A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS
APPROVING A WAIVER FROM THE REQUIREMENT TO UNDERGROUND
OVERHEAD UTILITIES LESS THAN 66 KV FOR A PROPOSED INDUSTRIAL
WAREHOUSE DEVELOPMENT PROJECT LOCATED AT THE NORTHEAST
CORNER OF MOUNTAIN VIEW AVENUE AND INTERSTATE 10 AND
ACCEPTANCE OF THE PAYMENT OF AN IN -LIEU FEE
WHEREAS, Duke Realty, LP ("Applicant") has filed applications for a Socio-Economic
Cost/Benefit Study and a Planned Development subdivision to construct two industrial warehouse
buildings located at the northeast corner of Mountain View Avenue and Interstate 10 in the Special
Development (EV/SD) District of the East Valley Corridor Specific Plan (collectively, the
"Project"), and
WHEREAS, Redlands Municipal Code Section 17 17 020 (G) (3) allows the applicant to
request that the undergrounding requirement along peripheral street be waived by the approving
body, and accept a fee in lieu of the undergrounding in the amount determined by the City Engineer,
and
WHEREAS, the applicant has provided a formal request to waive the requirement for the
undergrounding of overhead utilities in accordance with RMC Section 17 17 020 (G) (3), and
WHEREAS, the City Engineer has determined that the reasonable estimated cost of a future
undergrounding project for the utilities attribution to the in the amount of three hundred forty eight
thousand one hundred fifty five dollars ($348,155) which has been accepted by the City Engineer,
and
WHEREAS, on May 11, 2021, the Planning Commission held a noticed public hearing at
which interested persons had an opportunity to testify in support of, or in opposition to, the granting
of the waiver, and at which the Planning Commission subsequently recommended adoption to the
City Council, and
WHEREAS, on June 24, 2021, notice of the City Council's public hearing for the proposed
project, , was published in the Redlands Daily Facts by the City Clerk; and
WHEREAS, the City Council held a duly noticed public hearing on July 6, 2021, at which
interest persons had the opportunity to provide verbal and written testimony on the granting of the
waiver, and
WHEREAS, the City Council continued the public hearing on July 6, 2021 to a date certain
on July 20, 2021,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
REDLANDS AS FOLLOWS

Section 1 The granting of the waiver for undergrounding overhead utilities for the
Project is hereby approved based upon the following findings
A THE SUBDIVISION IS WITHIN AN AREA WHERE EXISTING UTILITIES
HAVE NOT BEEN UNDERGROUNDED AND THAT DEFERRAL WILL BE ALLOWED
BECAUSE UNDERGROUND IS IMPRACTICAL DUE TO PHYSICAL CONSTRAINTS, OR
THE SURROUNDING NEIGHBORHOOD IS ABSENT OF SIMILAR IMPROVEMENTS
The project site is in area where existing utilities have not been completely undergrounded
Portions of the surrounding area to the south (in the City of Loma Linda) have large power poles
along the east side of Mountain View Avenue and are absent of similar improvements The area to
the north of the project site (north of the flood control channel) in the City of Redlands does not have
any power poles above -ground and utilities were undergrounded previously along the east side of
Mountain View Avenue Staff recommends this finding may be made
B. OVERHEAD UTILITIES WILL HAVE NO SIGNIFICANT VISUAL IMPACT
The visual character and quality of Mountain View Avenue and surrounding area will not be
detnmentally affected by deferring the undergroundmg of utility lines along this segment of
Mountain View Avenue Along the east side of Mountain View Avenue O. e , the project frontage),
there are existing utility lines that are not underground To the north of the project site along
Mountain View Avenue, projects undergrounded the utility lines on the east side of the street (and
power poles begin on the north side of the flood control channel) To the south of the I-10 freeway
(in the City of Loma Linda) the large utility lines are above -ground and continue south through Loma
Linda Therefore, deferring the undergrounding is not expected to result in any significant visual
impacts since the aforementioned utility lines will remain Staff recommends this finding may be
made
Section 2 Pursuant to Redlands Municipal Code section 17 17 020 G4, if the
undergrounding requirements are waived pursuant to the findings made by this City Council in
section 1, adhere, the in -lieu fee are established by the City Engineer shall be made in condition of
approval of the subdivision requirement.
Section 3 Effective Date This Resolution shall become effective upon adoption
ADOPTED, SIGNED AND APPROVED this 20t s d;of July, 2021
