approved for the landscape planter. Mr. Jaquess received a letter from the applicant relative to the Sweet Shade trees, which may be too large for the 10 foot square planter. Mr. Jaquess stated the applicant expressed concern that this type of tree may block the visibility of the sign and interfere with overhead electric power lines. Chairman Webber disagreed and stated that Sweet Shade Trees are deciduous, columnar trees, that grow fairly slowly. Chairman Webber disagreed with the statement that the trees would interfere with power lines. Chairman Webber stated that he did not support the applicant's request to delete the Sweet Shade tree from the approved landscape plan. Commissioner Osborne noted that the landscape planter may have been built incorrectly, and he stated that that it should have been expanded to the east, with the trees located behind the sign. Mr. Shaw stated the owner was notified that he is not in compliance with what was approved. Assistant City Attorney Les Murad stated that the applicant must submit an application if he wants to modify the conditions of approval. Commissioner Thompson requested that the minutes from the August 12th Planning Commission be reviewed to determine what was approved. VI. APPROVAL OF MINUTES A. January 27, 2004 Commissioner Osborne requested the minutes be revised to reflect comments that were made by Planning Commission Minutes of February 10, 2004 Page 6 Mr. Huffstetler. The minutes were tabled. VII. CORRESPONDENCE/COMMUNICATIONS A. City Council Report Mr. Shaw gave a brief summary of the City Council actions of January 3rd B. Status of Major Projects Mr. Shaw reviewed the Status of Major Projects list that was distributed to the Commission. VIII.
